No.258 of 2009\n                      -------------------------------------\n             Dated this the 19th day of January, 2009\n\n                                  ORDER\n<\/pre>\n<p>      Petitioner faces indictment in a prosecution under Section<\/p>\n<p>138 of the Negotiable Instruments Act. The petitioner has not<\/p>\n<p>entered appearance so far. The petitioner is employed abroad, it<\/p>\n<p>is submitted. Knowing that fact fully, a distant relative of the<\/p>\n<p>petitioner as the complainant has initiated this prosecution<\/p>\n<p>under Section 138 of the Negotiable Instruments Act to vex and<\/p>\n<p>harass the petitioner.       Non bailable warrants issued by the<\/p>\n<p>learned Magistrate are chasing the petitioner.                Steps under<\/p>\n<p>Sections 80 to 83 Cr.P.C are pending.\n<\/p>\n<p>      2.    According to the petitioner, he is absolutely innocent.<\/p>\n<p>There was no wilful disobedience of the processes of the court by<\/p>\n<p>him. He is willing to appear before the learned Magistrate. But<\/p>\n<p>as he is employed abroad he is not able to immediately appear<\/p>\n<p>before the learned Magistrate.                He will appear before the<\/p>\n<p>learned Magistrate though his counsel and claim exemption from<\/p>\n<p>his personal appearance. But coercive processes against him<\/p>\n<p>may not be executed at this juncture, it is prayed.<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No.258 of 2009         2<\/span><\/p>\n<p>      3.   The petitioner has rushed to this Court unnecessarily.<\/p>\n<p>In the light of the decision in <a href=\"\/doc\/1924828\/\">Jain Babu v. Joseph<\/a> [2008(4)<\/p>\n<p>KLT 16] as explained later in <a href=\"\/doc\/1942135\/\">Rohit S.Ved v. State of Kerala<\/a><\/p>\n<p>[2008 (4) KLT 671], it is for the petitioner to appear before the<\/p>\n<p>learned Magistrate through a counsel and apply for exemption.<\/p>\n<p>Instead of doing that the petitioner has unnecessarily rushed to<\/p>\n<p>this Court.   I am, in these circumstances, satisfied that this<\/p>\n<p>petition can only be dismissed with the specific observation that<\/p>\n<p>the petitioner can appear before the learned Magistrate through<\/p>\n<p>counsel and claim the advantage of the decisions in <a href=\"\/doc\/1924828\/\">Jain Babu v.<\/p>\n<p>Joseph<\/a> [2008(4) KLT 16] and <a href=\"\/doc\/1942135\/\">Rohit S.Ved v. State of Kerala<\/a><\/p>\n<p>[2008 (4) KLT 671]. Needless to say, the learned Magistrate<\/p>\n<p>must consider the same and pass appropriate orders on merits.<\/p>\n<p>      4.
