Sinha &amp; Lokeshwar Singh Panta\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<br \/>\nREPORTABLE<\/p>\n<p>CIVIL APPEAL NO.    3321              OF 2008<br \/>\n[Arising out of SLP (Civil) No. 8262 of 2007]<\/p>\n<p>S.B. SINHA, J :\n<\/p>\n<p>1. \tLeave granted.\n<\/p>\n<p>2. \tAppellant was driving a two-wheeler bearing registration No. DL-45<br \/>\nAQ 0731 on 30.10.2003.  He was aged about 17 = years.  He met with an<br \/>\naccident, as allegedly respondent No.1 was driving a mini-truck rashly and<br \/>\nnegligently.  He suffered the following injuries in the said accident:\n<\/p>\n<p>&#8220;1.\tCrush injury over right root.\n<\/p>\n<p>2.\tFracture fifth M.T. bone and joint.\n<\/p>\n<p>3.\tFracture P.P. little toe. (Total 3 fractures)\n<\/p>\n<p>4.\tAbrasions over left side trunk, right-foot,<br \/>\nright-leg, right-hand and left-knee\n<\/p>\n<p>5.\tProfusely Bleeding.\n<\/p>\n<p>6.\tAbrasions and blunt injuries all over body.&#8221;\n<\/p>\n<p>3. \tAppellant filed a claim petition under Section 166 of the Motor<br \/>\nVehicles Act, 1988 (for short &#8220;the Act&#8221;).  The Tribunal opined that as the<br \/>\nappellant did not possess a driving licence, he must be held to have<br \/>\ncontributed to the accident.  Although a sum of Rs. 30,000\/- was awarded by<br \/>\nway of compensation, in view of the finding that he was guilty of<br \/>\ncontributory negligence on his part, found to be entitled to a sum of Rs.<br \/>\n12,000\/- only.  The High Court by reason of the impugned judgment has<br \/>\ndismissed the appeal preferred by him under Section 173 of the Act.\n<\/p>\n<p>4. \tThe question which arises for consideration is as to whether the<br \/>\nappellant can be said to have guilty of contributory negligence.<br \/>\nOrdinarily, the doctrine of contributory negligence is not applicable in<br \/>\ncase of children with the same force as in the case of adults.\n<\/p>\n<p>5. \tWe do not intend to lay down a law that a child can never be guilty of<br \/>\ncontributory negligence but ordinarily the same is a question of fact.  [See<br \/>\nMuthuswamy and another v. S.A.R. Annamalai and others [1990 ACJ 974]\n<\/p>\n<p>6. \tA contributory negligence may be defined as negligence in not<br \/>\navoiding the consequences arising from the negligence of some other person,<br \/>\nwhen means and opportunity are afforded to do so.  The question of<br \/>\ncontributory negligence would arise only when both parties are found to be<br \/>\nnegligent.\n<\/p>\n<p>7. \tThe question is, negligence for what?  If the complainant must be<br \/>\nguilty of an act or omission which materially contributed to the accident and<br \/>\nresulted in injury and damage, the concept of contributory negligence would<br \/>\napply.  [See New India Assurance Company Ltd. v. Avinash 1988 ACJ 322<br \/>\n(Raj.)]<\/p>\n<p>\tIn T.O. Anthony v. Kavarnan &amp; Ors. [(2008) 3 SCC 748, it was held <\/p>\n<p>&#8220;6. &#8216;Composite negligence&#8217; refers to the negligence<br \/>\non the part of two or more persons. Where a<br \/>\nperson is injured as a result of negligence on the<br \/>\npart of two or more wrong doers, it is said that the<br \/>\nperson was injured on account of the composite<br \/>\nnegligence of those wrong-doers. In such a case,<br \/>\neach wrong doer, is jointly and severally liable to<br \/>\nthe injured for payment of the entire damages and<br \/>\nthe injured person has the choice of proceeding<br \/>\nagainst all or any of them. In such a case, the<br \/>\ninjured need not establish the extent of<br \/>\nresponsibility of each wrong-doer separately, nor<br \/>\nis it necessary for the court to determine the extent<br \/>\nof liability of each wrong-doer separately. On the<br \/>\nother hand where a person suffers injury, partly<br \/>\ndue to the negligence on the part of another person<br \/>\nor persons, and partly as a result of his own<br \/>\nnegligence, then the negligence of the part of the<br \/>\ninjured which contributed to the accident is<br \/>\nreferred to as his contributory negligence. Where<br \/>\nthe injured is guilty of some negligence, his claim<br \/>\nfor damages is not defeated merely by reason of<br \/>\nthe negligence on his part but the damages<br \/>\nrecoverable by him in respect of the injuries stands<br \/>\nreduced in proportion to his contributory<br \/>\nnegligence.\n<\/p>\n<p>7. Therefore, when two vehicles are involved in an<br \/>\naccident, and one of the drivers claims<br \/>\ncompensation from the other driver alleging<br \/>\nnegligence, and the other driver denies negligence<br \/>\nor claims that the injured claimant himself was<br \/>\nnegligent, then it becomes necessary to consider<br \/>\nwhether the injured claimant was negligent and if<br \/>\nso, whether he was solely or partly responsible for<br \/>\nthe accident and the extent of his responsibility,<br \/>\nthat is his contributory negligence. Therefore<br \/>\nwhere the injured is himself partly liable, the<br \/>\nprinciple of &#8216;composite negligence&#8217; will not apply<br \/>\nnor can there be an automatic inference that the<br \/>\nnegligence was 50:50 as has been assumed in this<br \/>\ncase. The Tribunal ought to have examined the<br \/>\nextent of contributory negligence of the appellant<br \/>\nand thereby avoided confusion between composite<br \/>\nnegligence and contributory negligence. The High<br \/>\nCourt has failed to correct the said error.&#8221;\n<\/p>\n<p>8. \tIf a person drives a vehicle without a licence, he commits an offence.<br \/>\nThe same, by itself, in our opinion, may not lead to a finding of negligence<br \/>\nas regards the accident.  It has been held by the courts below that it was the<br \/>\ndriver of the mini-truck which was being driven rashly and negligently.  It is<br \/>\none thing to say that the appellant was not possessing any licence but no<br \/>\nfinding of fact has been arrived at that he was driving the two-wheeler rashly<br \/>\nand negligently.  If he was not driving rashly and negligently which<br \/>\ncontributed to the accident, we fail to see as to how, only because he was not<br \/>\nhaving a licence, he would be held to be guilty of contributory negligence.\n<\/p>\n<p>9. \tThe matter might have been different if by reason of his rash and<br \/>\nnegligent driving, the accident had taken place.\n<\/p>\n<p>10.\tWe, therefore, are of the opinion that the impugned judgment cannot<br \/>\nbe sustained which is set aside accordingly.  Appellant is entitled to the said<br \/>\nsum of Rs. 30,000\/- by way of compensation with interest at the rate of 7=%<br \/>\nper annum from the date of the award till making of the payment.  Even<br \/>\notherwise there is no reason as to why in view of the nature of the injuries he<br \/>\nhas suffered, he should be deprived of even the petty sum of Rs.30,000\/- by<br \/>\nway of compensation.  The appeal is allowed with the aforementioned<br \/>\ndirection.
