Civil Revision Application No. 19 of 2002\n          MR MUKUND M DESAI for Petitioners No. 1-2\n          .......... for Respondent No. 1\n\n\n     --------------------------------------------------------------\n\n\n              CORAM : MR.JUSTICE SHARAD DAVE\n\n\n              Date of Order: 10\/01\/2002\n\n\nORAL ORDER<\/pre>\n<p>     With the consent of the LAs for the parties, the<br \/>\n     matter is heard finally and disposed of at admission<br \/>\n     stage only.\n<\/p>\n<p>     2.Mr.   Desai, LA for the petitioner submits that,<br \/>\n     in pursuance to the tender the petitioner was given order<br \/>\n     to provide certain articles. On account of the dispute<br \/>\n     arisen between the parties, the suit was filed by the<br \/>\n     present respondent against the present petitioner. being<br \/>\n     Summary Suit, No. 3787 of 2000, to recover the sum of<br \/>\n     Rs.68,900\/- in the court of City Civil Court, Ahmedabad,<br \/>\n     At the time of hearing of summary suit, the Trial Court<br \/>\n     was   pleased to order for depositing an amount of<br \/>\n     Rs.35,000\/in the court within 4 weeks from the date of<br \/>\n     the order and thereby, granted a conditional leave to<br \/>\n     defend the suit by passing the detailed order on 20th<br \/>\n     Sept. 2001.\n<\/p>\n<p>     3.Being dissatisfied by the said order, passed by<br \/>\n     the Ld.    City Civil Judge, Ahmedabad, the original<br \/>\n     defendant filed this revision application under Sec. 115<br \/>\n     of the CPC and contended that the order is not clear and<br \/>\n     as such the same requires the interference of this Hon.<br \/>\n     Court.\n<\/p>\n<p>     It was further contended that, in the said order<br \/>\n      the Chamber Judge of the City Civil Court, Ahmedabad, has<br \/>\n     observed as under:-\n<\/p>\n<p>&#8220;On the other  hand, the defendants have only<br \/>\n             raised bare contentions of the supply of inferior<br \/>\n             quality of the goods at a belated stage on the<br \/>\n             ground that the said fact is intimated to the<br \/>\n             plaintiff by the defendnats. But no documentary<br \/>\n             evidence establishing the said fact is brought on<br \/>\n             record by the defendants. Hence, I do not see<br \/>\n             genuine defence in the said contentions except of<br \/>\n             defence on jurisdictions and supply of inferior<br \/>\n             quality of the goods by the        plaintiff   no<br \/>\n             substantial    defences   are   raised   by   the<br \/>\n             defendants.&#8221;\n<\/p>\n<p>     4.Therefore, the submission of Mr. Desai, LA for<br \/>\n     the petitioner, is that, there is contradictory statement<br \/>\n     made by the Ld.     Trial Court Judge.     Therefore, the<br \/>\n     petitioner seeks interference of this Honourable Court.<br \/>\n     I have perused the judgment and order passed by the Ld.<br \/>\n     Chamber Judge.    At that, time, there may be        some<br \/>\n     discrepancy in the order passed by the Ld. Trial Court<br \/>\n     Judge, but ultimately, the order passed in Civil Suit by<br \/>\n     the Ld.    Trial Court judge is required to be seen as a<br \/>\n     whole and not in a part. From reading the whole order,<br \/>\n     it appears that, there is no jurisdictional error or<br \/>\n     anything which may call for interference        by   this<br \/>\n     Honourable Court.\n<\/p>\n<p>     5.When the order was dictated by me in the open<br \/>\n     court, Mr.    Desai, LA for the petitioner submits that,<br \/>\n     the amount which is ordered to be deposited by the<br \/>\n     defendant University is very high.       Therefore, some<br \/>\n     amount be reduced. I do not think it just and proper to<br \/>\n     interfere with the order passed by the Ld.
