Justice V.RAMKUMAR\n\n Dated :08\/10\/2010\n\n O R D E R\n                         V.RAMKUMAR, J.\n              ----------------------------------------------\n               Bail Application No.5964 of 2010\n             ------------------------------------------------\n            Dated this the 8th day of October, 2010\n\n                                ORDER\n<\/pre>\n<p>      The petitioner, who is the sole. accused in Crime<\/p>\n<p>No.1042 of 2010 of Kundara Police Station, Kollam District for<\/p>\n<p>offences punishable under Sections 294(b) &amp; 506 (ii) I.P.C. &amp;<\/p>\n<p>3(v), (viii) &amp; (xv) of SC\/ST (Prevention of Atrocities) Act, seeks<\/p>\n<p>anticipatory bail.\n<\/p>\n<p>      2.     The   learned     Public     Prosecutor      opposed the<\/p>\n<p>application.\n<\/p>\n<p>      3.     Anticipatory bail cannot be granted in a case of<\/p>\n<p>this nature. But at the same time, I am inclined to permit the<\/p>\n<p>petitioner to surrender before the Investigating Officer for the<\/p>\n<p>purpose of interrogation and then to have his application for<\/p>\n<p>bail considered by the Magistrate having jurisdiction.<\/p>\n<p>Accordingly, the petitioner shall surrender before the<\/p>\n<p>investigating officer on 20\/10\/2010 or on 21\/10\/2010 for<\/p>\n<p>the purpose of interrogation and recovery of incriminating<\/p>\n<p>material, if any. The petitioner shall thereafter be produced<\/p>\n<p>before the Magistrate concerned and file an application for<\/p>\n<p>regular bail. On being convinced that the petitioner has been<\/p>\n<p>Bail Appln.No.5964\/2010<br \/>\n<span class=\"hidden_text\">                                  : 2 :<\/span><\/p>\n<p>interrogated by the police, the Magistrate shall preferably on<\/p>\n<p>the same date on which the application is filed, release the<\/p>\n<p>petitioner on bail on his executing a bond for Rs.15,000\/-<\/p>\n<p>(Rupees fifteen thousand only) with two solvent sureties each<\/p>\n<p>for the like amount to the satisfaction of the Magistrate and<\/p>\n<p>subject to the following conditions:-\n<\/p>\n<blockquote><p>       1.    The     petitioner   shall  report   before    the<\/p>\n<p>             Investigating Officer between 9 a.m. and 11 a.m.<\/p>\n<p>             on all Wednesdays.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>       2.   The petitioner shall make himself available for<\/p>\n<p>             interrogation including custodial interrogation as<\/p>\n<p>             and when required by the Investigating Officer.<\/p>\n<\/blockquote>\n<blockquote><p>       3.    The petitioner shall not influence or intimidate<\/p>\n<p>             the prosecution witnesses nor shall he attempt to<\/p>\n<p>             tamper with the evidence for the prosecution.<\/p>\n<\/blockquote>\n<blockquote><p>       4.    The petitioner shall not commit any offence while<\/p>\n<p>             on bail.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>        5.
