Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :04\/03\/2008\n\n O R D E R\n             THOTTATHIL B.RADHAKRISHNAN , J.\n                     =======================\n                      W.P.(C) No.5837   of 2008(T)\n                     =======================\n\n                 Dated this the 4th day of March, 2008\n\n\n                            JUDGMENT\n<\/pre>\n<p>      The 4th respondent was issued Ext.R4(a) licence on<\/p>\n<p>18.5.2007 to conduct a Toddy Shop. The petitioner, a retired<\/p>\n<p>teacher and recipient of Ext.P1, challenges the licence on<\/p>\n<p>different grounds. He relies on Rule 7(15) of the Kerala Abkari<\/p>\n<p>Shop Disposal Rules, 2002 and Section 18A(2) of the Abkari Act<\/p>\n<p>to state that the issuance of licence on 18.5.2007 that is beyond<\/p>\n<p>the period of one year is not only without authority but in<\/p>\n<p>violation of the laws. He further states that the premises from<\/p>\n<p>which the Toddy is being sold is in a building which is not<\/p>\n<p>approved by    the Panchayat authorities. He further states that<\/p>\n<p>the sale is not only unauthorised but within the prohibited<\/p>\n<p>distance from certain institutions.\n<\/p>\n<p>      2.   Referring to Rule 5(16) of the Rules, it is pointed out<\/p>\n<p>by the learned Government Pleader that the requirements of<\/p>\n<p>execution of agreement etc. have to be done within a reasonable<\/p>\n<p><span class=\"hidden_text\"> W.P.(C) No.5837\/2008\/T            -2-<\/span><\/p>\n<p>time and that the agreement has been executed within a<\/p>\n<p>reasonable time and hence there is no violation of the Rules. The<\/p>\n<p>learned counsel appearing for the 4th respondent submits that<\/p>\n<p>Rule 7(15) is only part of the general conditions applicable to<\/p>\n<p>licences and the provision in Rule 7(15) that shops not     opened<\/p>\n<p>within one month from the date of receipt of confirmation of sale<\/p>\n<p>of shop shall be liable to be resold or disposed otherwise at the<\/p>\n<p>risk and loss of the licencees is only a liability which the<\/p>\n<p>government may enforce and is not one that will result in the<\/p>\n<p>licence becoming void. The general conditions of licence which<\/p>\n<p>are incorporated in the licence issued and signed by the licencee<\/p>\n<p>is characterized by the learned counsel for the 4th respondent as<\/p>\n<p>not in terms,      mandatory nature, in the sense that it does not<\/p>\n<p>result in any statutory cancellation of the licence and that if the<\/p>\n<p>government does not move to enforce the liability of being resold<\/p>\n<p>or disposed otherwise, a citizen cannot insist on the enforcement<\/p>\n<p>of that Rule. In that sense Rule 7(15) is characterized as only<\/p>\n<p>directing and not mandatory.\n<\/p>\n<p>      3.     Even if I were to resolve all the issues raised in this<\/p>\n<p>writ petition, the counter affidavit of the 4th respondent contains<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.5837\/2008\/T            -3-<\/span><\/p>\n<p>the averment that he had done his part of the requirement in<\/p>\n<p>terms of the rules, however, that the issuance of licence was<\/p>\n<p>delayed because the files were processed by the department after<\/p>\n<p>considering the objections and such delay cannot be put against<\/p>\n<p>the 4th respondent.\n<\/p>\n<p>     4.     The learned counsel for the petitioner has referred to<\/p>\n<p>the judgment of this Court in <a href=\"\/doc\/1423573\/\">Balakrishnan Nair v. State of<\/p>\n<p>Kerala<\/a> (1996 (1) KLT 14) to argue that a prescription as to law<\/p>\n<p>binds not only private citizens but also the statutory authorities,<\/p>\n<p>who are bound to enforce the law. He, accordingly, urges that<\/p>\n<p>even if the department was in default, the licence is void.<\/p>\n<p>     5.     A plain reading of Rule 7(15) appears to suggest that<\/p>\n<p>the said part of the general conditions of licence       gives the<\/p>\n<p>Government the power to have the shop resold or disposed of<\/p>\n<p>otherwise. If it is not opened within one month from the date of<\/p>\n<p>receipt of confirmation of sale of that shop, such resale or<\/p>\n<p>disposal could be at the risk and loss of licencees. Rule 5(16)<\/p>\n<p>referred to by the learned Government Pleader which primarily<\/p>\n<p>governs the grant of privilege of vending toddy enjoins the<\/p>\n<p>condition that the original rental paid by the licencee shall be<\/p>\n<p><span class=\"hidden_text\"> W.P.(C) No.5837\/2008\/T            -4-<\/span><\/p>\n<p>forfeited and the group resold or otherwise disposed of if the<\/p>\n<p>purchaser fails to comply with the requirements of executing the<\/p>\n<p>agreement and taking out necessary licence within a reasonable<\/p>\n<p>time. The time lag in the case cannot be treated as unreasonable<\/p>\n<p>since Ext.R4(a) licence is issued on 18.5.2007. Rule 5(16) is also<\/p>\n<p>designed in such a way that the result of enforcement of that rule<\/p>\n<p>is forfeiture and the result of that rule does not provide for an<\/p>\n<p>automatic cessation of the licence by efflux of time. That rule<\/p>\n<p>also does not require the Government or statutory authority to<\/p>\n<p>apply forfeiture on the expiry of one month but leaves it to the<\/p>\n<p>wisdom of the Abkari officers to decide whether the licence has<\/p>\n<p>been availed and an agreement executed within a reasonable<\/p>\n<p>time.\n<\/p>\n<p>      6.     As of now, the considerations of the aforesaid<\/p>\n<p>questions would exist,    in my considered view, is only academic<\/p>\n<p>because, by the efflux of time, all that remains is the expiry of<\/p>\n<p>the period of licence for this year, which is co-terminus with the<\/p>\n<p>expiry of the current Abkari year.          It is stated that the<\/p>\n<p>Government has already released the policy document in relation<\/p>\n<p>to the Abkari policy for the next year and it does not provide for<\/p>\n<p><span class=\"hidden_text\"> W.P.(C) No.5837\/2008\/T             -5-<\/span><\/p>\n<p>any renewal of any existing licence.\n<\/p>\n<p>      7.     Having regard to the aforesaid, ends of justice will<\/p>\n<p>remain satisfied if the competent authority       takes care of the<\/p>\n<p>petitioner&#8217;s complaint regarding the identity of the land and<\/p>\n<p>building and his objections to the conduct of the toddy shop in<\/p>\n<p>the said site and in the building in question.\n<\/p>\n<p>      In the result, while refusing to interfere with the impugned<\/p>\n<p>licence, it is directed that the objections of the petitioner to the<\/p>\n<p>housing of a toddy shop in the site in question shall be<\/p>\n<p>considered if and when any shop is         proposed to be licenced<\/p>\n<p>from the said site in the coming Abkari year.\n<\/p>\n<p>      Writ petition ordered accordingly.\n<\/p>\n<\/p>\n<p>                         THOTTATHIL B.RADHAKRISHNAN,<br \/>\n                                        JUDGE<\/p>\n<p>jp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court P.I.Avirah vs State Of Kerala on 4 March, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C) No. 5837 of 2008(T) 1.
