(3) 557 JT 1993 (2)\t337\n 1993 SCALE  (2)78\n\n\nACT:\nAdvocates  Act,\t 1961 : Section 38-Appeal against  order  of\nDisciplinary  Committee of Bar Council of  India-Proceedings\nagainst Advocates-Findings-whether proper.\n\n\n\nHEADNOTE:\nRespondent-Bank lodged a complaint before the Bar Council of\nDelhi  against\tthe appellant-Advocate,\t alleging  that\t the\nappellant  and\ttwo other Advocates of the M\/s.\t  Singh\t and\nCompany, (a Firm of Advocates and solicitors) were guilty of\nserious professional misconduct, as they failed to discharge\ntheir.professional duties and responsibilities entrusted  to\nthem.\nThe case of the Bank was that in 1975, the Bank engaged\t the\nFirm  to  rile\ta  recovery suit for  the  recovery  of\t Rs.\n6,12,164.10  from M\/s.\tDelhi Flooring (P) Ltd.\t and  handed\nover   the  case-rile  containing  original   and   valuable\ndocuments.\nThe Firm submitted a bill for riling the recovery suit which\nincluded  the  professional  fees  and\tother  miscellaneous\ncharges.   On 15.11.1975 the Bank paid a sum of\t Rs.  11,475\nwhich  included\t 1\/3rd\tof  the\t professional  fee  and\t the\nmiscellaneous  charges.\t It did not inform the Bank  whether\nthe suit was filed or not.\nOn  5.12.1975 the Bank wrote a letter to the Firm to send  a\ncopy  of  the plaint before 8.12.1975 or the Bank  would  be\ncompelled to withdraw the case from the Firm.\nOn  15.12.1975, one of the partner of the firm informed\t the\nBank  the  suit was filed on 15.12.1975 in the\tHigh  Court.\nThereafter  the Bank was kept in the dark about the fate  of\nthe  case.  Hence the Bank engaged the services of  one\t Mr.\nArora, Advocate, in order to find out as to what happened to\nthe suit.\nOn  23.1977,  the Bank was informed by Mr.  Arora,  Advocate\nthat\n489\nsuit  was  filed  on 15.12.1975 in the\tHigh  Court  and  on\n31.1.1976,  it\twas returned by the Original Branch  to\t the\nRegistry  with\tobjections.   Mr.  Arora,  Advocate  further\ninformed  the Bank on 31.3.1977 that the entire\t suit  paper\nbook  was  returned to Mr. Singh, Advocate of  the  Firm  on\n27.7.1976  for removing the object-ions and  thereafter\t the\nsuit was not refiled.\nThe  respondent-Bank,  therefore,  claimed  before  the\t Bar\nCouncil\t of  Delhi  that the appellant\tand  his  associates\nmisappropriated\t the  money  paid to  them  for\t court\tfee,\nmiscellaneous  expenses\t and one-third of  the\tprofessional\nfee.\nThe  Disciplinary  Committee  of the Bar  Council  of  Delhi\ntransferred  the  case of the Bar Council of India,  as\t the\ncase was pending for more than one year.\nThe  Bar  Council  of India  issued  notices  returnable  on\n2.11.1980. The appellant and his associates were not present\non  that  date.\t  Therefore fresh notices  were\t issued\t for\n20.12.1980.  The appellant did not present on  20.12.1980and\nex parte proceedings were ordered.  The case was posted\t for\n23.1.1981 for the evidence of the complainant.\nOn 23.1.1981 the appellant moved an application for  setting\naside the ex parte order dated 20.12.1980, which was allowed\nand  the  case\twas adjourned to  27.2.1981.  The  case\t was\nadjourned  from time to time and finally fixed for  evidence\non 22.8.1981. On 22.8.1981, the appellant's application\t for\nadjournment  was rejected.  The evidence was concluded,\t ar-\nguments were heard and the order was reserved.\n(The  complainant  had\tgiven up its case  against  one\t Ms.\nV.Singh, Advocate an associate of the appellant, and the Bar\nCouncil\t of  India  did not proceed against  her.   One\t Mr.\nB.Singh, Advocate the other associate of the appellant,\t was\nalso proceeded against.\t Notice to him was returned with the\npostal\tendorsement \"refused\" and ex parte  proceeding\twere\nordered.)