MAHESH C VORA for Petitioner(s) : 1, \nNOTICE\nSERVED for Respondent(s) : 1 - 2. \nMS SEJAL K MANDAVIA for\nRespondent(s) : 1 -\n2. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 12\/08\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nway of this petition, the petitioner has prayed to quash and set<br \/>\naside the judgment and award passed by the Labour Court, Amreli in<br \/>\nReference (LCA) No.6\/2001 dated 01.01.2010, whereby, an amount of<br \/>\nRs.50,000\/- was awarded as compensation to the petitioner in lieu of<br \/>\nreinstatement and back wages.\n<\/p>\n<p>2.\tThe<br \/>\nfacts in brief are that the petitioner had raised an industrial<br \/>\ndispute against the action of the respondent-Board of terminating his<br \/>\nservices, which was referred to the Labour Court, Amreli for<br \/>\nadjudication. The same was numbered as Reference (LCA) No.6\/2001.<br \/>\nAfter considering the facts of the case and evidence on record, the<br \/>\nLabour Court awarded an amount of Rs.50,000\/- as compensation to the<br \/>\npetitioner in lieu of reinstatement and back wages. Being aggrieved<br \/>\nby the same, the petitioner has preferred the present petition.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record.\n<\/p>\n<p>4.\tToday,<br \/>\nwhen the matter was taken up for hearing, Ms. Sejal Mandavia, learned<br \/>\ncounsel appearing on behalf of the respondent-Board, submitted a copy<br \/>\nof the Undertaking dated 23.03.2010 executed by the petitioner<br \/>\nherein, which is taken on record. Having perused the said<br \/>\nUndertaking, it transpires that the petitioner has received payment<br \/>\nof the amount, as directed by the Labour Court, on 23.03.2010. In the<br \/>\nsaid Undertaking, the petitioner has categorically stated that having<br \/>\naccepted the said amount of Rs.50,000\/-, there does not remain any<br \/>\ngrievance against the respondent-Board and that he would not file any<br \/>\nlitigation before any Court of Law in the subject matter in future.\n<\/p>\n<p>5.\tNow,<br \/>\nwhen the petitioner has accepted the amount, as awarded by the Labour<br \/>\nCourt, without any objection on 23.03.2010, for which he has also<br \/>\nexecuted an Undertaking in writing, it is not open to him to<br \/>\nchallenge the award subsequently. Further, the petitioner has not<br \/>\ndisclosed the fact regarding acceptance of the said amount of<br \/>\nRs.50,000\/- in this petition. Thus, the present petition deserves to<br \/>\nbe rejected on two counts, firstly, he has filed the present<br \/>\npetition, after having accepted the amount as awarded by the Labour<br \/>\nCourt and for which he had executed a written Undertaking to the<br \/>\neffect that he does not have any grievance against the<br \/>\nrespondent-Board and also that he would not file any litigation<br \/>\nbefore any Court of Law in the subject matter in future,; and<br \/>\nsecondly, for suppression of the fact regarding acceptance of the<br \/>\nsaid amount of Rs.50,000\/- in the present petition.\n<\/p>\n<p>6.\tFor<br \/>\nthe foregoing reasons, the petition is dismissed with a cost of<br \/>\nRs.500\/- [Rupees Five hundred only] to be paid to the<br \/>\nrespondent-Board.
