\nand the  widow of late
\nK.N.Shafi-ujixllap     determination of
\ncompen.=sat_i”o.ni.’ the income of the
\ndeceas_ed–.  ‘ per month is on higher

  not in dispute that Mylari, the son<\/p>\n
  1 and 2 died in a road traffic<\/p>\n
acciden~t_’fwAhile discharging his duties as a<\/p>\n
V’~\u00bb.<:lean'e.r__i3on 11.11.2002 at 1.09 pm., on the way to<\/p>\n
"'-x_"r\u00a7u_blii_A.'.'uru near Iddalanagenahalli gate on account<\/p>\n
  the rash and negligent driving of the lorry.<\/p>\n
According to the respondents 1 and 2, their son<\/p>\n
was discharging his dutiesas a cleaner and died<\/p>\n

while on duty. According to them, the a\u00e9\u00e9e\u00e9s\u00e9dk<\/p>\n
was earning a sum of Rs.4,GOO\/~ pert month Rae?<\/p>\n
salary" in addition to a 'batta?_ of: Re:3\ufb02J;Vdper\u00bb<\/p>\n
day. The deceased was aged about 18 yeags, 7r\ufb01\u00e9T.<\/p>\n
owner of the vehicle Ajoemunisa did not contest
\nthe case. The appellant insdrance coeoanf filed
\nits objections contehd\ufb01ng that since the owner of
\nthe vehicle K.1f{.Shafiauli"la ""cn'A'*:\u00e9:2\u00a7"1o.2oo2 and
\nthe accident;_"'hjaaa'V ole-:c1irj:.'ed':"' :\u00a7\ufb01\u00a2."'l1.1.~;'11.2oo2 i.e..

\npay comheneationim It eaa also contended that the<\/p>\n
deceased Qaa not gettihg a salary of R5.4,000\/-<\/p>\n
s,pervmenth and a 'hatta' of Rs.50\/– per day. The<\/p>\n
d:Commisaloner; by rejecting the- contention of the<\/p>\n
ahpeilanthhfherein has held that there was<\/p>\n
V.relationahip of employer and employee between the<\/p>\n
u""lhdeceaaed"and Ajeemunisa even though the owner of<\/p>\n
4ltheh"?ehicle K.N.Shafiulla died prior to the<\/p>\n
h\ufb02"aacldent. It was also held that the deceased was<\/p>\n
uh"~oetting a salary of Rs.3,000\/– and based on the<\/p>\n

same by taking the factor in terms tcfg the<\/p>\n
Schedule to the Workmen's Compensation_\u00a7ct{ii9\u00a73fn<\/p>\n
awarded compensation of Rs.3,39,5?0[F,VhQ\u00ab$hiew<\/p>\n
judgment and award is called in question in thie<\/p>\n
appeal.\n<\/p>\n
3. The main’ contention rof the” learned
\nCounsel for the appellant hefof\u00e9f\ufb01\ufb01 is since on
\nthe date of..accidenti the “owngf\u00ab\u00a2\u00a7f the vehicle<\/p>\n
Shafiulla “\ufb01asi hotj alive fthere cannot be a<\/p>\n
relationehie of emplo\ufb01er_and employee between the
\ndeceased and–the owner of the vehicle, Shafiulla<\/p>\n
and the liability fixed on the insurance company<\/p>\n

i} positive evidence has been let in to show that<\/p>\n
the deceeeed Qas getting a sum of Rs.3,00G\/* per<\/p>\n
a month as \u00e9alazy.\n<\/p>\n
l4. We are unable to accede to the<\/p>\n
l’~contentions for the following reasons.<\/p>\n
Admittedly the policy is issued wto qthe .<\/p>\n
vehicle covering the risk of the accident.’ It iea<\/p>\n
no doubt true that the vehicle of the oener.diedx<\/p>\n
on 22.10.2002 and the acaia\u00e9ntt o\u00e9e\ufb01rrednfo\ufb01”<\/p>\n

\ndeath of Shafiulla hie wife oelhd the legal heir

\nof Ajeemunle\u00e9\u00ab\ufb01%h\ufb01t\ufb01KtheJ a\u00a7\u00a2\u00e9\u00a7\u00a7\u00a7a’ was not an
\nemployee on her and heh htebana. When deceased
\nhad beenmvienploged Ld\ufb01rlor;lWto the death of
\nShafiulla; even attefathtvdeath of Shafiulla his<\/p>\n
relationship with Ajeemuniea would continue as an<\/p>\n
‘”emplofer and emoloyee. As etated earlier, when<\/p>\n
the Gehicle is insured and it does not cover the<\/p>\n
personal riak of Shafiulla, we are of the opinion<\/p>\n
