This  appeal by special leave arises from the  judgment<br \/>\nof the Division Bench of the Punjab &amp; Haryana High Court  in<br \/>\nCWP  No. 388 of 1987 which was dismissed on 23-11-1987.\t  On<br \/>\n14-9-1985 the Market Committee of Shri Hargobindpur Sahib in<br \/>\nGurdaspur District had published in the daily newspaper Ajit<br \/>\ncalling applications to fill the posts of Auction  Recorder,<br \/>\nElectrician,  Helper,  Chowkidar and Clerk  etc.   It  would<br \/>\nappear that on 28-9-1985 a sub-committee was constituted for<br \/>\nselection  of the candidates and on the same  day  selection<br \/>\nwas done.  The General Body of the Market Committee approved<br \/>\nthe selection and letters of appointment were issued<br \/>\nFrom  the Judgment and Order dated 23-11-1987 of the  Punjab<br \/>\nand Haryana High Court in C.W.P. No. 388 of 1987<br \/>\n<span class=\"hidden_text\">321<\/span><br \/>\nand  the selected candidates had joined on the same  day  on<br \/>\nregular\t  basis.   On  17-1-1987  the  Board  reviewed\t the<br \/>\nappointments   and  terminated\ttheir\tappointments.\t The<br \/>\nappellant  challenged  the  termination\t orders.   The\tHigh<br \/>\nCourt,\tas  stated earlier, dismissed the writ\tpetition  on<br \/>\ndiverse grounds.  Thus, this appeal by special leave.\n<\/p>\n<p>2.   Shri  K. Madhava Reddy, the learned Senior Counsel\t for<br \/>\nthe appellants strenuously contended that the Committee\t was<br \/>\nduly constituted to select the candidates; advertisement  in<br \/>\nthe local newspaper was made inviting the applications;\t the<br \/>\nappellants  along with others had applied for and were\tduly<br \/>\nselected  to the existing regular posts as on that date\t and<br \/>\nwere  duly  appointed.\tThough there was ban on\t ad  hoc  or<br \/>\ntemporary appointments, there was no ban on the\t appointment<br \/>\nto  the regular posts which came to be issued on  18-10-1985<br \/>\nand that therefore, the appointment of the appellants cannot<br \/>\nbe said to be irregular or illegal.  He also contended\tthat<br \/>\nthe cancellation was made by the Board without notice to the<br \/>\nappellants  and that therefore, it is violative of not\tonly<br \/>\nthe regulations, but also the principles of natural justice.<br \/>\nIn  the view we are taking, it is not necessary to  consider<br \/>\nthe  questions\traised by the appellants or the\t grounds  on<br \/>\nwhich  the High Court affirmed the order of cancellation  of<br \/>\nappointments made by the Board.\n<\/p>\n<p>3.   Subsequent\t to the cancellation of the  appointment  of<br \/>\nthe  appellants, on a regular advertisement candidates\twere<br \/>\nselected, appointments were made and posts have been  filled<br \/>\nup.   Those candidates have been functioning from  27-5-1987<br \/>\nonwards.  They are not before this Court nor are they sought<br \/>\nto  be\timpleaded in the High Court.  Therefore,  any  order<br \/>\nthat  may be passed by this Court would have adverse  effect<br \/>\nof unsettling their appointment without they being impleaded<br \/>\nand without any opportunity of hearing given to them.  Under<br \/>\nthose circumstances, we decline to interfere with the  order<br \/>\nof  the\t High Court and the order of  the  Market  Committee<br \/>\ncancelling the appointments of the appellants.\tHowever,  if<br \/>\nany future vacancies were to arise or any existing for which<br \/>\nany  regular recruitment is to be made, the  appellants\t may<br \/>\nalso apply for and their cases may also be considered  along<br \/>\nwith others according to rules.\t In case by that date,\tthey<br \/>\nbecome barred by age, the necessary relaxation in respect of<br \/>\nage may be given and they may also be considered along\twith<br \/>\nother\tqualified  candidates  for  selection\tto   regular<br \/>\nappointments.  Any payments made for the period during which<br \/>\nthe  appellants\t were  in  service  from  the  date  of\t the<br \/>\nappointment till the date of termination and they worked  in<br \/>\nthat  period, there may not be any order for I\trecovery  of<br \/>\nthe same.\n<\/p>\n<p>4.
