Respondents\n\n\t\t\t\n\t\tPetition filed under Article 226 of the Constitution of India\npraying for issuance a writ of Habeas Corpus, directing the respondents to\nproduce the body of Ms.Idhaya Kamalam, wife of Mahalingam, before this Court and\nset her at liberty.\n\t\t\t\n!For Petitioner    :  Mr.S.Pon Senthil Kumaran\n\nFor  Respondents  :  Mr.S.P.Samuel Raj,\n\t              Addl.Public Prosecutor.\n\n:ORDER\n<\/pre>\n<p>\t(Order of the Court was made by G.RAJASURIA,J)<\/p>\n<p>\t\tHeard the learned counsel for the petitioner as well as the learned<br \/>\nAdditional Public Prosecutor for the State.\n<\/p>\n<p>\t\t2.This petition has been filed seeking for issuance of a writ of<br \/>\nhabeas corpus, directing the respondents to produce the body of Ms.Idhaya<br \/>\nKamalam, wife of the petitioner, before this Court and to set her at liberty.\n<\/p>\n<p>\t\t3.At the hearing, learned Additional Public Prosecutor would submit<br \/>\nthat on the complaint given by the petitioner an FIR has been registered in<br \/>\nCrime No.300\/2007 for the offence under Section 365 IPC.  Learned Additional<br \/>\nPublic Prosecutor also would submit that the police is sincerely looking into<br \/>\nthe matter.\n<\/p>\n<p>\t\t4.Learned counsel for the petitioner would air the grievance of the<br \/>\npetitioner to the effect that the petitioner does not know whether the detenue<br \/>\nis alive or not, for which the learned Additional Public Prosecutor would submit<br \/>\nthat the police is looking into the matter and taking appropriate action.\n<\/p>\n<p>\t\t5.Hence, in this circumstance, without deciding the truth or<br \/>\notherwise of the allegation, we would like to issue the following direction.<br \/>\n\t\tThe police shall continue their investigation and trace the detenue,<br \/>\nenquire her and if necessary produce her before the Magistrate Court concerned.<br \/>\nIf the investigation reveals otherwise, then suitable action, as per law, shall<br \/>\nbe taken.\n<\/p>\n<p>\t\t6.With the above direction, the habeas corpus petition is closed.\n<\/p>\n<p>To<\/p>\n<p>1.The Sub Inspector of Police,<br \/>\n  Kovilpatti East Police Station,<br \/>\n  Kovilpatti,<br \/>\n  Tuticorin  District.\n<\/p>\n<p>2.The Additional Public Prosecutor,<br \/>\n  Madurai Bench of Madras High Court,<br \/>\n  Madurai.\n<\/p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madras High Court S.Mahalingam vs The Sub Inspector Of Police on 9 May, 2007 BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED: 09\/05\/2007 CORAM THE HONOURABLE MS.JUSTICE K.SUGUNA and THE HONOURABLE MR.JUSTICE G.RAJASURIA HCP (MD)No.189 of 2007 S.Mahalingam ..
