\nthe respondent ?  State.\n<\/p>\n

\nMr. J.S. Yadav, learned advocate for the applicant and Mr. S.S.
\nPatel, learned A.P.P. for the respondent ?  state.\n<\/p>\n
3.\tThis
\nis an application u\/s 439 of the Code of Criminal Procedure,
\n1973 for regular bail as the applicant has been arrested by the
\npolice  in connection with the offence
\nregistered as CR No. I ?  283 of 2003 at Nadiad Town Police Station
\nfor the offences punishable u\/s 420, 114, 465, 468, 467, 471, 417 and
\n120-B of the I.P. Code.\n<\/p>\n
4.\tIt
\nis submitted by the learned advocate for the applicant that the
\napplicant was Chairman-cum-Director of   Swami Co-operative Credit
\nSociety Ltd., at Nadiad during the relevant time and he  had
\nsanctioned various loans to the members of
\nthe said credit society. However, the borrowers  could not repay the
\namount of loans and therefore the
\nAdministrator of the society  filed the present complaint   against
\nthe present applicant and other  members of the  Managing
\nCommittee and Directors of the Swami Co-operative Credit Society Ltd.
\nHe has also submitted that the  co-accused and other Directors
\nof the Swami Co-operative Credit Society Ltd. are released on
\nregular bail by the Court and the present applicant  is not released
\non bail though having played similar role and hence  on the ground of
\nparity the present applicant is required to be released on regular
\nbail.  Learned advocate for the applicant further
\nsubmitted that  the applicant had offered the property worth Rs.36.00
\nlacs to the Kheda Jilla Madhyastha Cooperative Bank Ltd.  against
\nthe outstanding  amount and therefore major part of the outstanding
\namount has been secured.  He has submitted
\nthat the civil suits for recovery of the remaining amount have been
\nfiled against the borrowers.\n<\/p>\n
He has submitted that  the charge sheet has also been filed and the
\ncase is based on the documentary evidence and therefore the applicant
\nshould be released on r regular bail.\n<\/p>\n
5.\tLearned
\nA.P.P. Mr. S.S. Patel submitted that the loans were also given to the
\nnon-members of the Swami Co-operative Credit Society Ltd. He has also
\nsubmitted that  other co-accused  who were the Directors
\nof the said credit society have been released on regular bail by the
\ncourt. He has also submitted that   some of the Directors of the
\ncredit society were released on anticipatory bail  by this Court and
\nthereafter they were released on regular bail by the court concerned.\n<\/p>\n
6.\tIt
\nappears from the complaint filed by Himatsinh P. Dabhi, Administrator
\nof Swami Co-operative Credit Society Ltd. before
\nNadiad Town Police Station that the applicant and other co-accused
\nhave advanced various loans  to their relatives and friends without
\nfollowing proper procedure and without obtaining security for the
\nrepayment of the advances made to the borrowers. It is also alleged
\nthat the applicant and other co-accused made advances to their
\nrelatives and friends who have failed to
\nrepay the loans. The applicant and other co-accused  have not passed
\nnecessary resolutions for grant of loans and have sanctioned  the
\nloans for their personal economic gain.\n<\/p>\n
7.\tIt
\nappears from the investigation papers that some of the co-accused
\nwho were  the Directors  of the Swami Co-operative Credit Society
\nLtd. were granted anticipatory bail and subsequently they were
\nreleased on  regular bail. Investigation papers  do not show  that
\nthe applicant has played any special or specific role in making
\nadvances to t he concerned borrowers.\n<\/p>\n
9.\tLearned
\nadvocate for the applicant  has also relied on decision  of this
\nCourt in the case of  Dashrathbhai Bholidas Patel
\nV. State of Gujarat and<\/a> another,
\nreported in 2004 CRI.L.J. 4369,
\nwherein this Court has released the applicant accused on bail on the
\nground of parity and  has  observed that
\n?Swhen the office bearers  are released
\non bail and when the investigation  qua the applicant  was over and
\nthe charge sheets were  filed, the applicant should be released on
\nbail on the ground of parity.??\n<\/p>\n
9.\tThe applicant  accused
\nhas been in the jail since more than  seven
\nmonths and the charge sheet  has already been filed.  It is also
\nstated that the applicant has offered  security to the Bank from
\nwhich major part of the advances   could
\nbe realised. A copy of the advertisement  is produced at Page 60 of
\nthe present compilation which also indicates that the Bank has
\ninvited the  tenders  for sale of the
\nproperty of the applicant situated at Swami Complex  at Nadiad. It
\nalso appears that other office bearers  who were parties to the
\nresolution  passed for making advances  to the borrowers  have been
\nreleased on regular bail. In these   circumstances,
\n   applicant ?   Pramodbhai Kantibhai Barot is required to be
\nreleased on regular  bail.\n<\/p>\n
10.\tConsidering  the
\nsubmissions made  on behalf of the parties
\nand having regard to facts and circumstances of the case, the
\napplication is allowed  and  applicant ?  Pramodbhai Kantibhai Barot
\n is released on regular  in connection with CR  No. I ?  283 of 2003
\nregistered at Nadiad Town Police Station on  his executing a bond of
\nRs.50,000\/- (Rupees Fifty Thousand only) with one surety
\nfor the lime amount to the satisfaction  of the lower court and the
\nsubject to  the conditions that the applicant shall,<\/p>\n
(a)\tnot take  undue
\nadvantage  of his  liberty or abuse his liberty;\n<\/p>\n
(b)\tnot act in a manner
\ninjurious  to the interest
\nof the prosecution;\n<\/p>\n
( c)\tmaintain  law and
\norder;\n<\/p>\n
(d)\tnot leave  the State
\nof Gujarat  without the prior permission of
\nthe Sessions Court concerned, <\/p>\n
(e)\tfurnish the address of
\nhis residence  at the time of execution  of the bond and shall not
\nchange the residence without  prior
\npermission  of the Court;\n<\/p>\n
(f)\tsurrender  his
\npassport, if any, to the lower court within
\na week.\n<\/p>\n
11.\tIf breach of any of
\nthe above conditions is committed,  the Sessions Judge concerned
\nwill be free to  take appropriate
\naction\/step in the matter.\n<\/p>\n
12.\tBail before the lower
\ncourt having jurisdiction to try the case.\n<\/p>\n
13.\tRule is made absolute.\n<\/p>\n

\nHe has also submitted that the  co-accused and other Directors
\nof the Swami Co-operative Credit Society Ltd. Are released on
\nregular bail by the Court and the present applicant  is not released

\non the ground of parity the present applicant is required to be
\nreleased on regular bail.  Learned advocate for the applicant further
\nsubmitted that  the applicant had offered the property worth Rs.36.00

9.\tLearned
\nadvocate for the applicant  has also relied on decision  of this

\nreleased on regular bail. In these   circumstances,
\n   applicant ?  Kantibhai Pramodbhai Barot is required to be
\nreleased on regular  bail.\n<\/p>\n
10.\tConsidering  the
\nsubmissions made  on behalf of the parties
\nand having regard to facts and circumstances of the case, the
\napplication is allowed  and  applicant ?  Pramodbhai Kantibhai Barot
\n is released on regular  in connection with CR  No. I ?  283 of 2003
\nregistered at Nadiad Town Police Station on his his executing a bond
\nof Rs.50,000\/- (Rupees Fifty Thousand only) with one surety
