Justice K.T.SANKARAN\n\n Dated :23\/10\/2009\n\n O R D E R\n                        K.T.SANKARAN, J.\n                  ---------------------------------------------\n                         B.A.No.6128 of 2009\n                  ---------------------------------------------\n             Dated this the 23rd day of October, 2009\n\n\n\n                               ORDER\n<\/pre>\n<p>        This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure. The petitioners are accused Nos.1<\/p>\n<p>to 6 in Crime No.86 of 2009 of Rajapuram Police Station,<\/p>\n<p>Kasaragod District.\n<\/p>\n<p>      2.   The offences alleged against the petitioners are under<\/p>\n<p>Sections 143, 147, 148, 341, 324, 326 and 307 read with Section<\/p>\n<p>149 of the Indian Penal Code.\n<\/p>\n<p>      3.   The date of occurrence was on 8.8.2009. The<\/p>\n<p>petitioners were arrested on 6.10.2009. It is submitted by the<\/p>\n<p>learned Public Prosecutor that the investigation is at the final<\/p>\n<p>stage.\n<\/p>\n<p>      4.   Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioners, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioners on stringent conditions.<\/p>\n<p><span class=\"hidden_text\">BA No.6128\/2009                   2<\/span><\/p>\n<p>     The petitioners shall be released on bail on their executing<\/p>\n<p>bond for Rs.25,000\/- each with two solvent sureties for the like<\/p>\n<p>amount to the satisfaction of the Judicial Magistrate of the First<\/p>\n<p>Class-I, Hosdurg, subject to the following conditions:<\/p>\n<p>a)   The petitioners shall report before the investigating officer<br \/>\n     between 9 A.M.       and    11 A.M.     on every Monday and<br \/>\n     Thursday, till the final report is filed or until further orders;<\/p>\n<p>b)   The petitioners shall appear before the investigating officer<br \/>\n     for interrogation as and when required;<\/p>\n<p>c)   The petitioners shall not try to influence the prosecution<br \/>\n     witnesses or tamper with the evidence;<\/p>\n<p>d)   The petitioners shall not commit any offence or indulge in<br \/>\n     any prejudicial activity while on bail;<\/p>\n<p>e)   In case of breach of any of the conditions mentioned above,<br \/>\n     the bail shall be liable to be cancelled.<\/p>\n<p>     The Bail Application is allowed as above.<\/p>\n<p>                                                 K.T.SANKARAN,<br \/>\n                                                        JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Bhaskaran T. vs State Of Kerala Through The on 23 October, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 6128 of 2009() 1.
