Kuriakose, J.\n\n                  - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n\n                           W.P.(C) No.  1831   of  2008\n\n                  - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n\n                  Dated this the 21st   day of January,2008\n\n\n                                     JUDGMENT\n<\/pre>\n<p>        Learned   Government   Pleader   submits   that   there   is   no   serious<\/p>\n<p>objection   for   the   District   Collector   being   directed   to   take   an   early<\/p>\n<p>decision on Ext.P4 representation   submitted by the petitioner wherein<\/p>\n<p>the  prayer is that a direction may be issued to facilitate a measurement<\/p>\n<p>of   the   property   for   identifying   the   alleged   puramboku     area   in   the<\/p>\n<p>possession of the petitioner Wakaf.\n<\/p>\n<\/p>\n<p>        2. The learned counsel for the petitioner submits that a few trees<\/p>\n<p>which stood on the properties have been cut down, the timber has been<\/p>\n<p>lying on  the  property  for    some time now.  A few items  have already<\/p>\n<p>been   stolen.   Therefore,   the   learned   counsel   wants     a   direction   to   the<\/p>\n<p>District Collector to conduct public auction of those trees which were<\/p>\n<p>cut   down   from   the   alleged   puramboku   area     of   the   properties   and   to<\/p>\n<p>remit   the   proceeds   in   the   treasury   in   an   account   which   fetches   the<\/p>\n<p>maximum interest  so that ultimately the amount can be disbursed to the<\/p>\n<p>eligible party after decision is taken on Ext.P4 representation.<\/p>\n<p><span class=\"hidden_text\">WPC 1831\/2008                             2<\/span><\/p>\n<p>       3. In the circumstances, I am of the view that the above request<\/p>\n<p>is reasonable. Accordingly, the writ petition stands disposed of issuing<\/p>\n<p>the following directions:-\n<\/p>\n<\/p>\n<blockquote><p>       The   2nd  respondent   is   directed   to   take   up   Ex.P-4<\/p>\n<p>       representation   immediately  and   facilitate     a   measurement<\/p>\n<p>       of   the   properties,   which   are   subject   matter   of   this   writ<\/p>\n<p>       petition,   by   a   competent   surveyor   at   the   earliest   with<\/p>\n<p>       notice   to   the   petitioner,   the   1st  respondent   panchayat   and<\/p>\n<p>       also   other   neighbouring   owners,   if   any,   and   thereby<\/p>\n<p>       identify   the     puramboku   portions   of   the   property.   This<\/p>\n<p>       shall be done as early as possible, at any rate within three<\/p>\n<p>       month   of   receiving   copy     of   this   judgment.   In   the<\/p>\n<p>       meanwhile, the 3rd  respondent is directed to sell the trees,<\/p>\n<p>       which were cut down by the petitioner from that portion of<\/p>\n<p>       the   property,     which   is   rightly   puramboku,   in   public<\/p>\n<p>       auction   and   to   deposit   the   proceeds   of   the   same   in   an<\/p>\n<p>       account   with   the   treasury   which   fetches   the   maximum<\/p>\n<p>       interest.   The   2nd  respondent,   while   deciding   Ext.P4,   will<\/p>\n<p><span class=\"hidden_text\">WPC 1831\/2008                             3<\/span><\/p>\n<p>       also decide the manner in which the proceeds deposited in<\/p>\n<p>       the   treasury   is   to   be   disbursed     ultimately.   The   learned<\/p>\n<p>       counsel for the petitioner further submits that certain trees<\/p>\n<p>       have   been   cut   down   from   the     property,   which<\/p>\n<p>       undisputedly and absolutely belongs to the petitioner.     If<\/p>\n<p>       trees   have  been  cut  down  from  the property   which,  even<\/p>\n<p>       according to the 3rd  respondent, belongs to the petitioner,<\/p>\n<p>       the petitioner should be permitted  to dispose of those trees<\/p>\n<p>       in what ever manner they like.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                                                        Pius C.
