SANKARAN, J.\n                    ---------------------------\n                    B.A. No. 6192 of 2009\n                ------------------------------------\n             Dated this the 26th day of October, 2009\n\n                            O R D E R\n<\/pre>\n<p>       This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure. The petitioner is accused No. 5 in<\/p>\n<p>Crime    No.479\/2009      of   Perinthalmanna      Police Station,<\/p>\n<p>Malappuram.\n<\/p>\n<p>       2. The offences alleged against the petitioner are under<\/p>\n<p>Sections 21(b)(ii)(C) and Section 29 of the Narcotic Drugs and<\/p>\n<p>Psychotropic Substances Act.\n<\/p>\n<p>       3. The prosecution case is as follows:<\/p>\n<p>       On 28\/7\/2009, the police got secret information that sale<\/p>\n<p>of Narcotic Drugs was being made in a lorry parked near the side<\/p>\n<p>of Perinthalmanna-Pandikad road. The police party reached the<\/p>\n<p>spot. Accused Nos.1 to 3 were found inside the lorry and accused<\/p>\n<p>Nos.4 and 5 were found outside the lorry. A quantity of 485<\/p>\n<p>grams of Brown sugar was found in the possession of the first<\/p>\n<p>accused and a quantity of 452 grams of Brown Sugar was found<\/p>\n<p>in the possession of the second accused. Accused Nos.3, 4 and 5<\/p>\n<p>were having possession of one gram each of Brown Sugar . The<\/p>\n<p>B.A. No. 6192 \/2009<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>accused persons were arrested on 28\/7\/2009. The investigation<\/p>\n<p>reveals that Brown Sugar was brought from Ujjain and it was<\/p>\n<p>intended for sale in Kerala. The packets containing one gram<\/p>\n<p>each found in the possession of accused Nos.3, 4 and 5 are<\/p>\n<p>sample packets. According to the prosecution, all the accused are<\/p>\n<p>involved in the offence in the same way and the offence against<\/p>\n<p>them is to be treated as offence involving commercial quantity. It<\/p>\n<p>is alleged that the first accused, Abdul Azeez, was convicted for<\/p>\n<p>an offence in Saudi Arabia and he was in jail in Jiddah for a<\/p>\n<p>period of about two years and he was later deported to India. The<\/p>\n<p>second accused Abdu @ Abdul Majeed was involved in a drug<\/p>\n<p>case and he was convicted and sentenced by a court in Bombay.<\/p>\n<p>The second accused was in jail for about five years. It is alleged<\/p>\n<p>that other accused are close associates of accused Nos.1 and 2<\/p>\n<p>and all of them acted for the same object of the sale of large<\/p>\n<p>quantity of Brown Sugar.\n<\/p>\n<p>        4. The petitioner filed B.A. No.4727\/2009, which was<\/p>\n<p>dismissed by the order dated 16\/9\/2009. Thereafter, he        filed<\/p>\n<p>another application, namely, B.A. No.5577\/2009, which was also<\/p>\n<p>B.A. No. 6192 \/2009<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>dismissed by the order dated 9\/10\/2009.<\/p>\n<p>        5. The learned Public Prosecutor opposed the Bail<\/p>\n<p>Application. The learned counsel for the petitioner submits that<\/p>\n<p>the quantitative analysis of the contraband was not done and<\/p>\n<p>therefore the continued detention of the petitioner after 60 days<\/p>\n<p>of the date of arrest is not legal and proper. He relies on the<\/p>\n<p>decision in K. K. Ashraf Vs. State of Kerala [B.A. No.5251\/2009].<\/p>\n<p>In that case, it was held as follows:\n<\/p>\n<blockquote><p>            &#8220;In E.Micheal Raj&#8217;s case, the Supreme Court<\/p>\n<p>      considered the statement of objects and reasons<\/p>\n<p>      concerning the Amendment Act of 2001 and also the<\/p>\n<p>      rationalisation of sentence structure and providing<\/p>\n<p>      strict bail provisions in respect of offenders who<\/p>\n<p>      indulge in serious offences. In view of the judgment<\/p>\n<p>      in E.Micheal Raj&#8217;s case, the prosecution has to<\/p>\n<p>      establish that the narcotic drug or psychotropic<\/p>\n<p>      substance constitutes the commercial quantity in order<\/p>\n<p>      to attract Section 21(c) of the Act. In the present<\/p>\n<p>      case, though the sample was sent for quantitative<\/p>\n<p>B.A. No. 6192 \/2009<br \/>\n<span class=\"hidden_text\">                                 4<\/span><\/p>\n<p>      analysis within few days of seizure,      report is not<\/p>\n<p>      obtained so far.     This Bail Application was being<\/p>\n<p>      adjourned on several occasions providing maximum<\/p>\n<p>      time to the prosecution to make available the FSL<\/p>\n<p>      report. Till now the report is not obtained. Therefore,<\/p>\n<p>      there is no material before the court to come to the<\/p>\n<p>      conclusion that the contraband involves commercial<\/p>\n<p>      quantity.<\/p><\/blockquote>\n<p>               Learned Public Prosecutor submitted that the<\/p>\n<p>      requirement of proof that the content of the narcotic<\/p>\n<p>      drug     in  the  contraband   constitutes  commercial<\/p>\n<p>      quantity arises only at the trial stage and it has no<\/p>\n<p>      relevance while considering the Bail Application. I am<\/p>\n<p>      not inclined to accept this contention in view of the<\/p>\n<p>      specific provisions in the Act.    