\nThe Disciplinary Committee of the Bar Council of India\theld\nthat  the case against the appellant and his  associate\t was\nproved\tbeyond reasonable doubt.  Their names  were  removed\nfrom the rolls of Advocates of the Bar Council of Delhi\t and\nthe Sanads granted to them were ordered to be withdrawn.\n490\nThe appellant riled the appeal before this Court, while\t his\nassociate, riled a review petition before the Bar Council of\nIndia,\twhich was still pending.  The Bar Council  of  India\ngranted him stay of the order dated 24.10.1981 in the review\nproceeding.\nThe  appellant\tcontended  that the suit was  filed  by\t the\nappellant on 15.12.11975 but the record of the suit file was\nmisplaced\/lost\tby the Registry of the High Court;  that  by\nhis  letter dated 20.8.1977, he informed the Bank about\t the\nsuit  rile being not traceable; and that the record  of\t the\nsuit was to be structured and refiled.\nDismissing the appeal, this Court,\nHELD  :\t 1.01.\tThe  letter dated  August  20,1977  was\t not\nproduced,  before  the Bar Council of India.   It  has\tbeen\nplaced before this Court for the first time.  Apart from the\nipse  dixit  of\t the appellant and Mr.B.Singh  in  the\tsaid\nletter, there is no evidence on the record to show that\t the\nsuit rile was misplaced or lost by the High Court  Registry.\nOn the other hand, there is cogent and reliable evidence  on\nthe  record  to\t shows that the Delhi  High  Court  Registry\nreturned  back the papers to, Mr. B. Singh for removing\t the\nobjections raised by it. [494D-E]\n1.02.\t  Both\tthe reports of Mr.R.P.Arora,  Advocate\thave\nbeen  proved  on the record of the Bar Council of  India  as\nevidence.   The Bar Council of India on appreciation of\t the\nevidence  before it came to the conclusion that\t the  charge\nagainst\t the  appellant\t and Mr.B.Singh\t was  proved  beyond\ndoubt.\t There is no ground to interfere with the  order  of\nthe Bar Council of India. Case No. 28 of 1979.\n<\/p>\n<p>B.Singh, S.K.Gambhir and Davinder Singh for the Appellant.<br \/>\nR.P.Kapur and Rajiv Kapur for the Respondents.<br \/>\nThe Judgment of the Court was delivered by<br \/>\n<span class=\"hidden_text\">491<\/span><br \/>\nKULDIP\tSINGH,\tJ. D.S. Dalal was a practising\tadvocate  in<br \/>\nDelhi.\tThe Bar Council of India by its order dated  October<br \/>\n24,  1981, removed his name from the rolls of  advocates  of<br \/>\nthe  Bar Council of Delhi and the sanad granted to  him\t has<br \/>\nbeen  withdrawn.   This\t appeal\t under\tSection\t 30  of\t the<br \/>\nAdvocates  Act\tis against the order of the Bar\t Council  of<br \/>\nIndia.\n<\/p>\n<p>The  State Bank of India lodged a complaint before  the\t Bar<br \/>\nCouncil\t of Delhi on September 4, 1978.\t It was\t alleged  in<br \/>\nthe  complaint\tthat  the appellant  along  with  two  other<br \/>\nadvocates  was practising under the name and style  of\t&#8220;M\/s<br \/>\nSingh and Company&#8221; a firm of advocates and solicitors having<br \/>\ntheir  office at 2670, Subzi Mandi, Delhi.  It\twas  alleged<br \/>\nthat  the advocates were duly engaged by the Asaf  Ali\tRoad<br \/>\nbranch\tof the State Bank of India to file a  recovery\tsuit<br \/>\nagainst\t M\/s Delhi Flooring (Pvt) Ltd. for the\trecovery  of<br \/>\nRs. 6,12,164.10. &#8220;Singh and Company&#8221; (the firm) at that time<br \/>\nwas  represented  by  Mr. D.S. Dalal, Mr. B.  Singh  and  Ms<br \/>\nV.Singh,  Advocates, who were the partners of the said\tfirm<br \/>\nand were conducting cases for and on behalf of the firm.