Civil Appeal No.<br \/>\n25\/2005 dated 15.12.2010 passed by the learned Presiding Officer &amp;<br \/>\nAddl. District Judge, Mehsana, and also for the prayer to quash and<br \/>\nset aside the order below Ex. 8 in Revision Application No. 14\/2004<br \/>\ndated 21.3.2005 passed by In-charge Charity Commissioner, Ahmedabad,<br \/>\nand also for the direction to restore the order passed on Change<br \/>\nReport No. 280\/2002 dated 26.8.2002 passed by the learned Asst.<br \/>\nCharity Commissioner, Mehsana.\n<\/p>\n<p>2.\tHeard<br \/>\nlearned advocate Mr. Darji for the petitioners.\n<\/p>\n<p>3.\tWithout<br \/>\ngoing into the merits, since as per the order passed in  Misc. Civil<br \/>\nAppeal No. 25\/2005 dated 15.12.2010, the Charity Commissioner has<br \/>\nremanded the matter back to the Asst. Charity Commissioner for<br \/>\ndeciding afresh,  learned advocate Mr. Darji does not press this<br \/>\npetition at this stage.  Therefore, the Asst. Charity Commissioner<br \/>\nshall decide the matter afresh in accordance with law after providing<br \/>\nan opportunity of hearing to all concerned including the present<br \/>\npetitioners and shall consider the objections and the contentions<br \/>\nraised by the petitioners on merits.  The Asst. Charity Commissioner<br \/>\nshall therefore decide the contentions with regard to the Change<br \/>\nReport no. 280\/2002 within a period of three months from today after<br \/>\nhearing all concerned.\n<\/p>\n<p>4.\tIt<br \/>\ngoes without saying that he shall decide the same on merits in<br \/>\naccordance with law without being influenced by the order passed by<br \/>\nthe learned Addl. District Judge in  Misc. Civil Appeal No. 25\/2005<br \/>\nas well as the Charity Commissioner  and it is also clarified that<br \/>\nthis court has also not considered the merits of the case either way.<br \/>\nTherefore, he will pass appropriate order in accordance with law on<br \/>\nmerits after hearing all concerned.\n<\/p>\n<p>5.\tWith<br \/>\nthe aforesaid observations, the present petition stands disposed of<br \/>\nas not pressed.
