Learned advocate Ms. Qureshi for Shri Pritesh L.Parikh for<br \/>\npetitioner was heard at length.  Learned advocate Shri Jani was also<br \/>\nheard.  Eventually, the petition was adjourned at the request of<br \/>\nlearned advocate for the petitioner to make additional submissions.<br \/>\nThereafter also matter was adjourned from time to time.  Today note<br \/>\nis given by learned advocate Shri Pritesh Parikh in which it is<br \/>\nstated that the petitioner has taken away papers from him and he<br \/>\nwould, therefore like to retire from the matter.  His request is<br \/>\ngranted.\n<\/p>\n<p>\tIn<br \/>\nfact on 27th September, 2006, when this matter was last on<br \/>\nboard, one Shri B.M.Patel, claiming to be Managing Director of<br \/>\npetitioner society had mentioned before the Court that he would be<br \/>\nrequesting his learned advocate to retire from the matter and he<br \/>\nwould be pursuing the petition himself.\n<\/p>\n<p>\tToday<br \/>\nsaid Shri B.M.Patel is not present before the Court.  One Shri Pravin<br \/>\nPatel claiming to be brother of Shri B.M.Patel states that Shri<br \/>\nB.M.Patel is not present due to his personal reasons.\n<\/p>\n<p>\tThough<br \/>\nI am inclined to permit the learned advocate for the petitioner to<br \/>\nretire from the matter, I am not inclined to adjourn the matter any<br \/>\nlonger.\n<\/p>\n<p>\tUnder<br \/>\nthe circumstances, in absence of any representation from the<br \/>\npetitioner, this petition is dismissed for want of prosecution.  Rule<br \/>\nis discharged.  Interim relief vacated.??\n<\/p>\n<p>This<br \/>\n\tMisc. Civil Application has been filed purported to be on behalf of<br \/>\n\tthe original petitioner seeking restoration of Special Civil<br \/>\n\tApplication.\n<\/p>\n<p>Normally,<br \/>\n\trestoration of a matter is liberally granted by this Court and would<br \/>\n\tbe under normal circumstances a matter of course. In the present<br \/>\n\tcase however, it was not clear whether Shri B.M. Patel who has<br \/>\n\tsought restoration at the behest of the petitioner-society had the<br \/>\n\tauthority to seek such restoration. Previously, therefore, when Shri<br \/>\n\tB.M. Patel had appeared before this Court on 25th<br \/>\n\tJanuary, 2007 in person, I had explained to him about the doubt I<br \/>\n\thad in my mind about his authority to represent the society and to<br \/>\n\tseek restoration of the matter. He had therefore, prayed for time<br \/>\n\twhich was granted upto 8th February, 2007 to produce<br \/>\n\tnecessary material showing his authority to represent the<br \/>\n\tpetitioner-society. Accordingly, he has produced a document titled<br \/>\n\tas ?SFinal argument list of events?? along with which he has also<br \/>\n\tproduced certain documents on which reliance is sought to be placed.\n<\/p>\n<p>He<br \/>\n\tcontends that he is a recovery officer appointed by AGM of the<br \/>\n\tpetitioner-society and he is duly authorised by the resolution of<br \/>\n\tthe society to represent the society in the litigation.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Shri P.K. Jani appearing on advance copy on behalf of<br \/>\n\trespondent no.3 pointed out the contents of affidavit in reply dated<br \/>\n\t7th February, 2007 filed by the said respondent stating<br \/>\n\tthat the Cooperation Department of the Government of Gujarat has<br \/>\n\tappointed an Administrator to administer the affairs of the Society<br \/>\n\tunder Section 81 of the Gujarat Cooperative Societies Act and that<br \/>\n\ttherefore, Shri B.M. Patel is not competent to file the application<br \/>\n\tseeking restoration.\n<\/p>\n<p>Though<br \/>\n\taffidavit in rejoinder has been filed by Shri B.M. Patel to the said<br \/>\n\taffidavit filed by respondent no.3, this factual aspect has not been<br \/>\n\tdenied. Fact therefore, remains that currently the affairs of the<br \/>\n\tsociety are in the hands of the administrator. It may be as stated<br \/>\n\tby Shri B.M.Patel that the society has preferred an appeal against<br \/>\n\tthe appointment of administrator, but as admitted by him no stay has<br \/>\n\tbeen granted.\n<\/p>\n<p>In<br \/>\n\tmy opinion, therefore, Shri B.M.Patel   neither has any authority to<br \/>\n\trepresent the petitioner-society or to seek restoration of the<br \/>\n\tpetition. Only on that ground, Misc.
