SHAH\n\t\t\n\t\n\n \n\nDate\n: 19\/01\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tThe<br \/>\npresent First Appeals arise out of the impugned order dated<br \/>\n30\/09\/2010 passed by learned Motor Accident Claims Tribunal, Morbi,<br \/>\nDistrict: Rajkot in Order below Exh-7 in Motor Accident Claim<br \/>\nPetition No.35\/2010 awarding a sum of Rs.50,000\/- with interest at<br \/>\nthe rate of 7.5% per annum from the date of application till<br \/>\nrealization to the original claimants by way of interim compensation<br \/>\nunder Section 140 of the Motor Vehicles Act for &#8220;No Fault<br \/>\nLiability&#8221;.\n<\/p>\n<p>2.\t\tHaving<br \/>\nheard Mr.Vibhuti Nanavati, learned advocate appearing on behalf of<br \/>\nthe appellant &#8211; original Opponent No.4, as the impugned orders are<br \/>\npassed under Section 140 of the Motor Vehicles Act, the same are not<br \/>\nentertained. However, it is observed that the same shall be without<br \/>\nprejudice to the rights and contentions of the respective parties in<br \/>\nthe main claim petitions and all the defences and contentions, which<br \/>\nare available to the respective parties are kept open and the same<br \/>\nshall be considered by the Tribunal while deciding the main claim<br \/>\npetitions. However, as far as the amount deposited by the appellant<br \/>\nas per the order passed by the Tribunal is concerned, it appears that<br \/>\nwhile passing operative portion of the order, the Tribunal has<br \/>\nmentioned that necessary orders with respect to disbursement of the<br \/>\namounts of compensation shall be passed after depositing the same<br \/>\nwith the Tribunal.\n<\/p>\n<p>\t\tUnder<br \/>\nthe circumstances, it is directed that the amount so deposited and\/or<br \/>\nto be deposited by the appellant shall be invested in the Fixed<br \/>\nDeposit in the name of Nazir, initially for a period of three years<br \/>\nand the same shall be continued to be renewed till main claim<br \/>\npetition is decided and disposed of. The original claimants are<br \/>\nentitled to get periodical interest thereon. With this, the present<br \/>\nFirst Appeals are disposed of.\n<\/p>\n<p>3.\t\tIn<br \/>\nview of disposal of the main First Appeals, no order in Civil<br \/>\nApplications and Civil Applications are also accordingly disposed of.<br \/>\nRule is discharged in each of the Civil Applications.
