RULE.\n<\/p>\n
\tLearned A.P.P. waives service of rule on behalf of the
\n\trespondent-State and Mr.Ravani, learned Counsel, waives service on
\n\tbehalf of respondent No.2.\n<\/p>\n
These
\n\trevision applications filed by the same petitioner challenging two
\n\tseparate orders passed by C.B.I. Court. In Criminal Revision
\n\tApplication No.424 of 2008 the petitioner has challenged a portion
\n\tof the order dated 25.04.2006 passed by Special C.B.I. Court below
\n\tExh.1 in CBI Criminal Misc. Application No.81 of 2004 in Special
\n\tCase No.20 of 2003, whereas in Criminal Revision Application No.425
\n\tof 2008 the petitioner has challenged a portion of the order dated
\n\t13.10.2006 passed by Special C.B.I. Court below Exh.7 in CBI
\n\tCriminal Misc. Application No.147 of 2006 in Special Case No.20 of
\n\t2003.\n<\/p>\n
The
\n\tpetitioner is a government servant employed in the Department of
\n\tCustoms and Central Excise. While in service, C.B.I. allegedly
\n\tunearthed properties disproportionate to known source of his income.
\n\tSaid case is, therefore, instituted against him. It is the case of
\n\tC.B.I. that the petitioner has amassed wealth to the tune of
\n\tRs.21,10,440\/- in excess of his known source of income. The
\n\tinvestigating agency therefore, seized his properties, documents,
\n\tsealed lockers not only of the petitioner but also of other family
\n\tmembers. Petitioner therefore, moved abovementioned applications
\n\tseeking release of the properties. It was in these applications the
\n\tC.B.I. Court passed two separate orders impugned in these petitions.\n<\/p>\n
In
\n\tso far as order dated 25.04.2006, which is impugned in Criminal
\n\tRevision Application No.424 of 2008 is concerned, learned Judge
\n\tissued following directions:\n<\/p>\n
“1.\tThis
\n\tCBI Criminal Misc. Application No.81 of 2004 is partly allowed as
\n\tunder:-\n<\/p>\n
The
\n\topponent CBI is hereby permitted and directed to release the
\n\tdocuments relating to the properties mentioned in the re-numbered
\n\titems at sr.nos.1 to 4 of page no.1 annexed to Exh.10 to the
\n\tapplicant\/original accused after following the requisite procedure.\n<\/p>\n
The
\n\topponent CBI is hereby permitted and directed to release the
\n\tdocument relating to the property mentioned in the re-numbered item
\n\tat sr.no.1 of page no.2 annexed to Exh.10 to the applicant\/original
\n\taccused after following the requisite procedure.\n<\/p>\n
The
\n\topponent CBI is hereby permitted and directed to release the
\n\tarticles re-numbered at item nos.1 to 4 of page no.3 annexed to
\n\tExh.10 to the applicant\/original accused after following the
\n\trequisite procedure.\n<\/p>\n
So
\n\tfar as above directions in Sub Para 1(i) and 1(ii) are concerned,
\n\tthe same may be carried out by the opponent CBI on the
\n\tapplicant\/original accused giving undertaking that he shall not sell
\n\tor pledge or in any manner, whatsoever not to transfer the said
\n\timmovable properties. So far as the above direction in Sub Para
\n\t1(iii) is concerned, the same may be carried out by the opponent CBI
\n\ton the applicant\/original accused giving undertaking to produce the
\n\tsame in the Court as and when so ordered.\n<\/p>\n
As
\n\tregards the prayer for the applicant\/original accused to renew etc.
