MATHUR, J.\n<\/p>\n<p>1.\tDelay in filing the special leave petition is condoned.\n<\/p>\n<p>2.\tLeave granted.\n<\/p>\n<p>3.\tThis appeal has been preferred by the State of M.P. against the<br \/>\njudgment and order dated 16.7.2003 of Justice N.S. Azad of M.P. High<br \/>\nCourt in Crl. Appeal No.2244 of 1997.   The appeal is confined as against<br \/>\naccused Badri @ Bhuru.\n<\/p>\n<p>4.\t  The trial Court convicted the accused under Sections 307 and 341<br \/>\nI.P.C.  He was awarded a sentence of 7 years R.I. and a fine of Rs.1,000\/-<br \/>\nand in default to undergo R.I. for a further period of 3 months under the<br \/>\nfirst count and a fine of Rs.200\/- and in default to undergo 10 days R.I.<br \/>\nunder the second count.  The High Court partly allowed the appeal and<br \/>\nwhile upholding the conviction of the accused under Section 307 I.P.C.<br \/>\nreduced the sentence to the period already undergone which is about 5<br \/>\nmonths.\n<\/p>\n<p>5.\tLearned counsel for the appellant has submitted that the sentence<br \/>\nimposed by the High Court is wholly inadequate looking to the nature of<br \/>\nthe offence.\n<\/p>\n<p>6.\tThe High Court has not assigned any satisfactory reason for<br \/>\nreducing the sentence to about 5 months.\n<\/p>\n<p>7.\tThat apart, the High Court has written a very short and cryptic<br \/>\njudgment.  To say the least, the appeal has been disposed of in a most<br \/>\nunsatisfactory manner exhibiting complete non-application of mind. There<br \/>\nis absolutely no consideration of the evidence adduced by the parties.\n<\/p>\n<p>8.\tChapter XXIX of Code of Criminal Procedure deals with<br \/>\nAPPEALS.   Section 384 Cr.P.C. empowers the appellate Court to dismiss<br \/>\nan appeal summarily if it considers that there is no sufficient ground for<br \/>\ninterference.   Section 385 Cr.P.C.  gives the procedure for hearing<br \/>\nappeals not dismissed summarily and Section 386 Cr.P.C. gives the<br \/>\npowers of the appellate <a href=\"\/doc\/1820883\/\">Court.   In Amar Singh v. Balwinder Singh<\/a> 2003<br \/>\n(2) SCC 518, the duty of the appellate Court while hearing a criminal<br \/>\nappeal in the light of the aforesaid provisions was explained and para 7 of<br \/>\nthe report reads as under :\n<\/p>\n<p>&#8220;7.\tThe learned Sessions Judge after placing reliance on<br \/>\nthe testimony of the eye-witnesses and the medical evidence<br \/>\non record was of the opinion that the case of the prosecution<br \/>\nwas fully established.   Surprisingly, the High Court did not<br \/>\nat all consider the testimony of the eye witnesses and<br \/>\ncompletely ignored the same.   Section 384 Cr.P.C.<br \/>\nempowers the Appellate Court to dismiss the appeal<br \/>\nsummarily if it considers that there is no sufficient ground<br \/>\nfor interference.   Section 385 Cr.P.C. lays down the<br \/>\nprocedure for hearing appeal not dismissed summarily and<br \/>\nsub-section (2) thereof casts an obligation to send for the<br \/>\nrecords of the case and to hear the parties.   Section 386<br \/>\nCr.P.C. lays down that after perusing such record and<br \/>\nhearing the appellant or his pleader and the Public<br \/>\nProsecutor, the Appellate Court may, in an appeal from<br \/>\nconviction, reverse the finding and sentence and acquit or<br \/>\ndischarge the accused or order him to be re-tried by a Court<br \/>\nof competent jurisdiction.   It is, therefore, mandatory for the<br \/>\nAppellate Court to peruse the record which will necessarily<br \/>\nmean the statement of the witnesses.   In a case based upon<br \/>\ndirect eye-witness account, the testimony of the eye-<br \/>\nwitnesses is of paramount importance and if the Appellate<br \/>\nCourt reverses the finding recorded by the Trial Court and<br \/>\nacquits the accused without considering or examining the<br \/>\ntestimony of the eye-witnesses, it will be a clear infraction<br \/>\nof Section 386 <a href=\"\/doc\/173865\/\">Cr.P.C.    In Biswanath Ghosh v. State of<br \/>\nWest Bengal &amp; Ors. AIR<\/a> 1987 SC 1155 it was held that<br \/>\nwhere the High Court acquitted the accused in appeal<br \/>\nagainst conviction without waiting for arrival of records<br \/>\nfrom the Sessions Court and without perusing evidence<br \/>\nadduced by prosecution, there was a flagrant mis-carriage of<br \/>\njustice and the order of acquittal was liable to be set aside.<br \/>\nIt was further held that the fact that the Public Prosecutor<br \/>\nconceded that there was no evidence, was not enough and<br \/>\nthe High Court had to satisfy itself upon perusal of the<br \/>\nrecords that there was no reliable and credible evidence to<br \/>\nwarrant the conviction of the accused.   <a href=\"\/doc\/974810\/\">In State of UP v.<br \/>\nSahai &amp; Ors. AIR<\/a> 1981 SC 1442 it was observed that where<br \/>\nthe High Court has not cared to examine the details of the<br \/>\nintrinsic merits of the evidence of the eye-witnesses and has<br \/>\nrejected their evidence on the general grounds, the order of<br \/>\nacquittal passed by the High Court resulted in a gross and<br \/>\nsubstantial mis-carriage of justice so as to invoke extra-<br \/>\nordinary jurisdiction of Supreme Court under Article 136 of<br \/>\nthe Constitution.&#8221;\n<\/p>\n<p>9.\tSince the judgment of the High Court is not in accordance with law,<br \/>\nwe have no option but to set aside the same and to remit the matter back<br \/>\nto the High Court for a fresh consideration of the appeal.   The appeal<br \/>\npreferred by the State of M.P. is accordingly allowed, the judgment and<br \/>\norder of the High Court is set aside and the appeal is remanded back to the<br \/>\nHigh Court for a fresh hearing after issuing notice to the accused<br \/>\nrespondent.
