Learned APP Mr.<br \/>\nJani waives service of Rule on behalf of the respondent   State.\n<\/p>\n<p>\tThis<br \/>\napplication is filed under section 439 of the Code of Criminal<br \/>\nProcedure by the applicant who has been arrested in connection with<br \/>\nC.R. No. I &#8211; 639 of 2008  filed before the Salabatpura Police<br \/>\nStation, Surat for the offence punishable under sections 406, 420,<br \/>\n114 and 120(B) of the Indian Penal Code.\n<\/p>\n<p>\tMr. Rathod, learned<br \/>\nadvocate for the applicant submitted that the applicants are the<br \/>\ninnocent persons and a false case is foisted on them. The allegations<br \/>\nlevelled against the applicants are general in nature. This is a<br \/>\nclear case of civil nature and the complainant has to file Civil Suit<br \/>\nagainst the applicants. He  submitted that considering the role<br \/>\nattributed to the applicants and reflected in the FIR at Annexure &#8216;A&#8217;<br \/>\nto the application, this is a fit case to enlarge the applicants on<br \/>\nregular bail.\n<\/p>\n<p>\tAs against the aforesaid,<br \/>\nlearned APP Mr. Jani submitted that considering the role played by<br \/>\nthe applicant, no discretionary relief can be granted to the<br \/>\napplicant and the application deserves to be dismissed.\n<\/p>\n<p>\tHaving heard the rival<br \/>\nsubmissions of learned advocates and having considered the role<br \/>\nattributed to the applicant and reflected in the FIR at Annexure A,<br \/>\nthe quantum of punishment, gravity of the offence etc., I am of the<br \/>\nview that the the applicants are required to be enlarged on regular<br \/>\nbail at this stage on stringent conditions, without entering into the<br \/>\nmerits of the case and  without discussing the evidence in detail.\n<\/p>\n<p>\tThe parties do not press<br \/>\nfor further reasoned order.\n<\/p>\n<p>\tIn the facts and<br \/>\ncircumstances of the case, the petition is allowed and the applicants<br \/>\nare ordered to be enlarged on bail in connection with  C.R. No. I &#8211;<br \/>\n639 of 2008 registered with Salabatpura Police Station, Surat on<br \/>\ntheir executing a bond of Rs.10,000\/- [Rupees Ten thousand only] each<br \/>\nwith one surety of the like amount to the satisfaction of the trial<br \/>\ncourt and subject to the conditions that they shall:\n<\/p>\n<p>[a]\tnot take undue<br \/>\nadvantage of their liberty or abuse their liberty;\n<\/p>\n<p>[b].\tnot act in a manner<br \/>\ninjurious to the interest of the prosecution;\n<\/p>\n<p>[c].\tsurrender their<br \/>\npassport, if any, to the lower court within a week;\n<\/p>\n<p>[d].\tnot leave the State<br \/>\nof Gujarat without the prior permission of the Sessions court<br \/>\nconcerned;\n<\/p>\n<p>[e].\tnot leave the<br \/>\nterritory limits of Surat City as well as District without prior<br \/>\npermission of the learned Sessions Court.\n<\/p>\n<p>(f).\tfurnish the present<br \/>\naddress of his residence to the I.O. and also to the Court at the<br \/>\ntime of execution of the bond and shall not change their residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>[g].\tmaintain law and<br \/>\norder.\n<\/p>\n<p>\tIf breach of any of the<br \/>\nabove conditions is committed, the Sessions Judge concerned will be<br \/>\nfree to issue warrant or to take appropriate action in the matter.\n<\/p>\n<p>\tBail bond to be executed<br \/>\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tAt the trial, the trial<br \/>\nCourt shall not be influenced by the observations of preliminary<br \/>\nnature, qua the evidence at this stage, made by this Court while<br \/>\nenlarging the applicants on bail.\n<\/p>\n<p>\tRule is made absolute to<br \/>\nthe aforesaid extent.