\n\tthe Fixed Deposits, the Bonds etc. etc., which have matured for
\n\tencashment of the same are\u00a0concerned, the applicant\/ original
\n\taccused is hereby directed to bring the said facts to the notice of
\n\tthe opponent CBI Gandhinagar in writing requesting to have the
\n\trenewal or re-investment of the maturity value and the opponent CBI
\n\tis hereby directed to have the same renewed or re-invested. The
\n\topponent CBI is also directed that after the renewed or
\n\tre-investment of the relevant securities, the same shall be taken
\n\tinto their possession and custody along with the original matured
\n\tencashed documents, furnishing xerox copies of the same, if so
\n\trequired to the concerned Institution.\n<\/p>\n
As
\n\tregards the amount shown in item no.40 of the statement-B of the
\n\tCharge Sheet at Mark 3\/1 is concerned, on the request in writing
\n\tmade by the applicant\/original accused, the opponent CBI shall
\n\tarrange to have the relevant amount deposited in the Fixed Deposit
\n\tas may be desired by\u00a0the applicant\/original accused and the
\n\topponent CBI then take into his custody the relevant documents of
\n\tthe said Fixed Deposit.”\n<\/p>\n
The
\n\tpetitioner is aggrieved to the limited extent of the part of
\n\tdirections contained in sub-para (iii) of the operative portion,
\n\twhich can be reproduced again for ready reference:\n<\/p>\n
“So
\n\tfar as above directions in Sub Para 1(i) and 1(ii) are concerned,
\n\tthe same may be carried out by the opponent CBI on the
\n\tapplicant\/original accused giving undertaking that he shall not sell
\n\tor pledge or in any manner, whatsoever not to transfer the said
\n\timmovable properties. … …”\n<\/p>\n
In
\n\tso far as order dated 13.10.2006, which is impugned in Criminal
\n\tRevision Application No.425 of 2008 is concerned, the court rejected
\n\tthe prayer of the petitioner for release of seized ornaments kept in
\n\tthe lockers in the name of the wife of the petitioner and other
\n\tfamily members. The petitioner is also aggrieved by the direction to
\n\thand over the service revolver to the Customs Department contained
\n\tin the said order, which reads as under:\n<\/p>\n
“As
\n\tregards locker no.209 A (key no. 214) Central Bank of India, Gulbai
\n\tTekra, Ambawadi, Ahmedabad shall be opened by the I.O. accompanied
\n\tby the Accused and two witnesses and shall open this locker and
\n\tGovernment service revolver lying in the locker may be handed over
\n\tto the Competent Authority of the Custom and Central Excise where
\n\tthe Applicant Accused is serving subject to completing necessary
\n\tprocedure as ma be required.”\n<\/p>\n
Counsel
\n\tfor the petitioner submitted that fixed deposits, in the name of the
\n\tpetitioner and other family members totaling to Rs.21,16,946\/-, are
\n\tstill invested in different banks and originals thereof are in the
\n\tcustody of CBI Court. He submitted that such amount is sufficient to
\n\tcover the entire alleged excess wealth amassed by the petitioner. If
\n\tsuch amount is left untouched, it would not be necessary to freeze
\n\tother properties and belongings of the petitioner and other family
\n\tmembers. He submitted that many of these properties were purchased
\n\teven prior to period under consideration.\n<\/p>\n
Counsel
\n\tfor the CBI opposed the request, contending that the courts below
\n\thave committed no error.\n<\/p>\n
Upon
\n\tperusal of the documents and hearing counsel for the parties, I am
\n\tof the opinion that as long as fixed deposits are left untouched,
\n\twhich would cover the entire disputed amount, the remaining
\n\tproperties may be released. The details of such fixed deposits are

With
\n\trespect to the direction not to deal with the properties, when I am
\n\tof the opinion that the fixed deposits in the custody of CBI Court
\n\twould sufficiently safeguard the interest of both sides, such
\n\trestriction is no longer required to be imposed. Further, with
\n\trespect to the service revolver, it is stated that the petitioner is
\n\tstill in the service of the Customs Department. In that view of the
\n\tmatter, the revolver shall be returned to the petitioner. He shall,
\n\thowever, intimate this development to his department, who may
\n\tthereafter take such steps as may be found necessary in accordance
\n\twith law.\n<\/p>\n
One
\n\tlast safeguard is needed that some of the fixed deposits are in the
\n\tname of relatives of the petitioner, they shall also file an
\n\tundertaking before CBI Court that eventually if while passing final
\n\torder the court adjust the amounts of such fixed deposits, they will
\n\tnot raise any objections for the same being done.\n<\/p>\n
In
\n\tthe result, revision applications are disposed of with the following
\n\tdirections:\n<\/p>\n
CBI
\n\tCourt shall continue to hold the original documents of the
\n\tpetitioner, fixed deposits, details of which are given in para No.9
\n\tof the order. Such fixed deposits shall be re-invested, as and when
\n\tthey matured, till final disposal of the criminal proceedings;\n<\/p>\n
relatives
\n\tof the petitioner, in whose names such fixed deposits are shown,
\n\tshall file undertaking within four weeks to the effect that they
\n\twill not raise any objections if the court adjusts the amounts of
\n\tsuch fixed deposits towards recovery while passing final order;\n<\/p>\n
properties
\n\tmentioned in Paragraph No.(10) of this order shall be released
\n\tunconditionally;\n<\/p>\n
directions
\n\tfor not dealing with the immovable properties contained in the order
\n\tdated 25.04.2006 is deleted;\n<\/p>\n
condition
\n\tfor handing over service revolver to the customs department is
\n\tdeleted. The petitioner shall, however, intimate having received
\n\tsuch revolver to his department.\n<\/p>\n
Impugned
\n\torders stands modified to the said extent. Direct service is
\n\tpermitted.\n<\/p>\n
