Heard learned counsels.\n\n\n2.      These two revisions petitions are directed against the order of\n\nlearned trial court dated 28\/3\/2008 and 23\/4\/2008, whereby, the\n\nlearned trial court rejected the application under Order 7 Rule 11 CPC\n\nof Municipal Council, Pali, whereby, Municipal Council submitted\n\nthat the suit under Section 6 of the Specific Relief Act, 1963 was not\n\nmaintainable against it, the Municipal Council being falling within\n\nthe definition of `Government' and excluded from the ambit and\n\nscope of Section 6 of the said Act.\n\n\n\n3.      Learned counsel for the Municipal Council drew the attention\n\nof the Court towards the definition of Municipality under Section 3\n S.B.C. REVISION Pet. No.168\/2008 - Municipal Council Pali vs. Shiv Lal and others\nS.B.C. REVISION Pet. No.167\/2008 - Municipal Council Pali vs. Shiv Lal and others\nOrder dt: 1\/12\/2008\n\n                                            2\/5\n\n(16) of the Rajasthan Municipalities Act, 1959, which is reproduced\n\nhereunder:-\n\n\n         \"(16) `Municipality', That is to say, nagarpalika means\n         an institution (by whatever name called) of self-\n         government for the urban areas, in existence at the\n         time of commencement of, or constituted in\n         accordance with, the provisions of, the Act\"\n\n\n4.      He also drew the attention of the Court towards Section 6 of the\n\nSpecific Relief Act, 1963, which is also reproduced hereunder:-\n\n\n          \"Section 6. Suit by person dispossessed of immovable\n          property.-\n          (1) If any person is dispossessed without his consent\n          of immovable property otherwise than in due course of\n          law, he or any person claiming through him may, by\n          suit, recover possession thereof, notwithstanding any\n          other title that may be set up in such suit.\n\n          (2) No suit under this Section shall be brought -\n          (a) after the expiry of six months from the date of\n          dispossession; or\n          (b) against the Government.\n\n          (3) No appeal shall lie from any order or decree\n          passed in any suit instituted under this section, nor\n          shall any review of any such order or decree be\n          allowed.\n\n          (4) Nothing in this section shall bar any person\n          from suing to establish his title to such property and to\n          recover possession thereof.\"\n S.B.C. Learned counsel for the petitioner submits that obviously the\n\npurpose of excluding the Government from the ambit and scope of\n\nSection 6 is to ensure that dispossession from municipal property by\n\nGovernment agency is not involved in the litigation under Section 6\n\nof the Specific Relief Act, 1963, which is a summary proceedings for\n\nclaiming back the possession within six months from the date of\n\ndispossession irrespective of any other title that may be set up in such\n\nsuit. He submitted that the said suit was mainly against the petitioner-\n\nMunicipal Council, Pali and respondent-plaintiff was clearly found\n\nto be encroachee over the land of Municipal Council, therefore, he\n\nwas dispossessed from the said land.\n\n\n\n6.      Learned counsel for the respondent-plaintiff, however, opposed\n\nthe submissions and submits that the Municipal Council cannot be\n\nsaid to be part of State as the words `self government' have been used\n\nin Section 3(16) of the Rajasthan Municipalities Act, 1959. He\n\nsubmitted that the learned trial court has not erred in rejecting the\n\napplication under Order 7 Rule 11 CPC.\n\n\n\n7.      Having considered the rival submissions and upon perusal of\n S.B.C. REVISION Pet. No.168\/2008 - Municipal Council Pali vs. Shiv Lal and others\nS.B.C. REVISION Pet. No.167\/2008 - Municipal Council Pali vs. Shiv Lal and others\nOrder dt: 1\/12\/2008\n\n                                            4\/5\n\ndefinitions reproduced above, this Court is satisfied that Section 6 of\n\nthe Specific Relief Act, 1963 being a remedy of summary nature\n\nagainst the dispossession of a person without his consent of\n\nimmovable property otherwise than in due course of law excludes the\n\nGovernment from its ambit and scope. Hardly any debate is required\n\nto be held, to hold that the Municipality is part of Government and it\n\nis defined as an Institution of self-government for urban areas and it\n\nworks under the enactment of State Legislation. Therefore, it is a part\n\nof Government and works under the full control of State Government\n\neven through the elected bodies like Municipal Councils, Municipal\n\nBoards and Municipal Corporations.\n\n\n\n8.      This courts, thus, cannot find any force in the submissions of\n\nlearned counsel for the respondent-plaintiff that the Municipal\n\nCouncil is not a part of State or Government and cannot be excluded\n\nfrom the ambit and scope of Section 6 of the Specific Relief Act,\n\n1963. The suit against Government under Section 6 of the Act having,\n\nthus, obviously being barred by the provisions of Section 6(2) of the\n\nAct, the learned trial court has committed an error in rejecting the\n\nsaid application of the petitioner-Municipal Council, Pali, under\n S.B.C. REVISION Pet. No.168\/2008 - Municipal Council Pali vs. Shiv Lal and others\nS.B.C. REVISION Pet. No.167\/2008 - Municipal Council Pali vs. Shiv Lal and others\nOrder dt: 1\/12\/2008\n\n                                            5\/5\n\nOrder 7 Rule 11 CPC.\n\n\n\n9.       Consequently, these revision petitions of Municipal Council\n\nare allowed and the impugned orders of the learned trial court dated\n\n28\/3\/2008 and 23\/4\/2008 respectively are quashed and set aside and\n\napplications under Order 7 Rule 11 CPC of the petitioner-Municipal\n\nCouncil, Pali stand allowed. Consequently, suit no.2\/2008 <a href=\"\/doc\/463280\/\">(Shiv Lal\n\n&amp; Ors vs. Municipal Council, Pali)<\/a> stands dismissed.
