Even  though  S.A.No.581 of 1989 was admitted by this Court and<br \/>\nnotice was ordered as early as 26.4.1989, till date batta has  not  been  paid<br \/>\nfor  service  of  notice  in  the  above  second appeal on the 5th respondent.<br \/>\nHence, this second appeal is dismissed as against the 5th respondent.\n<\/p>\n<p>        1.2.  Even though S.A.No.662 of 1981 was admitted by  this  Court  and<br \/>\nnotice was ordered as early as on 28.4.1989, till date batta has not been paid<br \/>\nfor  service  of  notice  in  the  above  second appeal on the 7th respondent.<br \/>\nHence, this second appeal is dismissed as against the 7 th respondent.\n<\/p>\n<p>        2.1.  The above second appeals arise against the judgment  and  decree<br \/>\ndated  15.3.1985 made in O.S.No.99 of 1974, laid by one Guruvammal ( deceased)<br \/>\nand Raju alias  Subramanian,  impleaded  as  per  the  order  of  the  learned<br \/>\nSubordinate  Judge,  Ramnad  in  I.A.No.307  of  1981  dated  1.7.1  982,  for<br \/>\ndeclaration of the settlement deed dated 10.7.1973, marked as Ex.B8,  said  to<br \/>\nhave been executed by one Raju Asari, son of Kuttayan Asari and the husband of<br \/>\none Guruvammal (decesased) in favour of the first defendant Chelladurai Asari,<br \/>\nS\/o.Velu  Asari,  who is nonetheless the cousin of Raju Asari, son of Kuttayan<br \/>\nAsari, and to set aside the two sale deeds dated 6.9.1973,  marked  as  Exs.B6<br \/>\nand  B7,  executed  by the said Raju Asari, Son of Kuttayan Asari in favour of<br \/>\nthe defendants 2 and 3, who are the appellants in Second Appeal No.581 of 1989<br \/>\nand to declare that the  plaintiff  is  entitled  to  the  suit  property  and<br \/>\nconsequently for recovery of possession of the said suit property.\n<\/p>\n<p>        2.2.  The plaintiff in the suit seeks the above relief based on a Will<br \/>\ndated  18.12.1970,  marked  as  Ex.A6, executed by the said Raju Asari, son of<br \/>\nKuttayan Asari, contending that after execution of the Will dated  18.12.1970,<br \/>\nthe  testator  \u2013  Raju Asari, son of Kuttayan Asari became unsound in mind and<br \/>\ntherefore, the settlement deed dated 10.7.197 3 as well as two sale deeds even<br \/>\ndated 6.9.1973 executed against the  appellants  in  S.A.No.581  of  1989  are<br \/>\ndeclared to be illegal.\n<\/p>\n<p>        2.3.   The  suit was resisted by the settlee under the settlement deed<br \/>\ndated 10.7.1973 and the  purchasers  under  the  two  sale  deeds  even  dated<br \/>\n6.9.1973,  who are nonetheless the appellants in S.A.No.581 of 1989 contending<br \/>\nthat the said settlement deed and sale deeds being  executed  subsequently  to<br \/>\nthe Will dated 18.12.1970 would prevail over the Will dated 18.12.1970.\n<\/p>\n<p>        2.4.   The  learned Subordinate Judge, Ramanathapuram, by judgment and<br \/>\ndecree dated 15.3.1985 appreciating the evidence, both oral  and  documentary,<br \/>\nadduced  on  behalf of the plaintiffs and the defendants, accepted the case of<br \/>\nthe plaintiffs and decreed the suit, against  which,  the  settlee  under  the<br \/>\nsettlement deed  dated  10.7.1973  preferred  A.S.    No.123 of 1985 while the<br \/>\npurchasers under the sale deeds even dated 6.9 .1973  preferred  A.S.No.64  of<br \/>\n1985  before  the  learned  Additional  District Judge, Ramanathapuram, who by<br \/>\ncommon judgment and decree dated 12 .12.1988 dismissed both  the  appeals  and<br \/>\nconfirmed   the   judgment  and  decree  of  the  learned  Subordinate  Judge,<br \/>\nRamanathapuram dated 15.3.1985 .  Hence, the settlee under the settlement deed<br \/>\ndated 10.7.1973 and the purchaser under the two sale deeds even dated 6.9.1973<br \/>\nhave preferred S.A.Nos.662 of 1989 and 581 of 1989 respectively.\n<\/p>\n<p>        3.  Heard both sides.\n<\/p>\n<p>        4.  It is not in dispute that a Division Bench of  this  Court  by  an<br \/>\norder  in  L.P.A.No.26  of  1980  confirmed  that  the settlement deed dated 1<br \/>\n0.7.1973 is illegal as the same was executed by the said Raju  Asari,  son  of<br \/>\nKuttayan  Asari  in  favour  of Chelladurai Asari, son of Velu Asari, when the<br \/>\nsettlor was not in sound mind.  The above finding had admittedly become final.\n<\/p>\n<p>        5.  Taking note of the above finding and also  appreciating  both  the<br \/>\noral  and  documentary  evidence  adduced on behalf of the plaintiff, both the<br \/>\nCourts below had concurrently held that the sale deed  executed  on  6.9.1973,<br \/>\nwhich  is  subsequent to the settlement deed dated 10.7.197 3 is also illegal,<br \/>\nas the vendor therein namely, Raju  Asari,  Son  of  Kuttayan  Asari,  who  is<br \/>\nnonetheless the husband of the first plaintiff \u2013 Guruvammal (deceased) was not<br \/>\nin sound mind at the time of execution of the above documents.\n<\/p>\n<p>        6.   The  crux  of  the  issue that arises for my consideration in the<br \/>\nabove second appeals is whether Raju Asari, son of Kuttayan Asari, the settlor<br \/>\nin settlement deed dated 10.7.1973 and vendor in sale deeds dated 6.9.1973 was<br \/>\nsound in mind at the time of execution of settlement deed marked as Ex.B8, and<br \/>\nsale deeds marked as Exs.B6 and B7.\n<\/p>\n<p>        7.  Admittedly, a Division Bench of this Court has held in  L.P.A.No.2<br \/>\nof  1980  held  that  Raju Asari, Son of Kuttayan Asari, was not sound in mind<br \/>\nwhile executing the settlement deed dated 10.7.1973.  It is only  appreciating<br \/>\nthe  above  state  of mind of the Raju Asari, son of Kuttayan Asari and taking<br \/>\nnote of the oral and documentary evidence adduced by the plaintiff,  both  the<br \/>\nCourts below found that the vendor \u2013 Raju Asari, son of Kuttayan Asari was not<br \/>\nin  sound  mind at the time of execution of the two sale deeds dated 6.9.1973,<br \/>\nmarked as Exs.B6 and B7.\n<\/p>\n<p>        8.  If that be so, as the issue whether the person was sound  in  mind<br \/>\nor  not at the time of executing the documents marked as Exs.B6, B7 and B8, is<br \/>\npurely a question of fact, it may not be proper for this  Court  to  interfere<br \/>\nwith  such  finding on question of fact, exercising the jurisdiction conferred<br \/>\nunder Section 100 of the Code of Civil Procedure.\n<\/p>\n<p>        Hence, these second appeals are dismissed.
