Though the petitioner had approached the Judicial<\/p>\n<p>Magistrate of First Class-II, Haripad by filing a petition<\/p>\n<p>under Sec.12 of the Domestic Violence Act, the learned<\/p>\n<p>Magistrate by order dated 18.2.2009 in M.C.No.44\/2007<\/p>\n<p>dismissed the said petition.       Against the above order,<\/p>\n<p>though    the    revision      petitioner       had    preferred<\/p>\n<p>Crl.A.No.422\/2009, by judgment dated 1.6.2010, the<\/p>\n<p>learned Sessions Judge also dismissed the appeal as there<\/p>\n<p>was no representation. It is the above orders of the court of<\/p>\n<p>Addl.  Sessions   Judge,     Mavelikara      and   the   Judicial<\/p>\n<p>Magistrate of First Class-II, Haripad are challenged in this<\/p>\n<p>Crl.R.P.No.2058 of 2010<\/p>\n<p><span class=\"hidden_text\">                             -: 2 :-<\/span><\/p>\n<p>revision petition.\n<\/p>\n<p>      3.    I have heard the learned counsel appearing for<\/p>\n<p>the revision petitioner and also perused the above orders of<\/p>\n<p>the court below.\n<\/p>\n<p>      4.    The revision petitioner is the aggrieved person,<\/p>\n<p>who filed the above M.C. before the Court of Judicial First<\/p>\n<p>Class Magistrate-II, Haripad against the respondents<\/p>\n<p>among thereon. 1st and 2nd respondents are the parents of<\/p>\n<p>the    husband      of the petitioner   and  the   remaining<\/p>\n<p>respondents are the sisters of the 2nd respondent.<\/p>\n<p>According to the aggrieved person, the son of 1st and 2nd<\/p>\n<p>respondent, namely Sreenu, married the aggrieved person<\/p>\n<p>on 6.7.2003 as per the religious rites and the petitioner had<\/p>\n<p>52 sovereigns of gold ornaments at the time of her<\/p>\n<p>marriage. The relatives of the petitioner entrusted Rs.1.5<\/p>\n<p>lakhs to respondents 1 and 2. It is also the claim of the<\/p>\n<p>aggrieved person that the relatives of the petitioner also<\/p>\n<p>gave household articles and utensils to the petitioner.<\/p>\n<p>According to the aggrieved person, the respondents started<\/p>\n<p>Crl.R.P.No.2058 of 2010<\/p>\n<p><span class=\"hidden_text\">                               -: 3 :-<\/span><\/p>\n<p>ill-treating the petitioner subsequent to the marriage and<\/p>\n<p>the respondents took all the gold ornaments of the<\/p>\n<p>petitioner, except 5 sovereigns of gold and that gold<\/p>\n<p>ornaments were used for their own needs. It is also the<\/p>\n<p>case of the aggrieved person that the respondents have<\/p>\n<p>used Rs.1.5 lakhs received from the relatives of the<\/p>\n<p>petitioner to modify their house. Finally, the respondents<\/p>\n<p>have ousted the petitioner out of her shared household. The<\/p>\n<p>prayer of the petitioner in the petition is to permit her to<\/p>\n<p>reside in her shared household and to direct the<\/p>\n<p>respondents 1 and 2 to gave back 52 sovereigns of gold<\/p>\n<p>ornaments and Rs.1.5 lakhs.\n<\/p>\n<p>      5.    During the trial, the aggrieved person was herself<\/p>\n<p>examined as PW1 and no documentary evidence produced.<\/p>\n<p>Though the aggrieved person had claimed that 52<\/p>\n<p>sovereigns     of    gold ornaments     were  taken  by   the<\/p>\n<p>respondents 1 and 2 and Rs.1.5 lakhs, which was entrusted<\/p>\n<p>by the relatives of the petitioner, was misappropriated by<\/p>\n<p>respondents 1 and 2, the trial court has found that there is<\/p>\n<p>Crl.R.P.No.2058 of 2010<\/p>\n<p><span class=\"hidden_text\">                            -: 4 :-<\/span><\/p>\n<p>no evidence for the entrustment.        The trial court has<\/p>\n<p>specifically found that the aggrieved person has not<\/p>\n<p>furnished the details of the gold ornaments which she had.<\/p>\n<p>It is also the finding of the trial court that regarding the<\/p>\n<p>gold ornaments and the alleged entrustment of Rs.1.5 lakhs,<\/p>\n<p>absolutely there is no evidence and the aggrieved person<\/p>\n<p>failed to produce any convincing evidence.      Same is the<\/p>\n<p>finding of the trial court with respect to the household<\/p>\n<p>articles also. The trial court specifically found that during<\/p>\n<p>the cross examination of PW1, she has stated that<\/p>\n<p>Rs.25,000\/- was entrusted to the daughter of 1st respondent<\/p>\n<p>and 5 cents of property was transferred in the name of the<\/p>\n<p>petitioner. So the learned Magistrate found that the above<\/p>\n<p>evidence probabilise the case of the respondents. So the<\/p>\n<p>trial court concluded that the evidence adduced by the<\/p>\n<p>petitioner is not convincing to hold that 52 sovereigns of<\/p>\n<p>gold ornaments and Rs.1.5 lakhs were entrusted with the<\/p>\n<p>respondents 1 and 2. It is also pertinent to note that the<\/p>\n<p>husband of the aggrieved person is not a party in the<\/p>\n<p>Crl.R.P.No.2058 of 2010<\/p>\n<p><span class=\"hidden_text\">                               -: 5 :-<\/span><\/p>\n<p>proceedings. So on facts, based upon evidence the trial<\/p>\n<p>court found against the revision petitioner and accordingly<\/p>\n<p>dismissed the petition.       The above findings were though<\/p>\n<p>challenged in an appeal, the appeal was not properly<\/p>\n<p>prosecuted and accordingly, the same was dismissed by the<\/p>\n<p>lower appellate court.
