SCA No.13423 of 2004 is<br \/>\npreferred against the judgement and award dated 21st April<br \/>\n2004 passed by Labour Court, Surendranagar in Reference (LCS) No.266<br \/>\nof 1993 and SCA No.14684 of 2007 is preferred against judgement and<br \/>\naward dated 9th November 2006 passed by Labour Court,<br \/>\nSurendranagar, in Reference (LCS) No.265 of 1993. In all the above<br \/>\nReferences the Labour Court, Surendranagar rejected the references of<br \/>\nthe concerned petitioners.\n<\/p>\n<p>2.\tIn<br \/>\nall the above cases the concerned petitioners were working with the<br \/>\nrespondent Agricultural Produce Market Committee, Surendranagar and<br \/>\ntheir services came to be terminated  in pursuance of which disputes<br \/>\nwere raised and which were referred to Labour Court, Surendranagar.<br \/>\nHowever the Labour Court rejected the  References and therefore the<br \/>\npresent petitions have been filed.\n<\/p>\n<p>3.\tIt<br \/>\nis pointed out that the Reference came to be rejected on the ground<br \/>\nthat APMC is not an industry, which is apparently not a correct view.<br \/>\nTherefore on this ground alone judgements and award require to be<br \/>\nquashed and set aside.\n<\/p>\n<p>4.\tHowever,<br \/>\nin view of the long lapse of time it would not be in the interest of<br \/>\njustice to remand the matter. I am therefore of the view that<br \/>\ninterest of justice would be met by directing the respondents to<br \/>\nreinstate the petitioners in service with continuity of service and<br \/>\nwithout back wages. Learned Advocates for the parties could not<br \/>\ndispute this proposition.\n<\/p>\n<p>5.\tIn<br \/>\nthe premises aforesaid, the judgement and award of the Labour Court<br \/>\nare quashed and set aside. The petitioners shall be reinstated with<br \/>\ncontinuity of service, within 30 days from the date of receipt of<br \/>\nwrit of this order, without back wages.
