Kuriakose, J<\/p>\n<p>       The appellants who were claimants before the<\/p>\n<p>Reference Court in a reference under Section 28A(3) are<\/p>\n<p>aggrieved in that, the learned Subordinate Judge refused to<\/p>\n<p>place reliance on the judgment in LAR.123\/87, a copy of<\/p>\n<p>which was produced by the appellants in the enquiry<\/p>\n<p>conducted by the Reference Court. The properties belonging<\/p>\n<p>to the appellants situated in Sasthamcotta village of Kollam<\/p>\n<p>District was acquired for the construction of Chavara branch<\/p>\n<p>canal of Kallada Irrigation Project pursuant to Section 4(1)<\/p>\n<p>notification published on 15\/01\/83. They were awarded land<\/p>\n<p>value at the rate of Rs.4,197\/- per Are as against a claim of<\/p>\n<p>Rs.34,580\/- per Are. The appellants, however, did not seek<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.1329 of 2010     -2-<\/span><\/p>\n<p>a reference under Section 18. However, on coming to know<\/p>\n<p>that enhanced compensation has been awarded by the<\/p>\n<p>Reference Court to the claimant in LAR.20\/92 whose<\/p>\n<p>properties had been acquired for the same purpose pursuant<\/p>\n<p>to the same notification, he filed an application under<\/p>\n<p>Section 28A for redetermination of the compensation<\/p>\n<p>payable to him on the basis of the court award in<\/p>\n<p>LAR.20\/92. The Land Acquisition Officer allowed the above<\/p>\n<p>application and awarded him enhanced compensation at the<\/p>\n<p>rates fixed by the Reference Court under its judgment in<\/p>\n<p>LAR.20\/92. Being not satisfied with the above award, the<\/p>\n<p>appellant sought for a reference under Section 28A(3) which<\/p>\n<p>was favourably considered. In the enquiry held by the court<\/p>\n<p>in the 28A(3) Reference, the appellant relied on another<\/p>\n<p>court award in LAR.123\/1987. Under the above award rates<\/p>\n<p>higher than the rates awarded under LAR.20\/92 had been<\/p>\n<p>awarded to the party thereto. The learned Subordinate<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.1329 of 2010       -3-<\/span><\/p>\n<p>Judge did not become inclined to place any reliance on the<\/p>\n<p>award in LAR.123\/1987. According to the court, the<\/p>\n<p>appellant who had relied on the court award in LAR.20\/92 is<\/p>\n<p>not justified in seeking enhancement higher than what had<\/p>\n<p>been awarded to the party in LAR.20\/92. It was also noticed<\/p>\n<p>incidentally by the learned Subordinate Judge that the<\/p>\n<p>acquisition covered by LAR.123\/87 was pursuant to a<\/p>\n<p>different notification under Section 4(1).<\/p>\n<p>      2. In this appeal various grounds are raised challenging<\/p>\n<p>the     judgment       of the learned   Subordinate     Judge.<\/p>\n<p>Sri.B.Suresh Kumar, the learned counsel for the appellants<\/p>\n<p>addressed arguments on the basis of those grounds. He<\/p>\n<p>placed strong reliance on the judgment of the Supreme<\/p>\n<p>Court in <a href=\"\/doc\/543981\/\">Ramakrishna Rao v. Singareni Collieries Com. Ltd.<\/a><\/p>\n<p>(2010(4) KLT 255 SC). According to the learned Counsel,<\/p>\n<p>the above judgment is authority for the proposition that a<\/p>\n<p>claimant in a reference under Section 28A(3) can be<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.1329 of 2010        -4-<\/span><\/p>\n<p>awarded higher compensation than what was awarded to<\/p>\n<p>the party to the judgment relied on by him in his application<\/p>\n<p>under Section 28A. Smt.Latha T. Thankappan, the learned<\/p>\n<p>Senior Government would oppose the submission of<\/p>\n<p>Sri.Suresh Kumar. She would submit that the Supreme<\/p>\n<p>Court does not lay down the proposition canvassed by the<\/p>\n<p>learned counsel for the appellant by its judgment in<\/p>\n<p><a href=\"\/doc\/543981\/\">Ramakrishna Rao v. Singareni Collieries Com. Ltd.<\/a> (2010(4)<\/p>\n<p>KLT 255 SC). She submitted further that at any rate, the<\/p>\n<p>judgment in LAR.123\/87 cannot have any relevance as the<\/p>\n<p>above judgment pertains to acquisition pursuant to an<\/p>\n<p>entirely different notification.\n<\/p>\n<p>      3. We have considered the submissions addressed at<\/p>\n<p>the Bar. We are not in a position to accept the argument of<\/p>\n<p>Sri.Suresh Kumar that the judgment of the Supreme Court<\/p>\n<p>in Ramakrishna Rao&#8217;s case (cited supra) is authority for the<\/p>\n<p>proposition that in a reference under Section 28A(3), the<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.1329 of 2010       -5-<\/span><\/p>\n<p>claimant can be awarded compensation higher than what<\/p>\n<p>had been awarded to the party to the judgment relied on by<\/p>\n<p>the claimant in his application under Section 28A. On going<\/p>\n<p>through       the    judgment of  the  Supreme    Court  in<\/p>\n<p>Ramakrishna Rao&#8217;s case (cited supra) what we find is that<\/p>\n<p>their Lordships were essentially considering the question<\/p>\n<p>whether a person whose application under Section 28A had<\/p>\n<p>been favourably considered by the Land Acquisition Officer<\/p>\n<p>and who had been granted the benefit of higher<\/p>\n<p>compensation is an aggrieved party entitled to seek a<\/p>\n<p>reference under Section 28A(3). It is that question which is<\/p>\n<p>answered in the affirmative by the Supreme Court. Their<\/p>\n<p>Lordships of the Supreme Court, however, have cautiously<\/p>\n<p>observed in paragraph 11 of the judgment that the<\/p>\n<p>Reference Court considering the Reference under Section<\/p>\n<p>28A(3) &#8220;will have to bear in mind that a person who has not<\/p>\n<p>sought for the reference under Section 18 cannot get<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.1329 of 2010         -6-<\/span><\/p>\n<p>compensation higher than the one payable to those who had<\/p>\n<p>sought reference under that Section&#8221;. A survey of various<\/p>\n<p>judicial precedents governing Section 28A will reveal that<\/p>\n<p>the legislative intentment underlying the above provision is<\/p>\n<p>to give relief to an illiterate and inarticulate person who had<\/p>\n<p>omitted to invoke the provision for reference under Section<\/p>\n<p>18 and thereby to ensure that there is a parity in the<\/p>\n<p>compensation which is ultimately received by persons whose<\/p>\n<p>properties were acquired for a public purpose pursuant to<\/p>\n<p>the very same notification. We do not think that it has ever<\/p>\n<p>been in the intention of the legislature to confer more<\/p>\n<p>benefits upon such illiterate and inarticulate persons than<\/p>\n<p>those persons who acted promptly and sought for reference<\/p>\n<p>under Section 18. If the argument of Sri.Suresh Kumar is<\/p>\n<p>accepted, the same will amount to conferring more benefits<\/p>\n<p>on the appellants than what had been given to the party in<\/p>\n<p>LAR.20\/92 on the basis of which only the appellant could file<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.1329 of 2010      -7-<\/span><\/p>\n<p>his application under Section 28A. We do not find any<\/p>\n<p>illegality or infirmity about the view taken by the learned<\/p>\n<p>Subordinate Judge. Appeal fails and will stand dismissed in<\/p>\n<p>limine.\n<\/p>\n<\/p>\n<p>                                        PIUS C.
