Heard       Shri      Sunil    Kumar,    learned<\/p>\n<p>                       counsel for the petitioner and Shri Ajay<\/p>\n<p>                       Kumar Sinha, learned counsel appearing on<\/p>\n<p>                       behalf    of        all   the    respondents\/Allahabad<\/p>\n<p>                       Bank.\n<\/p>\n<p>                                 The        petitioner     in     extraordinary<\/p>\n<p>                       writ jurisdiction has prayed for directing<\/p>\n<p>                       the     respondents\/Bank           to     consider     his<\/p>\n<p>                       appointment with effect from 1.12.1972 and<\/p>\n<p>                       thereafter,         calculate     his    entire    retiral<\/p>\n<p>                       dues. The petitioner, as per pleading, was<\/p>\n<p>                       appointed as Part Time Clerk in Allahabad<\/p>\n<p>                       Bank     on     1.11.1972.         Subsequently,       his<\/p>\n<p>                       service       was    terminated     with     effect   from<\/p>\n<p>                       17.12.1976. However, on 20.11.1982, he was<\/p>\n<p>                       appointed       in    regular      service    as   Clerk.<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>After     his     appointment,           he      raised     the<\/p>\n<p>dispute for his initial date of appointment<\/p>\n<p>and     vide       circular            dated      30.4.1993,<\/p>\n<p>predating was accepted and his service was<\/p>\n<p>predated        with       effect       form     28.10.1981.<\/p>\n<p>Subsequently, the petitioner retired with<\/p>\n<p>effect from 29.2.1996. It is not in dispute<\/p>\n<p>that    petitioner,           after      retirement,         had<\/p>\n<p>received all the retiral dues. It further<\/p>\n<p>appears that petitioner thereafter raised a<\/p>\n<p>dispute    before          the    Controlling      Authority<\/p>\n<p>under Payment of Gratuity Act and finally<\/p>\n<p>the Controlling Authority under the Payment<\/p>\n<p>of     Gratuity        Act       and    Assistant        Labour<\/p>\n<p>Commissioner (Central), Patna, by its order<\/p>\n<p>dated 2.11.2009, has rejected the claim of<\/p>\n<p>the petitioner. One of the main ground for<\/p>\n<p>rejection of claim by the Assistant Labour<\/p>\n<p>Commissioner was that the matter was stale<\/p>\n<p>one and petitioner, after retirement in the<\/p>\n<p>year    1996,    had       received      all   the     retiral<\/p>\n<p>dues.     The     order          of     Assistant        Labour<\/p>\n<p>Commissioner          (Central),         Patna     has      been<\/p>\n<p>brought    on     record         as    Annexure-3      to    the<\/p>\n<p>petition. Surprisingly in the present writ<\/p>\n<p>petition,       the       petitioner     has     not   at   all<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>        made a prayer for quashing of the order of<\/p>\n<p>        Assistant     labour         Commissioner      nor     the<\/p>\n<p>        petitioner has brought on record, the order<\/p>\n<p>        whereby he was appointed in the year 1982.<\/p>\n<p>                   The court is of the opinion that<\/p>\n<p>        since the petitioner had already retired in<\/p>\n<p>        the   year    1996      i.e.     on     29.2.1996      and<\/p>\n<p>        received all the retiral dues, after such a<\/p>\n<p>        long delay, no relief can be granted to the<\/p>\n<p>        petitioner. Moreover in the writ petition,<\/p>\n<p>        the   petitioner       has    not     even   brought   on<\/p>\n<p>        record      his       appointment       letter       dated<\/p>\n<p>        20.11.1982, nor the communication, whereby<\/p>\n<p>        in the year 1972, he was appointed as Part<\/p>\n<p>        Time Clerk in the Bank.
