No. 166\/2006 in the file of Judicial<\/p>\n<p>First   Class   Magistrate&#8217;s   Court,   Mavelikara   with   respect   to   the   offence   under<\/p>\n<p>section 138 of the Negotiable Instruments Act has sought for a direction to the<\/p>\n<p>court below that there may not be an order of pre-trial detention at the time of his<\/p>\n<p>appearance. It was submitted that he could not appear before the court as on<\/p>\n<p>20.6.2006 as  no summons was received.\n<\/p>\n<\/p>\n<p>       In   the   circumstances,   the   petitioner   is   directed   to   surrender   before   the<\/p>\n<p>court below within two weeks from today and file an application for bail.   Non-<\/p>\n<p>Bailable warrant is  not to be executed in the meantime.  Pre-trial detention is not<\/p>\n<p>required.  The court below shall as far as possible dispose of the application for<\/p>\n<p>bail, to be filed on the date of appearance of the petitioner itself.  The Crl.M.C. is<\/p>\n<p>disposed of accordingly.\n<\/p>\n<\/p>\n<p>                                                 K.R.
