Dastoor, learned counsel for the applicant, Mr.Sunil<br \/>\n\tAgrawal, learned counsel for the respondent No.1 and Mr.H.L. Jani,<br \/>\n\tlearned Additional Public Prosecutor for respondent No.2-State.\n<\/p>\n<p>Mr.Agrawal<br \/>\n\thas opposed the present application and has contended that first<br \/>\n\tLeave to Appeal should be decided and thereafter only delay may be<br \/>\n\tcondoned.\n<\/p>\n<p>I<br \/>\n\thave perused the papers and submission advanced by learned counsel<br \/>\n\tfor the parties. Today, Criminal Miscellaneous Application No.15054<br \/>\n\tof 2010, i.e. application for leave to appeal, is also on the Board<br \/>\n\tfor hearing. Therefore, contention raised by Mr.Agrawal is of no<br \/>\n\tsubstance.\n<\/p>\n<p>In<br \/>\n\tview of the averments made in the application, present application<br \/>\n\tis allowed in terms of paragraph 6(b).
