between the parties and there being’ no  caused”, <\/p>\n
to the defendants, ought to have <\/p>\n
doing so and by rejecting I.AV,l3.._S’,~w..the Triai Colu-rt”ha’s\u00bb~acted ” it<\/p>\n
irrationally and hence_..the :i,mp’ugn’e,d orci’er_is:\u00a7 illegal.

\nparties, in as much as the suit filed being one for
\ncomprehensive reliefs, the trial having taken piace\u00e9fthe<\/p>\n
Court is justified in rejecting I.A.3.5.<\/p>\n
4. A perusal of the impugned orde.r_,s_:nowiS::’that,'”f<\/p>\n
the Triai Court has noticed that, <\/p>\n
application by the plaintiff seeking’-._amendm’ent: of <\/p>\n
piaint and the plaintiff had the l{‘n.o”wledge’ affine ees even
\neariier, which he could have stat_eci’ :.a_t,:th.e timefuof filing of
\nthe suit. It has further  fthatitiiie; hoider has<\/p>\n
deposedas”–l\u00a7\u00a7\\i_\u00a71\\:?\u00a7hro:u;i:t:  the documents were
\nmarkedVV”an’d\u00ab. that; has examined PWs 2 to 5,<\/p>\n
through whiom_”cer’tain=. adrnissions appear to have been<\/p>\n
.–‘r…,glici-ted A.theV”V’d”ei’e’ndants and that the proposed<\/p>\n
  does not taily with the record of the<\/p>\n
su’it,__’a%nd Va,n’VVr:entirely new case is sought to be introduced,<\/p>\n
V%fi”‘…,,”\u00bb.i\/which ifjailowed, wouid alter the nature of suit. Finding<\/p>\n
“ft_hat,””‘*there are no genuine and reasonabie grounds to<\/p>\n
  allow the prayer, I.A.1S was rejected. L<\/p>\n

S. In view of the rival contentions and the record,<\/p>\n
the point for consideration is:\n<\/p>\n
Whether the impugned order is irrational and .ii’iega_i’? _<\/p>\n
6. Indisputediy, on the date  ”\n<\/p>\n
issues had been framed and substantia*i~.par.t  of-‘then<\/p>\n
suit had taken place. Hence,  not_’h’a.ve <\/p>\n
allowed by the Trial Court,’   had-.,,c’orn’el”‘to the
\nconclusion that, in spite:-of duei’dili.g_:en’ce, the’p’l~ainrtiff could
\nnot have raised the mattlerl’beforefco_n’ii\ufb01fieLn’cement of trial.<\/p>\n
The power und,er.:’Ru_le  is discretionary.<\/p>\n
It shouiidi'”b’e..iiiuseidi-3,”judic\u00a7i’ousiy”‘on4 consideration of the
\ncircumstances of The object of the rule is to<\/p>\n
avoid _r_m.rltipiicity.Vyofiiproceedings. Amendment can be<\/p>\n
“‘\u00ab..allovwe~d;_whi.ch sa’tisi’–i–es’the two conditions namely, (a) Of<\/p>\n
vJo”rlk:_i:no*injustice to the other side and (b) Being<\/p>\n
nece’sisary.’fo’if the purpose of determining real question in<\/p>\n
‘gcontroversy between the parties. Prayer to amend should<\/p>\n
A ‘*?.beV’lr’ef_.used, when it has the effect to take away from the<\/p>\n
  party, a legal right accrued to him. \\<\/p>\n

7. The petitioner by filing I.A.1S, not merely<\/p>\n
proposed additional pleading and an item of property…__i_3ut<\/p>\n
has also prayed for deletion of the averments made’:inf”yth’e.f’<\/p>\n
plaint. The proposed pleading, when perused.-.y’:aiongjV’<\/p>\n
the plaint, is unnecessary to decid-etthe real V<\/p>\n
controversy between the parties.\n<\/p>\n

\nrecord shows that, the   .I.A.15 but the

\nhave stated  case which was proposed to<\/p>\n

\nwas directed to dispose of the suit itself at the earliest and
\npreferably within 3 months from the date of receipt of the<\/p>\n

the original records to the Trial Court <\/p>\n
period fixed by this Court for disposal    <\/p>\n

\napplication. In View ofy..thei~.ypie_adingS,'alriea'dy on record,<\/p>\n
the proposedilyl'ad*ditional_:"pleading in I.A No.15 is not
\nnecessaryto deci'de"t.he  :question in controversy. The<\/p>\n
plaintififf may in'sti.tute separate suit in respect of item No.2<\/p>\n
 Vpropierty;.th.e"cause of action being separate and distinct.<\/p>\n
 the trial of the suit is stated to be<\/p>\n
