S.J. MUKHOPADHAYA)<\/p>\n<p> After<br \/>\n taking into consideration the stand taken by the parties, it is not<br \/>\ndesirable to decide the main issue whether the Central Government can<br \/>\ndemand over-charged amount with interest or not, which actually is<br \/>\nrequired to be determined by the learned Single Judge after hearing<br \/>\nthe parties. We are, therefore, of the view that instead of the<br \/>\nnature of stay, as ordered by the learned Single Judge, the<br \/>\nappellant-petitioner should be directed to pay 50% of the total<br \/>\namount during the pendency of SCA No. 5028\/2009.  We accordingly<br \/>\ndirect the petitioner to deposit a sum of<br \/>\nRs. 32,00,000\/= within<br \/>\ntwo weeks, subject to the decision of the case. The learned Single<br \/>\nJudge will decide whether the said amount, wrongly charged, should be<br \/>\nrefunded back to the original petitioner or not. The order passed by<br \/>\nthe learned Single Judge and the earlier orders passed by this Court<br \/>\nstand modified to the aforesaid extent.\n<\/p>\n<p> SCA No. 5028\/2009 is ordered to be listed before the concerned<br \/>\nlearned Single Judge  on 13th<br \/>\nSeptember 2010 as the first case. We request the learned Single Judge<br \/>\nto decide the same without granting unnecessary adjournments to the<br \/>\nparties.\n<\/p>\n<p>  LPA &amp; CA No. 13040\/2009 stand disposed of with the aforesaid<br \/>\nobservation and direction.
