      This is an application for anticipatory bail under Section 438<\/p>\n
of the Code of Criminal Procedure. The petitioner is the accused<\/p>\n
in Crime No.40\/2010 of Kovalam Police Station.<\/p>\n
      2.    The offences alleged against the petitioner are under<\/p>\n
Sections 7 and 14 of the Foreigners Act and Rule 14 of the<\/p>\n
Registration of the Foreigners Rules.<\/p>\n
      3.    The prosecution case is that the petitioner is a foreign<\/p>\n
national, who allowed other foreign nationals to stay in<\/p>\n
Naalangoli Tourist Home Private Limited, Kovalam without giving<\/p>\n
the necessary information to the police officer concerned.<\/p>\n
      4. Section 7 of the Foreigners Act reads as follows:<\/p>\n
               “Obligation of hotel keepers and others to<\/p>\n
         furnish particulars:\n<\/p>\n
               It shall be the duty of the keeper of any<\/p>\n
         premises whether furnished or unfurnished<\/p>\n
         where lodging or sleeping accommodation is<\/p>\n
         provided for reward, to submit to such person<\/p>\n
         and in such manner such information in respect<\/p>\n

              of foreigners accommodated in such premises,<\/p>\n
              as may be prescribed.\n<\/p>\n
                    (2) Every person accommodated in any<\/p>\n
              such   premises shall     furnish to the keeper<\/p>\n
              thereof a statement containing such particulars<\/p>\n
              as may be required by the keeper for the<\/p>\n
              purpose of furnishing the information referred<\/p>\n
              to in sub-section(1).\n<\/p>\n
                    (3) The keeper of every such premises<\/p>\n
              shall maintain a record of the information<\/p>\n
              furnished by him under sub-section(1) and of<\/p>\n
              the information obtained by him under sub-<\/p>\n
              section (2) and such record shall be maintained<\/p>\n
              in such manner and preserved for such period<\/p>\n
              as may be prescribed, and shall at all times be<\/p>\n
              open to inspection by any police officer or by a<\/p>\n
              person authorised in this behalf by the District<\/p>\n
              Magistrate.\n<\/p>\n
                    (4) If in any area prescribed in this behalf<\/p>\n
              the prescribed authority by notice published in<\/p>\n
              such manner as may in the opinion of the<\/p>\n
              authority be best adapted for informing the<\/p>\n
              persons concerned so directs, it shall be the<\/p>\n
              duty of every person occupying or having under<\/p>\n
              his control any residential premises to submit to<\/p>\n
              such   person    and   in   such  manner     such<\/p>\n

              information     in     respect   of    foreigners<\/p>\n
              accommodated in such premises as may be<\/p>\n
              specified; and the provisions of sub-section (2)<\/p>\n
              shall apply to every person accommodated in<\/p>\n
              any such premises.\n<\/p>\n
                    7A. Power to control places frequented by<\/p>\n
              foreigners:\n<\/p>\n
                    (1) The prescribed authority may, subject<\/p>\n
              to such conditions as may be prescribed, direct<\/p>\n
              the owner or person having control of any<\/p>\n
              premises used as a restaurant or as a place of<\/p>\n
              public resort or entertainment or as a club and<\/p>\n
              frequented by foreigners-\n<\/p>\n
                    a) to close such premises either entirely or<\/p>\n
              during specified periods, or<\/p>\n
                    b) to use or permit the use of such<\/p>\n
              premises only under such conditions as may be<\/p>\n
              specified, or<\/p>\n
                    c) to refuse admission to such premises<\/p>\n
              either to all foreigners or to any specified<\/p>\n
              foreigner or class of foreigners.\n<\/p>\n
                    (2). A persons to whom any direction has<\/p>\n
              been given under sub-section (1) shall not,<\/p>\n
              while such direction remain in force, use or<\/p>\n
              permit to be used any other premises for any of<\/p>\n
              the   aforesaid   purposes,   except   with   the<\/p>\n

              previous permission in writing of the prescribed<\/p>\n
              authority and in accordance with any conditions<\/p>\n
              which that authority may think fit to impose.<\/p>\n
                    (3). Any person to whom any direction has<\/p>\n
              been given under sub-section(1) and who is<\/p>\n
              aggrieved thereby may, within thirty days from<\/p>\n
              the date of such direction, appeal to the Central<\/p>\n
              Government; and the decision of the Central<\/p>\n
              Government in the matter shall be final.”<\/p>\n
         5. Section 14 of the Foreigners Act provides that if any<\/p>\n
person contravenes the provisions of this Act or of any order<\/p>\n
made thereunder, or any direction given in pursuance of this Act<\/p>\n
or such order, he shall be punished with imprisonment for a term<\/p>\n
which may extend to five years and shall also be liable to fine.<\/p>\n
         6. When the Bail Application came up for hearing on<\/p>\n
02.02.2010, the learned counsel for the petitioner insisted for an<\/p>\n
interim order. After hearing the learned counsel for the petitioner<\/p>\n
and the learned Public Prosecutor the following order was passed<\/p>\n
on 02.02.2010.\n<\/p>\n
                      “The     learned     Public   Prosecutor<\/p>\n
                 submitted that the petitioner will not be<\/p>\n
                 arrested for a period of ten days,on condition<\/p>\n
                 that  the   petitioner  shall  surrender  her<\/p>\n

                 passport and travel documents before the<\/p>\n
                 commissioner of Police, Thiruvananthapuram<\/p>\n
                 City, on or before 03.02.2010.\n<\/p>\n
                       Post after a week”\n<\/p>\n
         7. The condition in the order dated 02.02.2010 is that the<\/p>\n
petitioner shall surrender her passport and travel documents<\/p>\n
before the Commissioner of Police, Thiruvananthapuram City, on<\/p>\n
or before 03.02.2010.\n<\/p>\n
         8. The learned Public Prosecutor submitted that the<\/p>\n
petitioner has not complied with the direction. No explanation is<\/p>\n
offered by the petitioner for not complying with the direction in<\/p>\n
the order dated 02.02.2010. The petitioner is represented by<\/p>\n
another counsel now.\n<\/p>\n
         9. The offences alleged against the petitioner are grave in<\/p>\n
nature. I am of the view that the petitioner is not entitled to the<\/p>\n
discretionary relief under Section 438 of the Code of Criminal<\/p>\n
Procedure. Custodial interrogation of the petitioner may be<\/p>\n
required in the present case. Accommodating foreigners in a<\/p>\n
tourist home without complying with the mandatory requirements<\/p>\n
of the Foreigners Act is very serious. The provisions of the<\/p>\n
Foreigners Act in this regard are intended to achieve certain<\/p>\n

objects. It is aimed at getting the necessary correct information<\/p>\n
regarding the movement of foreign nationals in the country. I do<\/p>\n
not think that in a case of this nature, the accused is entitled to<\/p>\n
anticipatory bail. Moreover, in spite of the specific order passed<\/p>\n
on 02.02.2010, the petitioner has not complied with the direction<\/p>\n
and no explanation is offered by the petitioner for not complying<\/p>\n
with the direction in the order dated 02.02.2010.<\/p>\n
         10. For the aforesaid reasons, I am of the view that the<\/p>\n
petitioner is not entitled to any discretionary relief under<\/p>\n
Section 438 of the Code of Criminal Procedure.<\/p>\n
         Accordingly, the Bail Application is dismissed.<\/p>\n
