Court of<br \/>\nSmall Causes, Member, VEv&#8217;I5C&#8217;I&#8217;, Me&#8217;t1._t;;x}ii\u00a7an Axea, &#8220;Banga1&lt;m:,<br \/>\n(SCCH.1&#039;i&lt;:;.!5), awarding a &#039;eeinpcnsg-_itioi:._&#039;nf&#039;~Rs.3,88,500[- with<br \/>\ninterest @ 6% pm. from the daie of   payment<\/p>\n<p>This Appeal,   day. the Court<br \/>\ndelivered the  _ _ &quot;  V 4&#039; A. &quot;\n<\/p>\n<p> is    __i:1s\u00a7urance Company, questioning<\/p>\n<p>the quantux\ufb01n  .\n<\/p>\n<p>  parents. brother and sister of the<\/p>\n<p>(ice A ..aeed.\n<\/p>\n<p>A\u20ac:3._._ Ogrze fgsi\u00e9vathappa was moving on his motor cycle on<\/p>\n<p>&#8221; mega; \u00a3egiaway~7, the offending bus came from opposite side in<\/p>\n<p>VA  end negligent manner and dashed against the said motor<\/p>\n<p>  and as a result of which, he su\ufb02emd griexzeazs injury and<\/p>\n<p>   euccumbed to the same. The claimants \ufb01led a claim petition<\/p>\n<p>under Section 163%. of the Motor Vehicles Act inlemiia, stating<\/p>\n<p>&#8211; 3 &#8211;\n<\/p>\n<p>that the deceased was 20 years at the time of accident and was<br \/>\nearning Rs.5,000\/\u00bb per month. The Tribunal consiclef\ufb01xg the<\/p>\n<p>evidence found that, there is no evidence ts take the\u00e9&#8217; pf<\/p>\n<p>the deceased at Rs.5.000l- and considered tbe&#8217;  <\/p>\n<p>deceased at Rs.3.000\/\u00ab. By applyixl\ufb01mtlie&#8217; _&#8217;1x\u20aci&#8217;.x&#8221;tiL3y &#8216; 7 AV<\/p>\n<p>tak1n&#8217; g into consideration the age of  <\/p>\n<p>compensation towards loss of tiepeiidencsr at  Iii<br \/>\nall. it granteci compensa\ufb01ortof R.~.a.-&#8216;.&#8221;;3,*\u00a3.%&#8217;8*S(}&#8217;.&#8217;}_.f~  at 6%<\/p>\n<p>4.  t&#8221;.Aev11;nseI;A_ submitted<br \/>\nthat. in cases&#8217;   .parents. the age of the<\/p>\n<p>parents hi-es __purpose of determining the loss of<\/p>\n<p>dependency&#8217;   the deceased. He also submitted<\/p>\n<p>that,  * :1e1me1&#8242;-. Aieireuncxtstatnces, in case of bachelor. 50%<\/p>\n<p> ~ bevm\u00e9teen. He further submitted that. the<\/p>\n<p> Rs.15,000]- per annum should have been<\/p>\n<p>  takeia  the  of Rs.36.(}0O] &#8211; per annum.<\/p>\n<p>V A&#8217; *5,&#8217; Vvbeamed Counsel for the claimants submitted that,<\/p>\n<p>%  claimants are parents, bmther and sister, since the<br \/>\nT tieeeesed was the only earning member of the family and<\/p>\n<p>D?   being the dependants, coxisidering the age of the minor<\/p>\n<p>sister and parents, the Tr&amp;una1 has rightly taken the age of the<\/p>\n<p><span class=\"hidden_text\">-5-<\/span><\/p>\n<p>of the deceased for the purpose of determining the loss of<\/p>\n<p>dependency.\n<\/p>\n<p>7. Insofar as deduction is conccmed.  <\/p>\n<p>deceased was the only earning member and *&#8217;;&#8217;:.i{: <\/p>\n<p>naturally would have been more,  \ufb01n.  1.23;: &#8216;<\/p>\n<p>family, particularly, the claim pezg\ufb01on %*V\u00a2mam se\u00e9ti\u00a23;%V16}3&#8211;A  .<\/p>\n<p>applicable to the class of peopk\ufb01u m&lt;;st\u00ab  &#039;vfh\ufb01ivficazning is<br \/>\nspent on the livelihood_ ..  schedule<br \/>\nshows deduction of V1\/Std  \ufb01nch, I am not in<br \/>\na\ufb01leement with  Counsel for the<br \/>\nappellant for  P\u00e9rgonal expenses of the<\/p>\n<p>dcceascd. &quot; &quot;&quot;&quot;  A &quot;\n<\/p>\n<p>8.
