Justice K.HEMA\n\n Dated :20\/06\/2008\n\n O R D E R\n                              K.HEMA, J.\n\n                  -----------------------------------------\n                         B.A.No.3932 of 2008\n                  -----------------------------------------\n\n               Dated this the 20th day of June, 2008\n\n                               O R D E R\n<\/pre>\n<p>      This petition is for bail.\n<\/p>\n<p>      2. The alleged offences are under Sections 420, 120B &amp; 379<\/p>\n<p>of Indian Penal Code. According to prosecution, the petitioner was<\/p>\n<p>operating a parallel telephone exchange. It is alleged that by doing<\/p>\n<p>so, he has caused loss to the Department and Government. He was<\/p>\n<p>arrested on 13.5.2008. He is in custody since then.<\/p>\n<p>      3. The petitioner was questioned and the seizure is effected<\/p>\n<p>and the petitioner&#8217;s custody may not be required for further<\/p>\n<p>investigation. It is submitted by learned Public Prosecutor that the<\/p>\n<p>petitioner could not be arrested for a long time and hence stringent<\/p>\n<p>conditions may be imposed while granting bail.<\/p>\n<p>      Hence, petitioner is granted bail on the following terms and<\/p>\n<p>conditions:\n<\/p>\n<p>      i) Petitioner shall execute a bond for Rs.25,000\/- with two<\/p>\n<p>solvent sureties each for the like sum to the satisfaction of the<\/p>\n<p>court below.\n<\/p>\n<p>      ii) Petitioner shall report before the investigating officer on<\/p>\n<p><span class=\"hidden_text\">    BA.3932\/08                      2<\/span><\/p>\n<p>every Monday and Thursday between 10 AM and 1 PM until further<\/p>\n<p>orders.\n<\/p>\n<p>     iii) Petitioner shall not leave limits of the police station within<\/p>\n<p>which crime is registered except with previous permission of<\/p>\n<p>learned Magistrate.\n<\/p>\n<p>     Petition is allowed.\n<\/p>\n<\/p>\n<p>                                   K.HEMA, JUDGE<\/p>\n<p>vgs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Abdul Nazer vs State Of Kerala on 20 June, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 3932 of 2008() 1.
