M.S.SHAH)<\/p>\n<p>\t\tMr.A.M.Parekh,<br \/>\nlearned advocate for the appellant, submits that the order dated<br \/>\n24.3.2008 (Annexure-F to the petition) suffers from the vice of<br \/>\nnon-application of mind and arbitrariness in as much as the Collector<br \/>\nallowed the appeal of respondent No.3 herein, Prince Satyanaran<br \/>\nKhatik,  only on the ground that Prince Satyanaran Khatik was the<br \/>\nfirst to file an appeal before the State Government, which appeal was<br \/>\nnot accepted by the State Government and, thereafter, the High Court<br \/>\nentertained the petition and ultimately remanded the matter to the<br \/>\nCollector. The said order of the Collector refers to the fact that no<br \/>\nother party had obtained any order from the competent Court and that<br \/>\nonly a letter was sent to the Collector.\n<\/p>\n<p>2.\t\tIt<br \/>\nis submitted by Mr.Parekh that this fact was brought to the notice of<br \/>\nthe State Government. It is submitted that the State Government&#8217;s<br \/>\norder dated 10.6.2008 in favour of the appellant ought not to have<br \/>\nbeen interfered by the learned single Judge merely because the order<br \/>\nwas not drafted in a meticulous manner.\n<\/p>\n<p>3.\t\tNOTICE<br \/>\nfor final disposal returnable on 13.08.2008.
