Subodh Kumar S\/O Sri Vishwanath Prasad R\/O Vill.-Karmatard, P.S.- Jamtara,\nDistt.- Dumka, Presenty Residing At Jokihat, P.S.- Jokihat, Distt.- Purnea\n                                    -----------\n<\/pre>\n<p>03\/   20th July 2011              This Letters Patent Appeal has been filed<\/p>\n<p>                       against the Judgment passed on 06.10.2009 by the<\/p>\n<p>                       learned Single Judge in C.W.J.C. No. 1281 of 2009, by<\/p>\n<p>                       which the learned Single Judge has set aside the<\/p>\n<p>                       termination order relying on the case of Secretary, State<\/p>\n<p>                       of Karnataka Vs. Uma Devi and Ors. reported in<\/p>\n<p>                       2006(2)P.L.J.R.(SC)363, and considered by the Apex<\/p>\n<p>                       Court in the case of State of Karnataka &amp; Ors Vs. M.L.<\/p>\n<p>                       Kesari &amp; Ors. reported in (2010) 9 SCC 247. In<\/p>\n<p>                       paragraph 11 of the Judgment, the Apex Court has<\/p>\n<p>                       observed as follows:-\n<\/p>\n<blockquote><p>                                               &#8220;The object behind the<\/p>\n<p>                                said direction in para 53 of Umadevi<\/p>\n<p>                                is two fold. First is to ensure that those<\/p>\n<p>                                who have put in more than ten years<\/p>\n<p>                                of continuous service without the<br \/>\n<span class=\"hidden_text\">            2<\/span><\/p>\n<p>protection of any interim orders of<\/p>\n<p>court or tribunals, before the date of<\/p>\n<p>decision in Umadevi was rendered, are<\/p>\n<p>considered for regularization in view<\/p>\n<p>of their long service. Second is to<\/p>\n<p>ensure              that           the<\/p>\n<p>departments\/instrumentalities do not<\/p>\n<p>perpetuate the practice of employing<\/p>\n<p>persons on daily wage\/ ad hoc\/ casual<\/p>\n<p>basis for long periods and then<\/p>\n<p>periodically regularize them on the<\/p>\n<p>ground that they have served for more<\/p>\n<p>than ten years, thereby defeating the<\/p>\n<p>constitutional or statutory provisions<\/p>\n<p>relating       to   recruitment   and<\/p>\n<p>appointment. The true effect of the<\/p>\n<p>direction is that all persons who have<\/p>\n<p>worked for more than ten years as on<\/p>\n<p>10.04.2006 (the date of decision in<\/p>\n<p>Umadevi) without the protection of<\/p>\n<p>any interim order of any court or<\/p>\n<p>tribunal, in vacant posts, possessing<br \/>\n<span class=\"hidden_text\">                   3<\/span><\/p>\n<p>         the requisite qualification are entitled<\/p>\n<p>         to be considered for regularization.<\/p>\n<\/blockquote>\n<p>         The fact that the employer has not<\/p>\n<p>         undertaken     such     exercise     of<\/p>\n<p>         regularization within six months of the<\/p>\n<p>         decision in Umadevi or that such<\/p>\n<p>         exercise was undertaken only in<\/p>\n<p>         regard to a limited few, will not<\/p>\n<p>         disentitle such employees, the right to<\/p>\n<p>         be considered for regularization in<\/p>\n<p>         terms of the above direction in<\/p>\n<p>         Umadevi as a one time measure.&#8221;\n<\/p>\n<p>            In view of the above law laid down, the<\/p>\n<p>order of termination of the petitioners is illegal.<\/p>\n<p>Admittedly, the petitioners have completed more than<\/p>\n<p>ten years of their service, and have completed about 10<\/p>\n<p>years of service as against the vacant post, appointed by<\/p>\n<p>the competent authority and were paid salary and were<\/p>\n<p>also given promotion after regularization of service and<\/p>\n<p>confirmation. Their appointments cannot be said to be<\/p>\n<p>illegal, which differ from irregular appointment. The<\/p>\n<p>appointment of the petitioners also cannot be said to be<br \/>\n<span class=\"hidden_text\">                            4<\/span><\/p>\n<p>         irregular and as per law laid down in Uma Devi Case in<\/p>\n<p>         para 53 and M.L. Keshri&#8217;s case. The petitioners were<\/p>\n<p>         fully entitled for regularization of his service, therefore,<\/p>\n<p>         their termination is bad in law.\n<\/p>\n<p>                     The learned Single Judge has rightly allowed<\/p>\n<p>         the writ petition and set aside the termination order. The<\/p>\n<p>         petitioners shall be reinstated forthwith and salary shall<\/p>\n<p>         be paid month to month regularly and arrears of salary<\/p>\n<p>         shall be paid within four months. We fully agree with the<\/p>\n<p>         Judgment of the learned Single Judge.