In order to attract<\/p>\n<p>      Section 21(c) of the Act, there must be material to<\/p>\n<p>      show that commercial quantity is involved.        Such<\/p>\n<p>      material     could normally    be   provided  after  a<\/p>\n<p>      quantitative analysis is made.    Of course, when the<\/p>\n<p>B.A. No. 6192 \/2009<br \/>\n<span class=\"hidden_text\">                                  5<\/span><\/p>\n<p>      quantity involved is so large that even without any<\/p>\n<p>      quantitative analysis it could be inferred that the<\/p>\n<p>      contraband constitutes a commercial quantity, the<\/p>\n<p>      position may be different. But in the present case, the<\/p>\n<p>      quantity involved is only 500 grams.       It cannot be<\/p>\n<p>      inferred that the content of the narcotic drug in the<\/p>\n<p>      contraband constitutes commercial quantity.        That<\/p>\n<p>      there occurs delay in getting the quantitative analysis<\/p>\n<p>      report is not a ground to invoke sub-section (4) of<\/p>\n<p>      Section 36A of the Act on the ground that the<\/p>\n<p>      contraband involves commercial quantity.         Unless<\/p>\n<p>      there are materials to indicate that commercial<\/p>\n<p>      quantity is involved, the court cannot apply sub-<\/p>\n<p>      section (4) of Section 36A of the Act simply because<\/p>\n<p>      an allegation is made without any material that<\/p>\n<p>      commercial quantity is involved.\n<\/p>\n<p>               When the law is clear and it has been<\/p>\n<p>      interpreted by the Supreme Court in E.Micheal Raj&#8217;s<\/p>\n<p>      case, it is not a consolation at all to the accused who<\/p>\n<p>B.A. No. 6192 \/2009<br \/>\n<span class=\"hidden_text\">                                    6<\/span><\/p>\n<p>      has been incarcerated in jail that the report from FSL<\/p>\n<p>      is not received.        When the law provides severe<\/p>\n<p>      punishment for drug trafficking and allied offences,<\/p>\n<p>      there must be sufficient infrastructural facilities for<\/p>\n<p>      implementing the Act and the provisions therein. The<\/p>\n<p>      freedom of citizen cannot be denied only on the<\/p>\n<p>      ground     that   we    do    not   have   the sufficient<\/p>\n<p>      infrastructural facilities to prove before Court without<\/p>\n<p>      delay that the contravention involves commercial<\/p>\n<p>      quantity of the narcotic drug.&#8221;\n<\/p>\n<p>      6.     In view of the Judgment in K.K. Ashraf Vs. State of<\/p>\n<p>Kerala, I am of the view that the petitioner is entitled to get bail<\/p>\n<p>in the present case.\n<\/p>\n<p>        7. The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.50,000\/- with two solvent sureties each for the like<\/p>\n<p>amount to the satisfaction of the Special Court (N.D.P.S. Act<\/p>\n<p>cases), Vadakara subject to the following conditions:-<\/p>\n<blockquote><p>               A)  The petitioner shall appear before the<br \/>\n                   Investigating Officer between 9 A.M. and<br \/>\n                   1 P.M. on all Mondays, till the final report<br \/>\n                   is filed or until further orders;\n<\/p><\/blockquote>\n<p>B.A. No. 6192 \/2009<br \/>\n<span class=\"hidden_text\">                                   7<\/span><\/p>\n<p>               B) The petitioner shall surrender his passport,<br \/>\n                   if any, before the Special Court (N.D.P.S<br \/>\n                   Act cases), Vadakara. If the petitioner<br \/>\n                   does not possess a passport, an affidavit<br \/>\n                   to that effect shall be filed before the<br \/>\n                   court. The surrender of the passport and<br \/>\n                   the filing of the affidavit, as the case may<br \/>\n                   be, shall be done within a period of one<br \/>\n                   week after the release of the petitioner<br \/>\n                   from the jail;\n<\/p>\n<p>               C)  The petitioner shall not leave the State of<br \/>\n                   Kerala without prior permission from the<br \/>\n                   Special    Court   (N.D.P.S     Act   cases),<br \/>\n                   Vadakara;\n<\/p>\n<p>               D) The petitioner shall not try to influence the<br \/>\n                   prosecution witnesses or tamper with the<br \/>\n                   evidence;\n<\/p>\n<p>               E) The petitioner shall not commit any offence<br \/>\n                   or indulge in any prejudicial activity while<br \/>\n                   on bail;\n<\/p>\n<p>               F)  In case of breach of any of the conditions<br \/>\n                   mentioned above, the bail shall be liable<br \/>\n                   to be cancelled.\n<\/p>\n<p>        The Bail Application is allowed as above.<\/p>\n<p>                                    K.T.
