Upon<br \/>\n\tcompletion of the said period in the year 1983 when the Corporation<br \/>\n\ttried to reclaim possession, petitioner resisted the same.<br \/>\n\tProceedings under the Gujarat Public Premises (Eviction of<br \/>\n\tUnauthorised Occupants) Act was undertaken. Competent Authority as<br \/>\n\twell as Civil Court in appeal held the petitioner to be unauthorised<br \/>\n\toccupant, directed his eviction and also decided to levy penalty for<br \/>\n\this extended unauthorised use.\n<\/p>\n<p>At<br \/>\n\tthe time of admission of the matter on 1.4.2002, it was recorded<br \/>\n\tthat petitioner is not interested in getting back the possession.<br \/>\n\tWith respect to recovery also, though the  Court refused any interim<br \/>\n\tprotection but provided that such recovery will be subject to the<br \/>\n\tresult of the petition.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances, I have heard learned advocate for the parties on<br \/>\n\tthe quantum of penalty.\n<\/p>\n<p>Learned<br \/>\n\tcounsel Shri Vyas for the petitioner submitted that even as per the<br \/>\n\tST Corporation, highest bid received in the year 1983 was of Rs.<br \/>\n\t3500\/- per month by way of license fee whereas authorities have<br \/>\n\tcharged penalty at the rate of Rs.10,000\/- per month and thereupon<br \/>\n\tcalculated interest at the rate of 18% without any basis.\n<\/p>\n<p>On<br \/>\n\tthe other hand, counsel for the ST Corporation contended that<br \/>\n\tpetitioner is not traceable. He has not paid any amount towards<br \/>\n\tpenalty. He opposed the petition.\n<\/p>\n<p>Having<br \/>\n\theard learned advocates for the parties and having perused the<br \/>\n\taverments on record, I am of the opinion that monthly fee of<br \/>\n\tRs.3500\/- offered by highest bidder in the year 1983 can be taken as<br \/>\n\tbase for fixing penalty amount to be collected  from the petitioner.<br \/>\n\tEven counsel for the petitioner did not dispute that in his<br \/>\n\tagreement with Corporation there was a clause for escalation of<br \/>\n\tlicense fees. Obviously, license fee agreed cannot apply in a block<br \/>\n\tperiod of 10 years or more. However, the terms on which highest<br \/>\n\tbidder had agreed to suffer such escalation are not on record. To<br \/>\n\tprovide for a rate formula, I am of the opinion that 10% increase<br \/>\n\tper year on the license fee of Rs.3500\/- would be in order.
