Justice ANTONY DOMINIC\n\n Dated :08\/02\/2008\n\n O R D E R\n                            ANTONY DOMINIC,J.\n\n\n                            W.P.(C)NO. 4201 of 2008.\n\n\n\n\n         DATED THIS THE 8th  DAY OF  FEBRUARY 2006\n\n\n\n\n                                   JUDGMENT\n<\/pre>\n<p>       The   petitioner   is   a   registered   dealer.     A   consignment     of<\/p>\n<p>imported timber has been detained   by Ext.P1 on the allegation<\/p>\n<p>of   undervaluation.     The   petitioner   submits     that   undervaluation<\/p>\n<p>indicated is quantified  on the value as per circular No.41\/06 and<\/p>\n<p>50\/06.     While,   according   to   the   petitioner,   the   rates   indicated<\/p>\n<p>therein   is   totally   unrealistic,   the   learned   Government   Pleader<\/p>\n<p>defends the action by stating that the market value is much more<\/p>\n<p>than   what is indicated in the circular.   It is also stated that the<\/p>\n<p>fixation   of   value     in   the   circular   has   been   done   with   the<\/p>\n<p>concurrence of dealers like the petitioner.\n<\/p>\n<p>       Be that   as it may, I feel that this is a matter for enquiry.\n<\/p>\n<p>Pending such enquiry, I do not think it necessary that the goods<\/p>\n<p>have   to   be     continued   under   detention,   especially   as   the<\/p>\n<p>petitioner   is   a   registered   dealer.     Therefore,   I   direct   that   if   the<\/p>\n<p>petitioner   executes   the   bond   without   sureties,   the   respondents<\/p>\n<p><span class=\"hidden_text\">W.P.(C)NO.4201\/2008              -2-<\/span><\/p>\n<p>shall release the goods to the petitioner subject to   enquiry and<\/p>\n<p>adjudication.
