Justice J.M.JAMES\n\n Dated :11\/12\/2006\n\n O R D E R\n                           J.M.JAMES, J.\n\n                             -------------------\n\n                        W.P.(C). 32872\/2006\n\n                            --------------------\n\n            Dated this  the 11th day of December, 2006\n\n\n                             JUDGMENT\n<\/pre>\n<p>              The writ petitioner, Devikulam  Taluk Plantation<\/p>\n<p>Workers   Co-operative   Credit   Society   Limited   No.K-382,<\/p>\n<p>had requested for amendment of its bye-laws.   Therefore,<\/p>\n<p>the   writ   petitioner   had     approached   the   Joint   Registrar,<\/p>\n<p>the   third   respondent,   as   per   the   provisions   contained<\/p>\n<p>under   Rule   9   of   the   Kerala   Co-operative   Societies   Rules,<\/p>\n<p>1969, in short &#8216;the Rules&#8217;.\n<\/p>\n<\/p>\n<p>      2.      The   learned   counsel   appearing   for   the     writ<\/p>\n<p>petitioner   brought   to   my   notice,   the   report   dated<\/p>\n<p>24.5.2006 of the fourth respondent,  Assistant Registrar of<\/p>\n<p>Co-operative Society (General),   in which he had reported<\/p>\n<p>that   all   the   requirements   of   Rule   9(3)   of   the   Rules   had<\/p>\n<p>been complied with, by the writ petitioner.<\/p>\n<p>      3.      The   learned   Government   Pleader   however,<\/p>\n<p>submits that there had been a complaint to the effect that<\/p>\n<p>no general body, as contemplated under rule 9(3)(a) of the<\/p>\n<p>W.P.(C).32872\/2006<\/p>\n<p><span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>Rules   had   been   complied   with   and,   therefore,<\/p>\n<p>amendment of the bye-laws could not be ordered to.<\/p>\n<p>      4.     Section   12(4B)   of   the   Kerala   Co-operative<\/p>\n<p>Societies Act, 1969, in short &#8216;the Act&#8217; lays down that if an<\/p>\n<p>application to register an amendment of the bye-laws of a<\/p>\n<p>society   is   not   disposed   of   within   the   time   specified   in<\/p>\n<p>sub-section (4A), the Society may make a representation;<\/p>\n<p>(a).     before   the   Registrar   and   then,     (b).     before   the<\/p>\n<p>Government.\n<\/p>\n<\/p>\n<p>      5.     In   the   case   at   hand,   the   Joint   Registrar   was<\/p>\n<p>approached   for   registering   the     amendment   of   the   bye-<\/p>\n<p>laws,   under   Section   3(2)   of   the   Act.     A   representation<\/p>\n<p>was   given   to   the   Registrar,   as   Joint   Registrar   did   not<\/p>\n<p>register   the   amendment   of   the   bye-laws,     proposed   by<\/p>\n<p>the   writ   petitioner,   Society.     The   said   representation   is<\/p>\n<p>also pending with the Registrar.\n<\/p>\n<\/p>\n<p>      6.     I   am   not   satisfied   with   the   submission   of   the<\/p>\n<p>learned Government Pleader.  In the meanwhile,  there is<\/p>\n<p>a   complaint   also   and   the   same   is   being   enquired   into.<\/p>\n<p>Even   if   there   is   such   a   complaint   and   an   enquiry   is<\/p>\n<p>W.P.(C).32872\/2006<\/p>\n<p><span class=\"hidden_text\">                                       3<\/span><\/p>\n<p>being proceeded with,   the Registrar has to give a reply<\/p>\n<p>to the writ petitioner, as per  Sub-Section (4B) of Section<\/p>\n<p>12   of   the   Act.     The   grievance   of   the   writ     petitioner   is<\/p>\n<p>that no reply had been given and the registration is also<\/p>\n<p>pending.\n<\/p>\n<\/p>\n<p>        7.