<br \/>\nIt is the case of the complainant that in the year 1975, the<br \/>\nfile relating to the case which was to be filed against\t m\/s<br \/>\nDelhi Flooring (Pvt) Ltd., containing original and  valuable<br \/>\ndocuments,  was handed over to the Firm by the\tcomplainant.<br \/>\nThereafter,  the  Firm\tsubmitted  a  bill  for\t filing\t the<br \/>\nrecovery suit which included the professional fees and other<br \/>\nmiscellaneous charges.\tAn amount of Rs. 11,475 was paid  to<br \/>\nthe  Firm  on November 15, 1975, for filing the\t suit  which<br \/>\nincluded   1\/3rd   of\tthe  professional   fee\t  plus\t the<br \/>\nmiscellaneous  charges.\t This was acknowledged by  the\tFirm<br \/>\nunder  a  receipt  which was placed  on\t the  record.\tTill<br \/>\nDecember  19, 1975, the Firm did not inform the bank  as  to<br \/>\nwhether\t the suit was filed and if so what was the stage  of<br \/>\nthe proceedings.  The bank wrote a letter dated December 05,<br \/>\n1975  to  the Firm asking it to send a copy  of\t the  plaint<br \/>\nbefore\tDecember  8, 1975, for signatures  and\tverification<br \/>\nfailing\t which the bank would be compelled to  withdraw\t the<br \/>\ncase  from the firm.  At that stage Mr. B. Singh,  Advocate,<br \/>\none  of\t the  partners\tof the Firm,  in  his  letter  dated<br \/>\nDecember  15, 1975 informed the bank that the suit had\tbeen<br \/>\nfiled  on  December  15, 1975 in the High  Court  of  Delhi.<br \/>\nThereafter,   the   bank  appears  to\thave   received\t  no<br \/>\ncommunication  from  the  said\tadvocates  despite  repeated<br \/>\nreminders  oral and other-,vise\t and the bank was kept\tin<br \/>\nthe  dark  about  the  fate of the  case  entrusted  to\t the<br \/>\nappellant and his associates.\n<\/p>\n<p><span class=\"hidden_text\">492<\/span><\/p>\n<p>As  there  was\tno response from  the  appellant,  the\tbank<br \/>\nengaged\t the services of Mr. R.P. Arora, Advocate, in  order<br \/>\nto  find  out as to what happened to the suit filed  by\t the<br \/>\nappellant and his associates on behalf of the bank.  Mr.R.P.<br \/>\nArora  in his letter dated March 2, 1977, informed the\tbank<br \/>\nthat the suit which had been filed on December 15, 1975\t was<br \/>\nreturned  by the original Branch on January 31, 1976 to\t the<br \/>\nRegistry  of the High Court with objections.  Mr.  Arora  in<br \/>\nhis  letter dated March 31, 1977 further informed  the\tbank<br \/>\nthat the entire suit paper book had been returned to Mr.  B.<br \/>\nSingh, Advocate on July 27, 1976 for removing the  objection<br \/>\nand  thereafter\t the  suit  has not  been  re-filed  in\t the<br \/>\nRegistry of the High Court of Delhi.\n<\/p>\n<p>The  complainant, therefore, claimed that the appellant\t and<br \/>\nhis   associates   were\t guilty\t of   serious\tprofessional<br \/>\nmisconduct  as they failed to discharge\t their\tprofessional<br \/>\nduties and responsibilities entrusted to them by the bank in<br \/>\nits  capacity  as a client.  It was further claimed  by\t the<br \/>\nbank   that   the   appellant\tand   his   associates\t had<br \/>\nmisappropriated\t the  money  paid to  them  for\t court\tfee,<br \/>\nmiscellaneous  expenses\t and one third of  the\tprofessional<br \/>\nfee.  The complainant further stated that even the documents<br \/>\nand  other  papers  handed over to  the\t appellant  and\t his<br \/>\nassociates  for\t filing\t the suit were\tnot  returned.\t The<br \/>\ncomplainant  was originally registered with the Bar  Council<br \/>\nof Delhi.  On September 19, 1979, the Disciplinary Committee<br \/>\nof the Bar Council of Delhi transferred the case to the\t Bar<br \/>\nCouncil\t of  India  on the ground that\tthe  case  had\tbeen<br \/>\npending\t for more than one year.  The Bar Council  of  India<br \/>\nissued notices returnable on November 2, 1980.