DAVE\n\t\t\n\t\n\n \n\nDate\n: 24\/01\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with the first information report registered<br \/>\nas Ist C.R. No. 151\/2010, registered with Pune\/Puna Police Station,<br \/>\nSurat for the offences punishable under Sections-302 and 114 of the<br \/>\nIndian Penal Code.\n<\/p>\n<p>2.\t\tLearned<br \/>\nAdvocate for the applicant, Shri. Hardik A. Dave, submitted that the<br \/>\ncharge-sheet is filed and considering the role attributed to the<br \/>\napplicant, he may be enlarged on bail, by imposing suitable<br \/>\nconditions.\n<\/p>\n<p>3.\t\tHeard learned APP<br \/>\nfor the the respondent-State, who opposed the grant of bail<br \/>\nlooking to the nature and gravity of the offence.\n<\/p>\n<p>4.\t\tHaving heard learned<br \/>\ncounsel for the parties and having perused the material on record<br \/>\nand taking into consideration the facts and circumstances of the<br \/>\ncase, nature of allegations, role attributed to the accused and<br \/>\npunishment prescribed for the alleged offences, I am inclined to<br \/>\nenlarge the applicant on bail, by imposing suitable conditions.\n<\/p>\n<p>5.\t\tLearned counsel for<br \/>\nthe parties do not press for further reasoned order.\n<\/p>\n<p>6.\t\tIn the facts and<br \/>\ncircumstances of the case, the application is allowed and the<br \/>\napplicant is ordered to be released on bail in connection with Ist<br \/>\nC.R. No. 151\/2010, registered<br \/>\nwith PUNE\/PUNA POLICE STATION, SURAT on<br \/>\nexecuting a bond of Rs.5,000\/- (Rupees Five Thousand only) with one<br \/>\nsurety of the like amount to the satisfaction of the trial Court and<br \/>\nsubject to the conditions that he shall;\n<\/p>\n<p>(a)\tnot take undue<br \/>\nadvantage of liberty or misuse liberty;\n<\/p>\n<p>(b)\tnot act in a manner<br \/>\ninjurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tsurrender passport,<br \/>\nif any, to the lower court within a week;\n<\/p>\n<p>(d)\tnot leave the State<br \/>\nof Gujarat without prior permission of the Sessions Judge concerned;\n<\/p>\n<p>(e)\tmark presence at the<br \/>\nconcerned police station on the first Sunday of every month between<br \/>\n10.00 a.m. and 3.00 p.m., till the trial commences;\n<\/p>\n<p>(f)\tfurnish the present<br \/>\naddress of his residence to the I.O. and also to the Court, at the<br \/>\ntime of execution of the bond, and shall not change the same without<br \/>\nprior permission of this Court;\n<\/p>\n<p>7.\t\tThe<br \/>\nAuthorities will release the applicant only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>8.\t\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>9.\t\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>10.\t\tAt<br \/>\nthe trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>11.\t\tRule<br \/>\nis made absolute to the aforesaid extent.
