No.75 of 2010\n                  = = = = = = = = = = = = = = = = =\n             Dated, this the 6th day of January,   2010\n\n                             O R D E R\n<\/pre>\n<p>      In this Revision   Petition filed under Section 397 read with<\/p>\n<p>Sec. 401     Cr.P.C. the petitioner who was the 2nd accused in<\/p>\n<p>C.C.No.792 of 2005 on the file of the J.F.C.M-III, challenges the<\/p>\n<p>conviction entered and the sentence passed against him for an<\/p>\n<p>offence punishable under Sec. 138 of the Negotiable Instruments<\/p>\n<p>Act, 1881 (hereinafter referred to as &#8216;the Act&#8217;).  The        cheque<\/p>\n<p>amount was Rs.1,00,000\/-. The compensation ordered by the lower<\/p>\n<p>appellate court is Rs.50,000\/-\n<\/p>\n<p>      2.    I heard the learned counsel for the Revision Petitioner<\/p>\n<p>and the learned Public Prosecutor.\n<\/p>\n<p>      3.    The learned counsel appearing for the Revision<\/p>\n<p>Petitioner re-iterated the contentions in support of the Revision.<\/p>\n<p>      4.     The courts below have concurrently held that the<\/p>\n<p>cheque in question was drawn by the petitioner in favour of the<\/p>\n<p>complainant, that the complainant had validly complied with<\/p>\n<p>clauses (a) and (b) of the proviso to Section 138 of the Act.    and<\/p>\n<p>that the Revision Petitioner\/accused failed to make the payment<\/p>\n<p>within 15 days of receipt of the statutory notice. Both the courts<\/p>\n<p>have considered and rejected the defence set up by the revision<\/p>\n<p>petitioner while entering the conviction. The said conviction has<\/p>\n<p>been recorded       after a careful evaluation     of the oral and<\/p>\n<p>documentary evidence. This Court sitting in the rarefied revisional<\/p>\n<p>jurisdiction will be loath to interfere with the findings of fact<\/p>\n<p>recorded by the courts below concurrently.       I do   not find any<\/p>\n<p><span class=\"hidden_text\">Crl.R..P. No. 75\/10                        -:2:-<\/span><\/p>\n<p>error, illegality or impropriety in the conviction             so recorded<\/p>\n<p>concurrently by the courts below and the same is hereby<\/p>\n<p>confirmed.\n<\/p>\n<p>       5.       What now survives for consideration is the legality of<\/p>\n<p>the sentence imposed on the revision petitioner.             In the light of<\/p>\n<p>the    decision      of     the     Supreme      Court  in     Ettappadan<\/p>\n<p>Ahammedkutty             v. E.P. Abdullakoya &#8211; 2008 (1) KLT 851<\/p>\n<p>default sentence cannot be imposed for the enforcement of an<\/p>\n<p>order for compensation under Sec. 357 (3) Cr.P.C.                     I am,<\/p>\n<p>therefore, inclined to modify the sentence to one of             fine only.<\/p>\n<p>Accordingly, for the conviction under Section 138 of the Act the<\/p>\n<p>revision petitioner is sentenced to pay a fine of             Rs. 55,000\/-<\/p>\n<p>(Rupees fifty five thousand only).               The said fine shall be paid<\/p>\n<p>as compensation under Section 357 (1) Cr.P.C.                  The revision<\/p>\n<p>petitioner is permitted            either to deposit the said fine amount<\/p>\n<p>before the Court below or directly pay the compensation to the<\/p>\n<p>complainant within 4           months from today and produce a memo to<\/p>\n<p>that effect before the trial Court in case of direct payment. If he<\/p>\n<p>fails to deposit or pay the said amount within the aforementioned<\/p>\n<p>period he shall suffer simple imprisonment for three months by<\/p>\n<p>way of default sentence.\n<\/p>\n<\/p>\n<p>       In the result, this Revision is disposed of confirming the<\/p>\n<p>conviction entered but modifying the sentence imposed on the<\/p>\n<p>revision petitioner.\n<\/p>\n<p>       Dated this the 6h day of January , 2010.\n<\/p>\n<\/p>\n<p>                                                  V.