\tOn that date<br \/>\nthe  respondents were not present and as such fresh  notices<br \/>\nwere  issued for December 20, 1980.  Mr. D.S. Dalal,  though<br \/>\nserved\twas not present on December 20, 1980 and as such  ex<br \/>\nparte  proceedings  were ordered.  Notice to Mr.  B.  Singh,<br \/>\nAdvocate was returned with the postal endorsement &#8220;refused&#8221;.<br \/>\nHe was also ordered to be proceeded ex parte.  The case\t was<br \/>\nposted\tfor  January  23,  1981\t for  the  evidence  of\t the<br \/>\ncomplainant.  On that day the appellant moved an application<br \/>\nfor  setting  aside the ex parte order\tdated  December\t 20,<br \/>\n1980.\tThe  ex\t parte order  was  set\taside  conditionally<br \/>\npermitting  the appellant to participate in the\t proceedings<br \/>\nand  the  case\twas  adjourned to  February  27,  1981.\t  On<br \/>\nFebruary  27,  1981, three witnesses were  examined  in\t the<br \/>\npresence  of  the  appellant  and  he  cross-examined  them.<br \/>\nThereafter  the\t case was adjourned from time  to  time\t and<br \/>\nfinally\t fixed\tfor  evidence  on  August  22,\t1981.\t The<br \/>\nappellant  again sent an application for  adjournment  which<br \/>\nwas rejected.  The evidence was con-\n<\/p>\n<p><span class=\"hidden_text\">493<\/span><\/p>\n<p>cluded,\t arguments were heard and the order  reserved.\t The<br \/>\nBar Council of India in the impugned order observed as under<br \/>\n:-\n<\/p>\n<blockquote><p>\t      &#8220;From  a\tperusal of the order  sheet  of\t the<br \/>\n\t      Disciplinary  Committee of the Bar Council  of<br \/>\n\t      Delhi  and also of the order sheet before\t us,<br \/>\n\t      it   reveals   that   the\t  respondents\thave<br \/>\n\t      throughout   adopted  the\t tactics   of\tnon-<br \/>\n\t      cooperation purposely with a view to  protract<br \/>\n\t      the proceedings unnecessarily&#8217;.\n<\/p><\/blockquote>\n<p>It  may be mentioned that the complainant had given  up\t its<br \/>\ncase  against  Ms. V. Singh, Advocate and as  such  the\t Bar<br \/>\nCouncil of India ultimately did not proceed against her.  So<br \/>\nfar  as Mr. B. Singh and Mr. D.S. Dalal are  concerned,\t the<br \/>\ncase  against  them was proved beyond reasonable  doubt\t and<br \/>\ntheir names were removed from the rolls of advocates of\t Bar<br \/>\nCouncil of Delhi and the sanads granted to them were ordered<br \/>\nto be withdrawn.\n<\/p>\n<p>The  appeal  before  us\t is by D.S.  Dalal.   We  have\tbeen<br \/>\ninformed that Mr.  B. Singh Advocate filed a review petition<br \/>\nbefore the Bar Council of India on October 22,1989 which  is<br \/>\nstill pending.\tThe Bar Council has also granted stay of the<br \/>\norder  dated  October 24, 1981 with the\t result\t that  Mr.B.<br \/>\nSingh  is continuing with his legal practise.\tThis  appeal<br \/>\nwas argued before us by Mr.B.Singh, Advocate.<br \/>\nIt  is\tnot  disputed  before us  that\tMr.B.Singh  and\t Mr.<br \/>\nD.S.Dalal  were the main partners of the Firm.\tIt  is\talso<br \/>\nnot  disputed  that an amount of Rs.11,475 was\treceived  by<br \/>\nthese  advocates towards the filing of the suit and  further<br \/>\nthat  the  connected documents and papers were\treceived  by<br \/>\nthem.\t Mr.B.Singh,  learned  counsel\t for-the   appellant<br \/>\nprimarily argued that the suit was filed by the appellant in<br \/>\nthe Delhi High Court on December 15, 19&#8217;\/5 but the record of<br \/>\nthe suit file was misplaced\/lost by the High Court registry.<br \/>\nHe further stated that by his letter dated August 20,  1977,<br \/>\nhe informed the bank about the suit file being not traceable<br \/>\nand  further  that  the record of the suit  was\t to  be\t re-<br \/>\nstructured and refiled.