Such<br \/>\n\tcomplaint is to be made by petitioner to Assistant Commissioner of<br \/>\n\tLabour, Mehsana within a period of fifteen days from date of<br \/>\n\treceiving copy of present order.\n<\/p>\n<p>As<br \/>\n\tand when Assistant Commissioner of Labour receive complaint from<br \/>\n\tpetitioner in respect to non compliance of award passed by Labour<br \/>\n\tCourt, Kalol in reference no. 586\/2003 dated 27\/5\/2008, it is<br \/>\n\tdirected to Assistant Commissioner of Labour to take necessary<br \/>\n\taction initiated against respondent no. 1 Gram Panchayat for breach<br \/>\n\tof award which amounts to offence under section 29 of Industrial<br \/>\n\tDisputes Act, 1947 and also to take an appropriate steps while<br \/>\n\texercising power under section 34 of Industrial Disputes Act, 1947<br \/>\n\tas early as possible within a period of three months from date of<br \/>\n\treceiving complaint from petitioner.\n<\/p>\n<p>Over<br \/>\n\tand above, respondent no. 3 District Development Officer and<br \/>\n\trespondent no. 2 are directed to take appropriate action against<br \/>\n\trespondent no. 1 Gram panchayat for not implementing award passed by<br \/>\n\tLabour Court, Kalol in reference no. 586\/2003 dated 27\/5\/2008 as<br \/>\n\tearly as possible within a period of three months from date of<br \/>\n\treceiving copy of present order.\n<\/p>\n<p>In<br \/>\n\tview of above observations and directions, present petition is<br \/>\n\tdisposed of by this Court without expressing any opinion on merits.<br \/>\n\tDirect service is permitted.\n<\/p>\n<p>\t\t\t\t\t\t\t\t(H.K.RATHOD,<br \/>\nJ)<\/p>\n<p>asma<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Patel vs Aithor on 29 March, 2011 Author: H.K.Rathod,&amp;Nbsp;
