suit in View of Section 59 of the Act and held tilatttize<\/p>\n
plaintiffs’ \ufb01rm being an unregistered  <\/p>\n
the bar under Section 69 of  uh’<\/p>\n
application and consequently, the\u00ab\u00e91o%i\u00a7re3’V  f.<\/p>\n
held that the suit of the pema\ufb01rs is not a t<\/p>\n
and accordingly dismissed  d<\/p>\n

to enforce a right arising from a contract or<\/p>\n

\nin execution or other proceeding

\nsuit or claim. ”\n<\/p>\n

6. A careful reading of subsection (3) of Section 69<\/p>\n
will make it clear that the bar contained in sub~sec.ftions<\/p>\n
(1) and (2) shall not have any effect iltsoilfm <\/p>\n
enforcement of any right to sue for the  ‘pf ta  t <\/p>\n
\ufb01rm or for accounts of a dissolved  elf   ‘V9: <\/p>\n
power to realise the pr0pe1fty.4__of at’   in <\/p>\n
View of the above exception  o1tt~’t.\u00e9uti\u00a7$ec\ufb01on
\n(3) (a), the suit of the ‘  tj\u00e9ingiiot ma\ufb01tainable,<\/p>\n
therefore, does not   teetitrts below have<\/p>\n
erred     provisions of Section
\n69 and   (3)(a) of Section 69.\n<\/p>\n
7. :.A.s_   question being dissolved is<\/p>\n
. lotxte\ufb02f\u00e9\u00e9tppeliate ctzaurt has also referred to<\/p>\n
  171\/1989 and the judgxnent rendered<\/p>\n
tht-3I”t:.i11,___v is produced as Ex.P–1, to hold that the<\/p>\n
   itt’q\u00a71estion was in fact dissolved. Therefore, the<\/p>\n
  egtsctaf the plaintiffs \ufb01lls squarely within the pmvisions<\/p>\n
Vt  -\u00bbc-o;ntai11ed in sub–sectioI1 (3)(a) of Section 69 of the Act.<\/p>\n
The courts below, therefore, were in error in holding that<\/p>\n
the suit of the plaintiffs is not maintainable.<\/p>\n

8. The lower appellate court dismissed the appeal<\/p>\n
filed by the pla\u00a7z1ti\ufb01’s only on the basis of the  V.<\/p>\n
as regards the suit of the plaJ’11t.i\ufb02’s”  WV”  K <\/p>\n
maintainable and did not go intowotlier   <\/p>\n
matter. The documents  by   <\/p>\n

the C. RC. were ,.   the<\/p>\n
application came to   jslppellants new<\/p>\n