\n<\/p>\n<p>We  have  been taken through the copy of  the  letter  dated<br \/>\nAugust 20, 1977, written by Mr.B.Singh on behalf of the Firm<br \/>\nto  the\t Regional Manager, State Bank of  India,  Parliament<br \/>\nStreet, New Delhi.  The relevant paragraph is as under<br \/>\n<span class=\"hidden_text\">494<\/span><br \/>\n\t      &#8220;However, as already intimated two bank cases-<br \/>\n\t      one  of  Delhi Flooring (P) Ltd. of  Asaf\t Ali<br \/>\n\t      Road   branch   and   second   of\t  J.M.A.I.E.\n<\/p>\n<p>\t      Corporation  of Jungpura branch filed  by\t the<br \/>\n\t      undersigned  in Delhi High Court\t have  been<br \/>\n\t      misplaced\/lost by High Court Registry and\t the<br \/>\n\t      record  reconstruction petitions have  already<br \/>\n\t      been  given  to the branches  in\tMarch,\t1976<br \/>\n\t      itself.\tIn  case  the said  suits  have\t not<br \/>\n\t      already  been got restored through some  other<br \/>\n\t      learned\tcounsel\t and  the   assistance\t the<br \/>\n\t      undersigned     is    required\t for\t the<br \/>\n\t      restoration\/reconstruction then he is  willing<br \/>\n\t      to  cooperate fully without charging  any\t fee<br \/>\n\t      and  without insisting on the payment  of\t his<br \/>\n\t      outstanding bills first.\tThe undersigned\t can<br \/>\n\t      work only when he is allowed to work in  terms<br \/>\n\t      of  his  approved\t schedule of  fees  and\t the<br \/>\n\t      payment is made of all his bill, forthwith.&#8221;<br \/>\nThe  letter  dated  August 20, 1977, quoted  above  was\t not<br \/>\nproduced  before  the  Bar Council of India.   It  has\tbeen<br \/>\nplaced\tbefore us for the first time.  Apart from  the\tipse<br \/>\ndixit of the appellant and Mr.B. Singh in the above  letter,<br \/>\nthere  is  no evidence on the record to show that  the\tsuit<br \/>\nfile  was misplaced or lost by the High Court Registry.\t  On<br \/>\nthe  other hand, there is cogent and reliable  evidence\t on<br \/>\nthe  record  to show that the Delhi High-.   Court  Registry<br \/>\nreturned  back the papers to, Mr. B. Singh for removing\t the<br \/>\nobjections raised by it.\n<\/p>\n<p>Mr.  R.P. Arora, Advocate, appeared as a witness before\t the<br \/>\nBar Council of India.  The relevant part of his evidence  is<br \/>\nas under<br \/>\n\t      &#8220;I  know the respondents in the case.   I\t was<br \/>\n\t      instructed by the complainant in case to\tfind<br \/>\n\t      out  as to whether the respondents  had  filed<br \/>\n\t      the  suit against the Delhi Flooring (P)\tLtd.<br \/>\n\t      in the High Court of Delhi which was entrusted<br \/>\n\t      by  the  complainant  with  the\trespondents.<br \/>\n\t      Accordingly  I  went to Delhi High  Court\t and<br \/>\n\t      made enquiries to find out whether such a suit<br \/>\n\t      has  been\t filed.\t On enquiry I came  to\tknow<br \/>\n\t      from the registers of the High Court that\t the<br \/>\n\t      suit   had  been\tfiled  on  behalf   of\t the<br \/>\n\t      complainant against Delhi Flooring (P) Ltd. on<br \/>\n\t      15th December, 1975. 1 found from the  records<br \/>\n\t\t\t    that the office has not registered the suit<br \/>\n<span class=\"hidden_text\">\t      495<\/span><br \/>\n\t      because  of certain objections raised  by\t the<br \/>\n\t      office.\tI also came to know that the  entire<br \/>\n\t      suit   filed   had  been\t returned   to\t the<br \/>\n\t      respondents for complying with the  objections<br \/>\n\t      and to refile the suit.  This was so  returned<br \/>\n\t      on 27.7.76. The enquiries that were made by me<br \/>\n\t      in the High Court office was during March 1977<br \/>\n\t      and  till\t that  date the suit  had  not\tbeen<br \/>\n\t      refiled by the respondents.