     Plaintiff in O.S.88\/1988 on the file of Munsiff<\/p>\n
Court,          Thiruvananthapuram                        is         the          appellant.\n<\/p>\n
Respondent   is   the   defendant.                                     Plaintiff   and<\/p>\n
respondent are husband and wife.  The suit is filed<\/p>\n
seeking         a         decree         for         permanent                   prohibitory<\/p>\n
injunction   restraining   respondent   from   trespassing<\/p>\n
into   the   plaint   schedule   property.     Admittedly   the<\/p>\n
relationship   between   the   parties   are   strained.\n<\/p>\n
Petition was filed by appellant before Family Court<\/p>\n
for judicial separation.  Under Exts.A1 and A2, the<\/p>\n
title   of   the   plaint   schedule   property   vests   with<\/p>\n
the   appellant.     According   to   appellant,   respondent<\/p>\n
left   the   house   and   is   living   away   from   the<\/p>\n
appellant   since   May,1987.                               The   case   of   the<\/p>\n
appellant   was   that   respondent   is   not   entitled   to<\/p>\n
reside   in   her   house   and   therefore   he   is   to   be<\/p>\n
restrained   by   a   permanent   prohibitory   injunction.\n<\/p>\n

Respondent   in   the   written   statement   contended   that<\/p>\n
the property was purchased with his funds and he is<\/p>\n
residing   in   that   house   till   appellant   left   the<\/p>\n
house   on   17.11.87.              It   was   contended   that<\/p>\n
respondent   is   entitled   to   reside   in   the   house   and<\/p>\n
appellant is not entitled to the decree sought for.\n<\/p>\n
Learned   Munsiff   framed   the   necessary   issues.     On<\/p>\n
the   evidence   of   plaintiff   as   PW1   and   defendant   as<\/p>\n
DW1,   Exts.A1   to   A4   and   B1   to   B6   learned   Munsiff<\/p>\n
held     that   Exts.A1   and   A2   establish     title   of   the<\/p>\n
appellant   and   case   of     respondent   that   the   amount<\/p>\n
for   purchase   of   the   plaint   schedule   property   was<\/p>\n
advanced   by   him   was   not   proved.     Learned   Munsiff<\/p>\n
also   found   that   appellant   is   in   exclusive<\/p>\n
possession   of   the   building   and   against   her   wishes<\/p>\n
respondent   is   not   entitled   to   reside   therein   and<\/p>\n
therefore   granted   a   decree   restraining   respondent<\/p>\n
from trespassing into the plaint schedule property.\n<\/p>\n
Respondent   challenged   the   decree   and   judgment<\/p>\n
before   the   District   Court,   Thiruvananthapuram   in<\/p>\n
A.S.435\/1991.          Learned          District         Judge         on<\/p>\n

reappreciation   of   evidence   confirmed   the   findings<\/p>\n
of the learned Munsiff that the title of the plaint<\/p>\n
schedule   property   vests   with   the   appellant.\n<\/p>\n
Learned   District   Judge   on   the   evidence   found   that<\/p>\n
respondent   being   her   husband   is   also   residing   in<\/p>\n
that   building   and   in   a   suit   for   injunction<\/p>\n
question   of   possession   on   the   date   of   the   suit   is<\/p>\n
to  be  considered.    Analysing  the  evidence    learned<\/p>\n
District   Judge   found   that   the   husband   is   also<\/p>\n
residing   in   that   house.     Holding   that   so   long   as<\/p>\n
the   marital   relationship   subsists   the   husband   is<\/p>\n
entitled to reside therein,  learned District Judge<\/p>\n
held   that   the   decree   for   injunction   is   only   a<\/p>\n
discretionary   relief   and   the   appellant   is   not<\/p>\n
entitled   to   the   decree   for   injunction   granted   by<\/p>\n
the   learned   Munsiff.   The   decree   granted   was   set<\/p>\n
aside and the suit was dismissed.  It is challenged<\/p>\n
in the second appeal.\n<\/p>\n
        2.         The   Second   Appeal   was   admitted   after<\/p>\n
formulating   the   following   substantial   questions   of<\/p>\n
law.\n<\/p>\n

      1)     Whether   the   first   Appellate   Court   was<\/p>\n
correct   in   interfering   with   the   decree   granted   by<\/p>\n
the  trial  court  after  upholding  the  finding  on  the<\/p>\n
question of title.\n<\/p>\n
      2)   Whether the finding of the first Appellate<\/p>\n
Court  that  respondent  is  entitled  to  reside  in  the<\/p>\n
plaint schedule building is sustainable?\n<\/p>\n
      3.  Learned counsel appearing for appellant and<\/p>\n
respondent were heard.\n<\/p>\n
      4.     The   argument   of   learned   counsel   appearing<\/p>\n
for   appellant   was   that   though   respondent   disputed<\/p>\n
the   title   the   trial   court   and   the   first   Appellate<\/p>\n
Court  on  evidence  held  that  appellant  has  title  to<\/p>\n
the   property   under   Exts.A1   and   A2.     It   was   also<\/p>\n
argued   that         courts   below   also   found   that<\/p>\n
appellant   has   established   her   possession   of   the<\/p>\n
property.     It   is   therefore   argued   that   in   such<\/p>\n
circumstance, first Appellate Court should not have<\/p>\n
interfered   with   the   decree   granted   by   the   trial<\/p>\n
court.     The   argument   of   learned   counsel   appearing<\/p>\n
for appellant was that trial court analysed     each<\/p>\n

item   of   evidence   in   the   proper   perspective   and<\/p>\n
found   that   the   documents   relied   on   by   the<\/p>\n
respondent   were   subsequent   to   the   institution   of<\/p>\n
the suit and therefore first Appellate Court should<\/p>\n
not have interfered with the decree.\n<\/p>\n
      5.           On   hearing   learned                   counsel   for   the<\/p>\n
appellant   and   respondent,   it   is   clear   that   the<\/p>\n
marital   relationship   between   the   husband   and   wife<\/p>\n
still   subsists.     Though   a   petition   for   judicial<\/p>\n
separation was filed before the Family Court by the<\/p>\n
wife,   it   was   not   successful.     So   long   as   the<\/p>\n
marital   relationship   subsists,   the   wife   is   not<\/p>\n
entitled to contend that husband is not entitled to<\/p>\n
come and reside with her.   On the evidence learned<\/p>\n
District   Judge   found   that   respondent   husband   is<\/p>\n
also   residing   in   the   plaint   schedule   building   on<\/p>\n
the   date   of   the   filing   of   the   suit.     Learned<\/p>\n
District              Judge         also         found         that         being         a<\/p>\n
discretionary   relief   appellant   is   not   entitled   to<\/p>\n
get   decree   for   injunction.                       On   the   facts   and<\/p>\n
circumstances   of   the   case,   I   do   not   find   any<\/p>\n

substantial question of law involved in the appeal.\n<\/p>\n
So   long   as   the   marital   relationship   subsists,   the<\/p>\n
wife   is   not   entitled   to   contend   that     husband   is<\/p>\n
not   entitled   to   reside   with   her.            In   such<\/p>\n
circumstance, I do not find any reason to interfere<\/p>\n
with   the   decision   of   the   District   Judge   holding<\/p>\n
that   appellant   is   not   entitled   to   the   decree   for<\/p>\n
permanent prohibitory injunction sought for.\n<\/p>\n
      Appeal is dismissed.\n<\/p>\n
