\nand outpatinet an\u00e9i   towards medical expenses.
\nInspite of ‘trevat\ufb01ent  unable to sit, squat, stand for long<\/p>\n
t1me’v._ee\u00a71e’eeVpeed1e<bicye1e. Hence, he \ufb01led the claim petition<\/p>\n
 \u00bb . before  Saundatti.\n<\/p>\n

evidence at Exs.P.1 to R5 learned Add1.MAC’I’, Saundatti, awarded<\/p>\n
compensation of Rs.2,81,\u20ac}90\/– with intezest at 80\/0 <\/p>\n
under chalienge.\n<\/p>\n
4. Heard the arguments of the    u<\/p>\n
appeann’ g on both sides and perused the   -. I. _ ”<\/p>\n

appellant] insurer is that the  ‘ toL11Iy…vi\u00a7en~ed in
\nawal\ufb01ing compensation undef’   Liof  earmn’ g<\/p>\n
cayacity’ to the extent _of.__Rs. ‘iespondent has<\/p>\n
not proved oefore’  “he was earning Rs.2,000\/-
\npm. by disttibu\ufb01yggo I}6\\g7’S  Vthat village. The Tribunal has

In the absence of any docuxnentary eetdenteef  the fact
\nthat respondent NO.1 is a  j’ ought to
\nhave assessed the loss of  —- the courts
\nbelow has taken     totally incomect.\n<\/p>\n
Likewise, the   Vo\ufb02ler heads is totally<\/p>\n
incomect.\n<\/p>\n
6. Exfen though_’Vthe–._t1espondent has not produced the
\nmedical   show  has spent Rs.33,804\/\u00ab the Tzibunal<\/p>\n
has’-a\ufb01avatiiieti [ssfptpof Rs.33,800\/- towards the medical expenses<\/p>\n
  without proper apprecia\ufb01on of the evidence.<\/p>\n
 ptaysu 2:_t}.:v1’at the appeal be ailowed by reducing the<\/p>\n

\ndoctor] P.W.2, gthe  suffers 35% of

8. Having heard the arguments of the learned c.o1z.1ise1<\/p>\n
appearing on both sides, the only substantial question…tliat:<\/p>\n
for my consideration and decision is Whether  T’  V’ <\/p>\n

9. I have carefully examined the   <\/p>\n
by both part1e’ s. There is no disptiteavith “r(‘=,–ggimd to Vvehicleli’<\/p>\n
involved in the accident and “\ufb02r_1_e  respondent
\nNo. 1 on 25\/7)’ 2095 near   The Wound<\/p>\n
certi\ufb01cate discloses.  the };as”:.;-iigstained grievous<\/p>\n
injuries for  lie   treatment both as inpatient
\nand outpatient.   summaxy discloses that he was
\n;aamgttcd;ei:5,4,i7\/2oo4\u00ab;;md discharged on 3\/3\/2004. This fact<\/p>\n
of  of respondent has been made clear by<\/p>\n
   he has sustained in all 4 injuries. P.W.2<\/p>\n
   assessed the permanent partial disability.<\/p>\n
  ‘o\u20ac.pundei~going ueaiment there is swelling. Thezefoxe, after<\/p>\n
  ilrieeent X-xays by examining both chemically and<\/p>\n
 iadiologcally, P.W.2 came to the conclusion that the 15’<\/p>\n
 iespondent su\ufb01ers 35% of the permanent partial disability to a<\/p>\n
particular limb. Even in the cross~examination he .i  <\/p>\n
that he has assessed the disability   5<\/p>\n
particular part of the body. Wheteas, ‘\u00abTIibn,iia1i  <\/p>\n
permanent partial disabiiity to the  of 25023 toassess the loss V<\/p>\n
of earning capacity. Of   has not
\nproduced any salary’  employer i.e, the
\nagent of the news; 11i3;’.}.d\u20acf(*’ \ufb01g  working as news
\npaper distzibutdn   about 16 years. But
\naccording   ‘iie;vvas aged about 14 years,
\nTherfore,  toha wrong conclusion by taking<\/p>\n
his incomeat tliieirate.  \/ – per month. So, in the absence<\/p>\n
 any  ..income’ia–\u00abf_he case of minor, the notional income<\/p>\n
“a:t’Rs.15,000\/~ pa. Therefore, the income taken<\/p>\n
  the Rs.24,000l– is excessive and the same is liable<\/p>\n

each t0w\u00a7s1ds- of expectation of life and loss of marriage<\/p>\n