&#8221;\n<\/p>\n<p>Mr. R.P. Arora, Advocate, after examining the records of the<br \/>\nDelhi  High Court had sent two reports to the State Bank  of<br \/>\nIndia.\tIn his report dated March 2, 1977 he stated as under<br \/>\n:-\n<\/p>\n<blockquote><p>\t      &#8220;As desired by you, to know the whereabouts of<br \/>\n\t      the above noted case, I contacted the  concern<br \/>\n\t      clerk in the Original Branch of High Court  of<br \/>\n\t      Delhi  at\t New Delhi and\talso  inspected\t the<br \/>\n\t      registers of the Original suits.<br \/>\n\t      The above noted case was filed by M\/s Singh  &amp;<br \/>\n\t      Co.  on  15.12.1975, but\tthere  were  certain<br \/>\n\t      objections by the original     branch  and  on<br \/>\n\t      31.1.76 the said case (file) was returned\t to<br \/>\n\t      the  registree  by the original  branch.\t The<br \/>\n\t      register\t of the registree in respect of\t the<br \/>\n\t      period from 31.1.1976\tis not available and<br \/>\n\t      I\t  shall\t  let  you  know   the\t upto\tdate<br \/>\n\t      information,  when the said case was  returned<br \/>\n\t      to M\/s.  Singh &amp; Co. within a short period.&#8221;\n<\/p><\/blockquote>\n<p>Subsequently  in  his  report  dated  March  31,  1977,\t Mr.<br \/>\nR.P.Arora,  Advocate gave the following information  to\t the<br \/>\nbank:-\n<\/p>\n<blockquote><p>\t      &#8220;I have enquired from the Original section  of<br \/>\n\t      High  Court  of Delhi at New Delhi,  that\t the<br \/>\n\t      file of the above stated case was returned  to<br \/>\n\t      Shri B.Singh on 27.7.1976 as the said case was<br \/>\n\t      under  objections.   So far he has  not  again<br \/>\n\t      filed the said case in High Court.&#8221;\n<\/p><\/blockquote>\n<p>Both the above quoted reports have been proved on the record<br \/>\nof the Bar Council of India as evidence.  The Bar Council of<br \/>\nIndia on appreciation of the evidence before it came to\t the<br \/>\nconclusion that the charge against the appellant and Mr.  B.<br \/>\nSingh  was  proved beyond doubt.  The Bar Council  of  India<br \/>\nconcluded as under:-\n<\/p>\n<p><span class=\"hidden_text\">496<\/span><\/p>\n<blockquote><p>\t      &#8220;..After having gone through the evidence\t and<br \/>\n\t      the documents produced in the case  carefully,<br \/>\n\t      we  have\tcome  to  the  conclusion  that\t the<br \/>\n\t      complainant had entrusted the suit to be filed<br \/>\n\t      against M\/s Delhi Flooring (Pvt) Ltd. with the<br \/>\n\t      necessary\t  papers  and  Rs.   11,400.74\t for<br \/>\n\t      expenses etc. to the respondent-advocates.  It<br \/>\n\t      is also established that the respondents\thave<br \/>\n\t      filed   the  suit\t on  15.12.1975\t with\tsome<br \/>\n\t      objections  deliberately and when\t the  papers<br \/>\n\t      were returned by the High Court, they had\t not<br \/>\n\t      refiled the suit for a pretty long time and as<br \/>\n\t      is established tiff this day.  So, we have  no<br \/>\n\t      hesitation  to conclude that the\trespondents,<br \/>\n\t      have  misappropriated the amount\trealised  by<br \/>\n\t      them from the Bank without filing the suit  in<br \/>\n\t      a proper manner.&#8221;\n<\/p><\/blockquote>\n<p>We  have given our thoughtful consideration to the  evidence<br \/>\non  the record against the appellant.  We see no  ground  to<br \/>\ninterfere  with the order of the Bar Council of\t India.\t  We<br \/>\nagree  with  the  reasoning  and  the  conclusions   reached<br \/>\ntherein.\n<\/p>\n<p>We, therefore, dismiss the appeal.
