On\t the\ndeath of the deceased he wrapped the dead body in a  blanket\nand left it in a railway compartment.  He was convicted\t and\nsentenced to death.\nOn appeal to this Court on the question of sentence\nHELD  :\t While\tmurder in its aggravated  form\tand  in\t the\nabsence\t  of  extenuating  factors  connected  with   crime,\ncriminal  or legal process, still is condignly visited\twith\ndeath\tpenalty,   a  compassionate  alternative   of\tlife\nimprisonment in all other circumstances is gaining  judicial\nground. [357 G-H]\nIn the instant case a few ameliorative features fall to\nbe  noticed since judicial temper has more  components\tthan\nindignation   against  murder.\tThe  appellant\tis  in\t his\ntwenties,  not\t irrelevant in considering  death  sentence.\nHe  was\t a married man.\t He was promiscuous  with  women,  a\nsalacious  sin\tfor which the deceased was  a  contributory.\nThe  latter's  pressure to get him to marry  her  must\thave\nplanted the seed of murderous thought in him.  He  bargained\nfor  romance,  encouraged by the-victim\t but  her  pretended\npregnancy upset the appellant.\tSome planning and  treachery\nhave aggravated the crime.  Yet another circumstance is that\nthe man was sentenced to death nearly two years ago and\t the\nspecter\t of  death  penalty must have  tormented  his  soul.\nTaken  separately,  none  of these matters  may\t suffice  to\ncommute but the conspectus of factors, personal and  social,\ntilt the scales in favour of life term.\t L357 El\n\n\n\nJUDGMENT:\n<\/pre>\n<p>CRIMINAL, APPELLATE JURISDICTION : Criminal Appeal No. 124<br \/>\nof 1973.\n<\/p>\n<p>Appeal\tby special leave from the judgment and\torder  dated<br \/>\nthe 30th November, 1972 of the Punjab and Haryana High Court<br \/>\nin  Criminal Appeal No. 632 of 1972 and Murder Ref.  No.  27<br \/>\nof 1972.\n<\/p>\n<p>Nuruddin Ahmed and S. K. Mehta, for the appellant.<br \/>\nGautam Goswami and R. N. Sachthey, for the respondent.<br \/>\nThe Judgment of the Court was delivered by<br \/>\nKRISHNA IYER, J. A young woman was vomitted into death by  a<br \/>\nyoung  man by giving her a cup of milk mixed with  a  lethal<br \/>\ndose  of stricnine.  He, along with two others, bundled\t the<br \/>\ncadaver\t into  a  Delhibound train  but\t the  coach  cleaner<br \/>\ndiscovered  it,\t the police unearthed the crime,  the  court<br \/>\nconvicted  the\tculprits awarding capital  sentence  to\t the<br \/>\nkiller and lighter punishments to the two accessories  after<br \/>\nthe  fact,  under  S. 201, I.P.C.  Special  leave  has\tbeen<br \/>\ngranted to the only appellant on the sole ground of sentence<br \/>\nand so our scrutiny is confined to the circumstances of\t the<br \/>\ncrime\tand  criminal  and  the\t penological  propriety\t  of<br \/>\ninflicting the higher or lesser punishment.\n<\/p>\n<p><span class=\"hidden_text\">357<\/span><\/p>\n<p>Twenty\tsix-years-old  Raghubir Singh&#8211;the  appellant-was  a<br \/>\nlesser\tofficial  in the Malaria Eradication  Department  in<br \/>\nGorior,\t a village in Rajasthan.  He became friends  with  a<br \/>\nveterinary   official,\tSri  Sharma,  P.W.  13,\t and  by   a<br \/>\nconcatenation  of innocent circumstances the appellant\tcame<br \/>\ninto  carnal  comity with Kailashwati, the  2nd\t accused,  a<br \/>\nmidwife\t in  a\tlocal hospital.\t Later,\t the  appellant\t was<br \/>\ntransferred  to a village Mandhapia in the  Family  Planning<br \/>\nDepartment  where he came across Sushma Thomas, a  nurse  in<br \/>\nthe same department.\t Prurient   Raghubir  picked  up   a<br \/>\nliaison with this malayalee belle  older  to  him  by\tfive<br \/>\nyears and-going by the medical evidence, not a\t  virgin.<br \/>\nShe  seems  to have feigned pregnancy probably\tto  force  a<br \/>\nmatrimony  for\twhich Raghubir was  reluctant.\t After\tmany<br \/>\ntwists\tand turns of events, on June 6, 1971, the  appellant<br \/>\nsecured half a grain of stricnine hydrochloride from Sharma,<br \/>\nthe  friend, on the pretext that it was needed\tfor  killing<br \/>\nstray dogs.  This Sharma&#8217;s naivete in supplying poison looks<br \/>\nsuspicious  and\t it  is for Government\tto  look  into,\t re-<br \/>\nmembering that he was more than a dispensing chemist in this<br \/>\ncase.  Anyway, the amorous pair spent the night of the\t10th<br \/>\nJune  at the quarters of the 2nd accused, and the  appellant<br \/>\nbrought-milk for the deceased who consumed the cup of death.<br \/>\nAfter  agonising hours of vomitting struggle,  she  breathed<br \/>\nher  last,  was\t wrapped in a blanket and  given  a  railway<br \/>\nburial.\n<\/p>\n<p>The  criminal  act was treacherous murder and  deserved\t the<br \/>\nsterner\t sentence.  But a few ameliorative features fall  to<br \/>\nbe  noticed since judicial temper has more  components\tthan<br \/>\nindignation against murder.  The convict is in his twenties,<br \/>\nnot irrelevant in considering death sentence.  He is said to<br \/>\nbe  a  married\tman. He  bargained<br \/>\nfor  romance,  encouraged by the victim but  the  pregnancy-<br \/>\nthough pretended-in a society which views unmarried  mothers<br \/>\nas  vicious upset the appellant.  These have no\t bearing  on<br \/>\nguilt at all but attenuate the lethal touch of the sentence.<br \/>\nSome planning and treachery have aggravated the crime, which<br \/>\nalso must not be overlooked.  Yet another circumstance.\t The<br \/>\nman  was sentenced to death as early as 23rd May, 1972,\t and<br \/>\nfor  twenty  months the specter of death penalty  must\thave<br \/>\ntormented  his\tsoul.  Taken separately, none of  these\t may<br \/>\nsuffice\t to commute but the conspectus of factors,  personal<br \/>\nand  social, tilt the scales in favour of a life  term.\t  We<br \/>\nhave  in  another case discussed at some length\t how  modern<br \/>\npenology  leans less towards death penalty and the winds  of<br \/>\ncriminological\tchange blow over Indian\t statutory  thought.<br \/>\nWhile  murder in its aggravated form and in the\t absence  of<br \/>\nextenuating factors connected with crime, criminal or  legal<br \/>\nprocess,  still is condignly visited with death\t penalty,  a<br \/>\ncompassionate alternative of life imprisonment in all  other<br \/>\ncircumstances is gaining judicial ground..
