III<br \/>\n                 For the B.P.S.C. :- Mr. Kumar Brajendra Nath.\n<\/p>\n<p>                                      &#8212;&#8212;\n<\/p>\n<p>\n3   01\/10\/2010             The Court has heard learned counsel for the<\/p>\n<p>                   parties in detail on the question of rejection of claim of<\/p>\n<p>                   the petitioner by the Bihar Public Service Commission<\/p>\n<p>                   (hereinafter called the Commission) to treat him as a<\/p>\n<p>                   Scheduled Tribe candidate and against the withdrawal of<\/p>\n<p>                   the recommendation made earlier for appointment on the<\/p>\n<p>                   post of Inspector, Weights and Measures. Annexure-17<\/p>\n<p>                   is a detailed order which has been passed by the<br \/>\n<span class=\"hidden_text\">                   -2-<\/span><\/p>\n<p>Commission in the deliberation held of all its members<\/p>\n<p>and the clear fact which has emerged therein is that from<\/p>\n<p>the year 1990 onwards Gonds are treated as Backward<\/p>\n<p>caste and not Scheduled Tribes in the district of<\/p>\n<p>Gopalganj. This is based on various circulars issued by<\/p>\n<p>the State of Bihar and the department related thereto.<\/p>\n<p>There is weight in the reasoning given by the<\/p>\n<p>Commission dependent upon the state of affairs as<\/p>\n<p>existed when the question of appointment of the<\/p>\n<p>petitioner arose. This Court is not convinced that the<\/p>\n<p>decision rendered by the Commission is erroneous and<\/p>\n<p>requires interference.\n<\/p>\n<p>        Learned counsel thereafter submits that if the<\/p>\n<p>petitioner is given a chance, he can establish his claim<\/p>\n<p>and get himself declared as Scheduled Tribe from a<\/p>\n<p>forum which will be best suited to him. In this regard,<\/p>\n<p>this Court has no objection if the petitioner wants to<\/p>\n<p>embark upon but no order or direction can be issued in<\/p>\n<p>favour of the petitioner to quash the order of the<\/p>\n<p>Commission or to direct them for appointment of the<\/p>\n<p>petitioner as a Scheduled Tribe candidate in view of the<\/p>\n<p>facts and circumstances rendered in the impugned order.<br \/>\n<span class=\"hidden_text\">                          -3-<\/span><\/p>\n<p>                This writ application has no merit.
