JUSTICE JYOTI SARAN\n\n              ORAL ORDER<\/pre>\n<p>              (Per: HONOURABLE THE CHIEF JUSTICE)<\/p>\n<p>2.   24.2.2011.                    Feeling aggrieved by the judgment and order<br \/>\n                      dated 7th January 2011 passed in above C.W.J.C. No.<br \/>\n                      17482 of 2009 the writ petitioner has preferred the<br \/>\n                      present Appeal under Clause 10 of the Letters Patent.\n<\/p>\n<p>                                   The appellant claims that he had been<br \/>\n                      granted licence for fair price shop under the public<br \/>\n                      distribution scheme by the order made by the Sub<br \/>\n                      Divisional Officer, Mahnar on 4th September 2006. On<br \/>\n                      the said premise the appellant filed the above C.W.J.C.<br \/>\n                      No. 17482 of 2009 for a direction to the respondents to<br \/>\n                      make allotment of wheat, rice, kerosene oil and other<br \/>\n                      essential commodities to the appellant.\n<\/p>\n<p>                                   In an earlier writ petition being C.W.J.C. No.<br \/>\n<span class=\"hidden_text\">                           -2-<\/span><\/p>\n<p>          2231 of 2008 filed by the petitioner in the subject matter,<br \/>\n          under order dated 7th July 2008 made by the learned<br \/>\n          single Judge, it was held, &#8220;the exercise carried by the<br \/>\n          Sub Divisional Officer cannot be considered to be in<br \/>\n          consonance with the procedure laid down by the State<br \/>\n          authorities&#8221;.\n<\/p>\n<p>                      The learned single Judge noted that the State<br \/>\n          Government      had    constituted   a    District   Selection<br \/>\n          Committee and the licences were to be issued on their<br \/>\n          recommendation. The learned single Judge held that the<br \/>\n          appellant had not been granted licence. In absence of a<br \/>\n          licence issued to the appellant his claim for allotment of<br \/>\n          food grains and other essential commodities was not<br \/>\n          sustainable. We are in agreement with the learned single<br \/>\n          Judge. In absence of a licence granted to the appellant,<br \/>\n          the appellant had no claim for allotment of the food<br \/>\n          grains and other essential commodities. Further, the<br \/>\n          petitioner&#8217;s claim based on an order made by the Sub<br \/>\n          Divisional Officer without the authority of law could not<br \/>\n          have been sustained.\n<\/p>\n<p>                      We see no substance in this Appeal. The<br \/>\n          Appeal is dismissed in limine.\n<\/p>\n<p>                                (R.M.
