SIRI JAGAN, J.\n                    ---------------------------------\n                    W.P.(C)NO. 12062 OF 2005\n                   ----------------------------------\n          DATED THIS THE 2nd DAY OF AUGUST, 2007\n\n                                JUDGMENT\n<\/pre>\n<p>            The petitioners are toddy shop workers attached to the<\/p>\n<p>toddy shop No.15 of Kuravilangad range, of which the 2nd respondent<\/p>\n<p>is the licencee. Their complaint in this writ petition is that despite a<\/p>\n<p>complaint made to the 1st respondent regarding non-payment of<\/p>\n<p>arrears of salary and workers&#8217; welfare fund contributions, the 1st<\/p>\n<p>respondent is not taking any action. The petitioners, therefore, seek<\/p>\n<p>the following reliefs.\n<\/p>\n<p>                        &#8221;      i)   issue a writ of mandamus<br \/>\n                  or any other appropriate writ, order or<br \/>\n                  direction directing the 1st respondent to<br \/>\n                  pass    final  orders  on   the    complaints<br \/>\n                  evidenced by Exhibits P3 to P5 directing the<br \/>\n                  2nd respondent to pay the arrears of salary<br \/>\n                  due to the petitioners for the year 2003-04<br \/>\n                  within a time limit and if he fails to pay the<br \/>\n                  amount recover the same by revenue<br \/>\n                  recovery steps and pay to the petitioners as<br \/>\n                  expeditiously as possible at any rate within<br \/>\n                  a time limit to be fixed by this Honourable<br \/>\n                  Court;\n<\/p>\n<pre>                        ii)    issue a writ of mandamus or\n                  any   other    appropriate  writ,   order   or\n<\/pre>\n<p>                  direction directing the 3rd respondent to<br \/>\n                  pass   final   determination   orders   under<br \/>\n                  Section 8 of T.S.No.15 of Kuravilangad<br \/>\n                  Excise Range and recover the balance as<br \/>\n                  expeditiously as possible at any rate within<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.12062\/07                  2<\/span><\/p>\n<p>                  a  time    limit to  be   fixed by   this<br \/>\n                  Honourable Court&#8221;\n<\/p>\n<p>       2.    The petitioners would submit that the arrears of salary<\/p>\n<p>would come to Rs.30,000\/-.         The learned counsel for the 2nd<\/p>\n<p>respondent, while disputing this, would submit that it would be only<\/p>\n<p>around Rs.25,000\/-.      To avoid any controversy and to give the<\/p>\n<p>dispute a quietus, I fix it as Rs.28,000\/-. This shall be paid to the<\/p>\n<p>petitioners within one month from today. In respect of the welfare<\/p>\n<p>fund contributions, the 2nd respondents submits that there is some<\/p>\n<p>dispute regarding the quantum.        It would be open to the 2nd<\/p>\n<p>respondent to take up the matter with the 3rd respondent, who<\/p>\n<p>shall pass orders in this regard within a period of one month from<\/p>\n<p>the date of receipt of representation from the 2nd respondent, which<\/p>\n<p>he shall file within one month from today. If the 2nd respondent<\/p>\n<p>does not file the representation as directed above the 3rd<\/p>\n<p>respondent shall initiate appropriate proceedings for recovery if<\/p>\n<p>there is default in payment of contributions as alleged by the<\/p>\n<p>petitioners.\n<\/p>\n<p>      The writ petition is disposed of as above.<\/p>\n<p>                                        S.
