Shukla\n\nHon'ble Sheo Kumar Singh,J.\n<\/pre>\n<p>Hon&#8217;ble Rajesh Chandra,J.\n<\/p>\n<p>Heard learned counsel for the petitioner, learned counsel who appears<br \/>\nfor the Bank and learned Standing Counsel.\n<\/p>\n<p>Challenge in this petition is recovery proceeding by which a particular<br \/>\namount is sought to be recovered from the petitioner.<br \/>\nCounsel for the petitioner has made statement at the bar that this is<br \/>\nthe first writ petition against the recovery proceeding and this fact has<br \/>\nalso been stated in the writ petition.\n<\/p>\n<p>Submission is that if reasonable time is allowed to pay the amount<br \/>\nsought to be recovered, petitioner may be able to pay the same and<br \/>\nirreparable injury on account of arrest and auction of property may be<br \/>\navoided.\n<\/p>\n<p>To the aforesaid, learned counsel appearing for Bank submits that<br \/>\nintention of the respondent bank has been never to cause any<br \/>\nirreparable injury to the loanee rather the loan amount was advanced<br \/>\nwith the purpose to improve the petitioner&#8217;s future prospects and thus if<br \/>\nfor justifiable reason the amount in terms of the agreement has not<br \/>\nbeen paid and now petitioner has bonafide intention to pay the amount<br \/>\nwithin a reasonable time then if that liberty is given, it will serve the<br \/>\ninterest of both sides i.e. petitioner may be saved from the riggers of<br \/>\ncoercive process i.e. arrest, auction of the properties and at the same<br \/>\ntime respondent bank will get its full amount with interest. Thus for<br \/>\ngrant of reasonable time, if that is to advance justice, respondents may<br \/>\nnot have any objection.\n<\/p>\n<p>In view of aforesaid, this Court feels in the ends of justice that amount<br \/>\nsought to be recovered be permitted to be deposited.<br \/>\nAccordingly, this petition is disposed of with the following directions :\n<\/p>\n<p>i) Petitioner is to deposit an amount of Rs. 1 lakh directly in the<br \/>\nconcerned bank within a period of one month from today to show<br \/>\nbonafide on his part.\n<\/p>\n<p>ii) If petitioner deposits the above amount within the time so allowed<br \/>\nthen he is permitted to deposit the remaining amount directly in<br \/>\nconcerned Bank in five equal quarterly instalments. In calculating<br \/>\nthe arrears the amount (if any) already paid will be adjusted.\n<\/p>\n<p>iii) The first instalment may be deposited by 31st October, 2010,<br \/>\nsecond instalment by 31st January, 2011, third by 30th April, 2011,<br \/>\nfourth by 31st July, 2011 and fifth by 31st October, 2011. These<br \/>\ndeposits may be made before the branch of the Bank from where the<br \/>\nloan was taken. In case instalments are deposited in the Bank then<br \/>\n 50% of the recovery charges will be recovered.\n<\/p>\n<p>iv) During period of deposit the recovery proceedings will be kept in<br \/>\nabeyance. In case petitioner defaults in depositing any of the<br \/>\ninstalments within the above stipulated time, it will be open to the<br \/>\nrespondents to start recovery proceedings again by taking coercive<br \/>\nprocess at once.\n<\/p>\n<p>v) Petitioner may file an application for supply of statement of account<br \/>\nalong with duly stamped self addressed envelope. In case any such<br \/>\napplication is filed, the concerned branch of the Bank will give the<br \/>\nsame to the petitioner after deposit of first instalment within fifteen<br \/>\ndays.\n<\/p>\n<p>vi) This order will not affect any auction if it has already taken place. In<br \/>\nthat event the petitioner may take appropriate legal proceedings to set<br \/>\naside the auction under U.P.Z.A. &amp; L.R.
