Learned eeunsel for the petitioner<\/p>\n<p>submits that since the order passed by _the,<\/p>\n<p>Special Seputy Commissioner at Annexure\u00a5JV\u00a7aa+,l<\/p>\n<p>already been quashed by this eeurt,&#8221;th\u00a7t\u00a2reer<\/p>\n<p>passed by the respondent at \ufb01nnexQre\u00a7B by the g<\/p>\n<p>BSA is not sustainable in law; Learned ceuneel<br \/>\nfor the respondent submits _that &#8220;this eourt<br \/>\nafter quashing the verder ;at&#8221;5annexurewJ has<\/p>\n<p>remanded the matter\u00bb tea the isp\u00e9gial Deputy<\/p>\n<p>Commissioner. &#8220;sa:*,&#8217;r:esh&#8217; consideratien in<\/p>\n<p>accordance with Seetien 39 of the Land Revenue<\/p>\n<p>4,Act .\u00a7and&#8217; that- &#8220;if _____ the Special Deputy<\/p>\n<p>&#8220;Cemmiaeioner after the enquiry comes to the<\/p>\n<p>cenelueion that the petitiener has encroached<\/p>\n<p>the \u00e9evern\ufb01ent lands, EDA is entitled to<\/p>\n<p>_ &#8220;initiate&#8221; proceedings for<\/p>\n<p>-eangeilationfwithdrawal of the lay-ut plan in<\/p>\n<p>*reepect of encreached portion.
